Court Rules President Trump Can Defund Planned Parenthood, Will Cut Almost $60 Million in Taxpayer Funding

A federal appeals court today ruled President Donald Trump can partially defund planned Parenthood while the abortion business’ lawsuit agaisnt his administrations new rules moves forward.

As LifeNews reported in March, the Trump administration finalized an administrative rule that would partially defund the Planned Parenthood abortion business and deprive it of as much as $60 million in taxpayer dollars. This action adds to President Trump’s record of defunding the Planned Parenthood abortion company.

The abortion chain receives about $50 million to $60 million in Title X funds annually, but that could change now that the new rules are being implemented. The administration’s changes to Title X family planning grants have angered the abortion chain Planned Parenthood, prompting a lawsuit, but they provide hope for life-affirming pregnancy centers, which can now compete with the abortion giant for the federal funds.

Title X funds are supposed to be used to help low-income women and men receive birth control, cancer screenings and other health care services. While the tax money cannot be used to pay for abortions, it indirectly funds Planned Parenthood’s vast abortion business.

Today, the 9th U.S. Circuit Court of Appeals granted the Trump administration’s request to lift national injunctions ordered by lower federal courts in Oregon and Washington state, as well as a statewide injunction in California. As Politico reports:

A three-judge panel said the administration will likely prevail in the legal battle over the Title X family planning program since similar Reagan-era rules were upheld by the Supreme Court almost 30 years ago.

“Absent a stay, HHS will be forced to allow taxpayer dollars to be spent in a manner that it has concluded violates the law, as well as the Government’s important policy interest in ensuring that taxpayer dollars do not go to fund or subsidize abortions,” wrote the judges, all appointees of previous Republican presidents, in a 3-0 opinion.

Last May, the Trump administration published a new proposal for Title X that would prohibit Planned Parenthood and other abortion businesses from receiving any of those tax dollarsunless they completely separate their abortion businesses from their taxpayer-funded services. That mean housing their family planning services in separate buildings with separate staff from their abortion businesses and a denial of funds if they fail to do so. Most Planned Parenthood entities are not expected to comply.

Under the new directive, which will take effect in 60 days, organizations receiving Title X funding have 120 days to financially separate their family planning and abortion operations and one year to physically separate their family planning and abortion operations.

The “Protect Life Rule,” as that proposal is known, was finalized today. And pro-life groups are delighted by the news.

“We thank President Trump for taking decisive action to disentangle taxpayers from the big abortion industry led by Planned Parenthood,” said SBA List President Marjorie Dannenfelser.

She told LifeNews: “The Protect Life Rule does not cut family planning funding by a single dime, and instead directs tax dollars to entities that provide healthcare to women but do not perform abortions. The Title X program was not intended to be a slush fund for abortion businesses like Planned Parenthood, which violently ends the lives of more than 332,000 unborn babies a year and receives almost $60 million a year in Title X taxpayer dollars. We thank President Trump and Secretary Azar for ensuring that the Title X program is truly about funding family planning, not abortion.”

National Right to Life president Carol Tobias also praised President Trump and noted that the decision doesn’t adversely affect women’s health because the federal funds will go to legitimate family planning efforts instead of places that kill babies in abortions.

“We thank President Trump and Health & Human Services Secretary Azar for their numerous actions to restore pro-life policies,” she told LifeNews. “We are encouraged to see the announcement of Title X regulations that are back in line with previous policy that prevents federal dollars from being used to directly or indirectly promote abortion domestically.”

According to National Right to Life, during the Reagan Administration, regulations were issued, with National Right to Life’s strong support, to restore the original character of Title X by prohibiting referral for abortion except in life endangering circumstances. Additionally, abortion facilities could not generally share the same location with a Title X site.

In the 1991 Rust v. Sullivan decision, the U.S. Supreme Court found similar regulations permissible.

However, the Clinton Administration would later reverse these regulations.

A recent Marist poll found that, by a double-digit margin, a majority of all Americans oppose any taxpayer funding of abortion (54 percent to 39 percent).

UK court orders forced abortion for disabled woman

London, England, Jun 21, 2019 / 11:15 am (CNA).- A British judge has authorized doctors to perform an abortion on a pregnant Catholic woman with developmental disabilities and a mood disorder, despite the objections of the woman’s mother and the woman herself. The woman is 22 weeks pregnant.

“I am acutely conscious of the fact that for the State to order a woman to have a termination where it appears that she doesn't want it is an immense intrusion,” said Justice Nathalie Lieven in her ruling in the Court of Protection, June 21.

“I have to operate in [her] best interests, not on society's views of termination,” Lieven explained, arguing that her decision is in the best interest of the woman.

The Court of Protection handles cases involving individuals judged to lack the mental capacity to make decisions for themselves.

The woman, who cannot been publicly identified, has been described as “in her twenties,” and is under the care of an NHS trust, part of the UK’s National Health Service.

 

 

Doctors at the trust wished to abort her pregnancy and argued that, due to her diminished mental capacity, the abortion would be less traumatic for the woman than giving birth, especially if the baby would then be placed in foster care.

The woman’s mother made clear to doctors and the court that she would assume care of her grandchild.

The woman is believed to have the mental capacity of a grade school-age child. She is reportedly Catholic, and her mother is Nigerian.

It is unknown if the pregnancy was conceived consensually, and police are investigating the circumstances of conception.

The woman’s mother, reported to be a former midwife, registered her absolute opposition to the abortion citing the Catholic faith of herself and her daughter. A social worker who cares for the woman also disagreed that she should be forced to have an abortion.

The judge said she did not believe the woman understood what it meant to have a baby.

“I think she would like to have a baby in the same way she would like to have a nice doll,” Lieven said.

Lieven also said she did not believe the woman's mother, who already helps care for her daughter, would be able to offer care for a grandchild at the same time.

Allowing the child to be born and then removed from the woman’s home and placed into foster care or adoption would be against the woman’s own interests, the judge concluded.

 

 

“I think [the woman] would suffer greater trauma from having a baby removed [from her care],” Lieven said, because “it would at that stage be a real baby.”

Lieven clarified that the pregnancy “although real to [the woman], doesn’t have a baby outside her body she can touch.”

As a lawyer, Lieven has appeared in court before in cases concerning abortion. In 2011, while representing the British Pregnancy Advisory Service, an abortion provider, she argued that British women should be permitted to medically abort their pregnancies at their own homes instead of in a hospital.

Five years later, Lieven argued in court that Northern Ireland’s abortion laws were a violation of the United Kingdom’s Human Rights Act.

In 2017, she said that Northern Ireland’s abortion laws were akin to torture and were discriminatory.

Unrestricted abortion is legal in the UK until 24 weeks of pregnancy, after which doctors must certify that the abortion is in the medical interests of the mother.

NHS statistics show babies born at 24 weeks have a 50% chance of survival on average, though the rate depends on the NHS trust providing care. Babies born in a University College London Hospitals NHS Foundation Trust hospital in London at 23 weeks of gestation have a 70% chance of survival.

Missouri Health Department Declines to Renew License for State's Last Abortion Clinic

Missouri’s health department declined to renew the license of the state’s last abortion clinic Friday, in a move that could eventually make the state the first in the U.S. without an abortion clinic in decades.

For now, the decision is symbolic. The clinic will continue providing abortion services while a court injunction remains in effect.

The state’s Department of Health and Senior Services announced it wouldn’t renew the license for the Reproductive Health Services of Planned Parenthood of the St. Louis Region before a Friday court hearing. The clinic’s license was set to expire May 31, but a St. Louis Circuit Court issued a preliminary injunction that kept its doors open. That injunction will stay in effect until further ruling from the court, a judge said in a hearing Friday morning.

“We will continue providing abortion care for as long as the court protects our ability to do so,” said Colleen McNicholas, a reproductive health doctor at the St. Louis clinic, in a statement after the hearing.

Earlier this month, Circuit Judge Michael Stelzer set a June 21 deadline for the state’s health department to decide whether to renew the clinic’s license. With the department’s decision Friday, the judge must now weigh next steps. At the hearing, Judge Stelzer said he would issue at least one more order on the case, taking into account the state’s decision not to renew the license.

“I can’t imagine that injunction can stand for too long,” said Rigel Oliveri, a professor at the University of Missouri School of Law. “That’s a tough spot for the court to be in, ordering a medical facility to be open when it’s been ordered to be closed for patient safety reasons.”

Randall Williams, director of the Department of Health and Senior Services, said Friday the department chose not to renew the license after the clinic failed to address a number of issues raised by the state.

“We never let anything interfere with the basic patient care that a patient is receiving,” he added.

 

The clinic has defended its practices and argued the state has used “fear mongering” as a tactic to push back against abortion access in Missouri. The state has said its focus is on maintaining health and safety standards.

“If you don’t provide a standard of care that ensures the safety of women, you shouldn’t be allowed to operate. It’s that simple,” Missouri Gov. Mike Parson said in a statement. He added that if the clinic can show it is abiding by state laws and regulations, “it has every right, under the law, to have its license renewed.”

Last week, the state’s health department filed a statement to the court that described 30 deficiencies and issues it found with the clinic, including details of “failed” abortion procedures that required further treatment. The department described the alleged deficiencies as “troubling instances and deviations from the standard care.”

It asked the court to reconsider its injunction, which the judge denied.

Days later, Planned Parenthood sent the health department a plan of correction, which the clinic said addressed issues raised by the state. In the four-page cover letter provided to The Wall Street Journal by Planned Parenthood, Kawanna Shannon, director of surgical services at the St. Louis clinic, described many of the department’s claims as “vague, unsupportable and baseless.” A representative from Planned Parenthood declined to detail the clinic’s plan.

Ahead of Friday’s decision, the clinic announced it would no longer comply with a state regulation that Planned Parenthood said required doctors to perform two pelvic exams before an abortion. Dr. Williams, the health department director, said Friday he would enact an emergency rule to allow the clinic to defer the additional pelvic exam.

For years, state regulations have required patients receiving abortions to undergo a pelvic exam before the procedure. But recently, the clinic said, the state has required an additional pelvic exam to take place during state-mandated counseling sessions, which occur 72 hours before the procedure. Clinic doctors have described the additional exam as medically unnecessary.

Missouri is one of six states with just one abortion clinic, including Kentucky, Mississippi, West Virginia, North Dakota and South Dakota, according to the Guttmacher Institute, a policy organization that supports abortion rights.

The legal fight in Missouri comes as a number of states have enacted stricter abortion laws and regulations as they take aim at the legality of the Supreme Court’s 1973 Roe v. Wade ruling. In Missouri, lawmakers passed legislation last month that prohibited abortion after eight weeks of pregnancy, except in cases of medical emergency. More liberal state legislatures, like in neighboring Illinois, have enacted laws enshrining abortion protections in response to the possibility of more limited access to the procedure.

The rescue of a newborn girl who was found alive inside a plastic bag in the Georgia woodswas captured on body-cam video, authorities said Tuesday.

The Forsyth County Sheriff’s Office made the video public in the hope that it will generate credible tips in the case of Baby India.

 

Authorities have been searching for the baby’s mother since June 6, when a family in a nearby home heard her crying in a wooded area in Cumming, about 35 miles north of Atlanta

 

 

 

"My kids said, 'That's a baby,' and I said 'That's an animal," a man who reported the noise tells responding deputies.

The video shows deputies tearing open the plastic bag containing the child as she cries. Then, they wrap her in a blanket to keep her warm.

Authorities said Tuesday that Baby India "is thriving and is in the care of the Georgia Department of Family and Children Services".

 

Officials are asking the public to share any knowledge of a woman in the late stages of pregnancy who may have given birth to the baby. Under Georgia law, a mother who does not want a baby can hand the child over to law enforcement officers in a designated area, such as a police department or fire station.

"We release this footage in hopes to receive credible information on the identity of Baby India and to show how important it is to find closure in this case," the sheriff's office said
