The Patriotic Union of Kurdistan (PUK) said on Monday that if the Kurdistan Democratic Party does not agree to its conditions, it will not participate in the next government of the Kurdistan region.

 

"If the conditions of the National Union are approved, he will participate in the government, and on the contrary, he will not participate," said a member of the negotiating committee of the union, Adnan Hama. "The world will not disappear in the event of non-participation of the national."

"If we do not reach an agreement with the Kurdistan Democratic Party then the latter can take the legal means to amend the law of the presidency of the Kurdistan region and ratify it," Hama Mina said.

He pointed out that "the National Union did not ask much, not much, but wants to share its strength and size and entitlement to power."

On Monday, March 4, 2019, the Kurdish National Democratic Party and the National Democratic Party signed an agreement on participation in the Kurdistan Parliament meetings, the Governor of Kirkuk and the Minister of Justice in the Federal Government

demanded the Patriotic Union of Kurdistan (PUK) on Wednesday to share four positions jointly with the Democrat in the new government of the province. 

The two main parties in the region are scheduled to hold their 11th meeting after the Kurdistan elections held at the end of September last year to resolve the next government formation. 

The two parties formed two committees to negotiate the distribution of government positions between them, held two meetings and today will hold the third in Sulaymaniyah. 

According to the information available, the two new committees have come close to reaching the ground for the conclusion of a new agreement between the two parties on the further formation of the next government of the region. 

According to the information, the Kurdistan Regional Parliament has suspended its meetings in the hope that the two sides will reach in the next few days an agreement leading to the formation of the government.

The information indicates that the National Union Committee has informed its counterpart in the Kurdistan Democratic Party of the desire to share four important positions within the new provincial government, in addition to that the first party has served as the speaker of parliament, and Vice-President of the region and the Kurdistan government. 

The Ministry of Natural Resources, the Ministry of the Interior, Foreign Relations and the Kurdistan Regional Security Council, headed by Barzani, are the only candidate to head the new provincial government. 

According to informed sources from both parties, if the two committees reached an agreement on sharing these positions, then will be followed in a formal ceremony to conclude the agreement to form a government between the Democratic and the National Union.

I don't know. They finally used the word "this" week instead of "next" week which means "this" week. That they used "this" must mean "last" week. 

He added that "a final agreement between the two sides looms on the horizon and we can see an agreement on the formation of the government this week."

So this indicates an urgency we have never seen before or ever thought they were capable of. They obviously want this done pronto. As in "this" LAST week!

KDP, Gorran submit presidency bill, but PUK says it’s a 'wrong step'

ERBIL, Kurdistan Region —The Kurdistan Democratic Party (KDP) and the Change Movement (Gorran) parties submitted a bill on Thursday with 68 signatures to amend the contentious presidency law that calls for parliament to elect the president, not via a public vote.

Parliament leadership is calling on all MPs to reconvene on Saturday.

"Within the framework of agreements struck between the KDP and Gorran and other sides to ramp up steps to form the government and reactivating the presidency … a bill to amend the presidency law and the mechanism of electing the president — until the Kurdistan constitution [officially] is drafted — was submitted with 68 signatures," Umed Khoshnaw, the head of the KDP bloc, said in a press conference.

The bill has eight articles, including measures to restore to the presidency all the powers that were distributed over the parliament, government, and judiciary when former president Masoud Barzani’s term ended in November 2017, Khoshnaw revealed. 

The president will retain all powers and functions “until the ratification of the constitution of Kurdistan-Iraq, in which the method for election of the Region’s president and its authorities are determined,” read the bill, a copy of which Rudaw obtained. 

The parliament will open nominations for the president within 30 days of the election of the legislature’s presidency board. Candidates will have three days to nominate themselves for the position. 

Two days after the nomination window is closed, the names of candidates who meet the necessary criteria will be announced. Individuals who were excluded for failing to meet the criteria can appeal the decision within two days and the appellate court will have another two days to settle the issue. The court’s ruling will be conclusive. 

Three days after any possible court rulings – twelve days after opening nominations – parliament will vote in an open ballot and the president will be elected with an absolute majority, the bill proposed. If no candidate wins in the first round, then the two people who secured the most votes will take part in a run-off second round. 

Previously, the president was in office for a four-year term. The bill submitted on Thursday proposes that the president’s term ends with that of the parliament.

The KDP and Gorran struck a government formation deal on February 16. 

Gorran bloc head Ali Hama Salih said at the conference “what was really important for us was that we wanted the president to be elected by MPs, not through a popular vote. And that it is fixed in the bill."

The Patriotic Union of Kurdistan (PUK), the New Generation, the Kurdistan Islamic Group (Komal) and the Kurdistan Islamic Union (KIU) did not sign the bill. All were present. The PUK bloc walked out.

The bill came on the heels of another failed round of talks between the KDP and PUK to strike a deal on government formation. 

The KDP won the most seats (45) in the election, but not an outright majority so it needs a coalition in order to govern. It has struck a deal with Gorran that finished third in the election with 12 seats. Together they have an absolute majority in the 111-seat legislative body.

 

But PUK-KDP cooperation is crucial as the Kurdistan Region is politically divided the two, particularly over control of security forces. 


The KDP and PUK signed a four-year political agreement in early March, but it lacked specifics on power-sharing. 

Rewaz Fayaq, a PUK MP, told Rudaw the presidency matter has a "national dimension" and it should have been settled between all parties.

"We had a failed experience in the past when the parties tried to individually raise bills and petitions to amend the presidency," Fayaq said, recounting "in the past the KDP thought that the presidency matter had a political, constitutional and national dimension. It has to be settled between all the parties, not each individual party trying to amend it alone. We are now of the view, which the KDP had been calling for in the past, is now what we ask for."

The matter of presidency has been the point of contention between the Kurdish sides. Previously, Gorran and PUK maintained the position that the presidency law should be amended and the president be elected by parliament. The KDP, however, was opposed to the idea. 

Fayaq said their MPs will not attend any parliamentary session, adding they will enter when they are told by their superiors.

 

The KDP and PUK have almost reached a deadlock in their talks about the latter's share in the new government, but argue about the distribution of government posts. 


Luqman Wardi, another PUK MP, described the bill as a "wrong step" made in the absence of his party.

"We will have reactions," he told Rudaw, without elaborating.

Referring in particular to the PUK, Khoshnaw said: "We really wanted all sides to join in, but others opted not to. We thought we were very late…”

He revealed they will require two weeks to finish the process.

ERBIL — Kurdistan Region Parliament has scheduled a session for Saturday to discuss the reactivation of the regional presidency.

According to an announcement by the parliament speaker, lawmakers will convene and discuss the reactivation of the presidency and the election of a new president at the parliament.

The amendment to the presidency law was submitted to the legislative on Thursday. It initially received 68 signatures from Kurdistan Democratic Party (KDP) and Change Movement (Gorran) lawmakers.

The Patriotic Union of Kurdistan (PUK), Kurdistan Islamic Union (KIU), Kurdistan Islamic Group (KIG), and New Generation did not sign the bill while KDP and Gorran encouraged all the sides to join the efforts.

The two parties said the reactivation of presidency is the precondition for forming the new government which is already delayed.

ERBIL (Kurdistan 24) – Lawmakers in the Kurdistan Region’s parliament on Thursday introduced a long-awaited bill to reinstitute the suspended post of regional president, an MP from the Kurdistan Democratic Party (KDP) told the media.

The KDP, along with its legislative allies, “submitted a bill for the reactivation of the presidency… amending the method of electing a president, and ratifying a [regional] constitution,” said Omed Khoshnaw, head of the KDP caucus in the Kurdistan parliament, during a press conference.

The briefing came following a meeting between the heads of the KDP bloc, its allies in the legislature, and the parliament’s leadership, during which they submitted the proposal. It is still unclear when lawmakers will convene in an ordinary session to vote on the proposed bill.

Khoshnaw said that 68 lawmakers had put their voices behind the bill, which after being passed, he explained, would give parliament the authority to “elect a president.” The KDP has already announced its nomination of outgoing Prime Minister Nechirvan Barzani for the post.

The presidency of the Kurdistan Region had been suspended in November 2017 when then-President Masoud Barzani announced he would end his already-extended term in the aftermath of the referendum on independence and as Kurdish parties failed to agree on a date for the regional elections.

Since then, the powers of the Kurdistan Region Presidency have been delegated to the prime minister and parliament speaker.

Once a new president is elected, he would call upon the leading coalition to name its candidate for the premiership—for which the KDP has nominated the region’s incumbent security chief Masrour Barzani— who would then go on to form the future regional government.

The Kurdistan Region previously held separate elections to select a president, but parliament seeks to alter this process for the time being, in hopes of facilitating the formation of the new government. According to the stated plan, this process would continue until parliament is able to ratify its regional constitution, which would outline the official procedure for appointments to the post and the powers it would wield.

The Kurdistan Region has a unicameral legislature with 111 seats, five each reserved for Turkmen and Christian parties and one to be held by a member of an Armenian party.

In the September regional elections, the KDP won 45 seats to take first place, while the Patriotic Union of Kurdistan (PUK) came in second with 21. The Change (Gorran) Movement secured 12 seats and was the second runner-up.

The KDP is currently allied with Gorran and the minority parties, all of which have approved the bill on the presidency. The PUK, however, is holding out for something of a grand bargain on issues not directly related to regional government formation, with negotiations aimed at reaching an alliance with the KDP not yet yielding concrete results.

ERBIL, Kurdistan Region — The question of the disputed areas should be solved by the Iraqi Council of Ministers in coordination with locals from the areas after the Kurdistan Region forms its new government, Iraqi Parliament Speaker Mohammed al-Halbousi argued on Friday. 
 

"On the 140 Article by the constitution with the CoR (Council of Representatives), we have to create a committee to address these [areas]. Clearly, there are service problems. Some of these areas started to have problems after the liberation battle," he explained at the United States Institute of Peace (USIP).

 

Primarily, questions remain as to whether the Kurdistan Region will contribute to the reconstruction or the federal government, according to the speaker. The Kurdistani or disputed areas lie in diverse areas like Shingal, the Nineveh Plains, Makhmour, and Tuz Khurmatu which were under the administration of the KRG during the Islamic State (ISIS) conflict, but were no-man's-land during much of the US invasion and resurgence. 

 

"This is a problem: this or that? And these people are suffering because they have not received anything — no infrastructure efforts from either one. To provide these services for IDPs and to bring the IDPs so the decision makers of those 140 Article [areas] are the people of these [places]... how to implement this?" he posited.


Iraq held parliamentary elections on May 12. All but a few key ministerial posts have been filled. The Kurdistan Region held an election on September 30. 

Erbil is yet to form a cabinet or elect a prime minister because of disputes between the Kurdistan Democratic Party and Patriotic Union of Kurdistan. A parliament session is due to convene on Saturday.
 

"I think because the IKR [Iraqi Kurdistan Region] is busy in the formation of their Kurdistan Regional Government (KRG), after this, hopefully, before 2020 according to Baghdad and the IKR schedule's points-of-view, we have to deal with this," said Halbousi, referring to Article 140.


In much shorter time than under predecessor PM Haider al-Abadi, Adil Abdul-Mahdi who has historic relations with Kurds was able to help negotiate a budget that was acceptable to both the IKR and the federal government.

"The relationship between Baghdad and Erbil, or Kurdistan, it was somehow... now I think it's much, much better than how it was before. There is an intention in Baghdad to have an understanding with the IKR (Iraqi Kurdistan Region) and vice versa with a relationship to everything,” Halbousi said.

The Kurdistan Region's independent sale of oil has been a sticking point in previous budgets. 

"But this year is much, much better than everyone before. We have somehow compromised from Baghdad to Erbil and Erbil gave some comprises to Baghdad to agree in 2019 to have resolved all of the outstanding problems between the two,” he added.

"There are clear differences on the contracts in IKR, for example, the contracts are partnership contracts. In Baghdad, it's more than partnership. It's about how to service these contracts.”

Halbousi claimed the will is always there to resolve outstanding issues. 
 

"This is how we are going to negotiate in the next phase as a political entity, we have to work on that. It will always be a problem, but we have to, both sides have to comprise in order to service the Iraqi people, the Kurdistan people," he said.

 

Halbousi, a Sunni politician who is the former governor of Anbar, said after assuming the office of speaker last year, he met with leaders of Iraq's various ethno-religious components including Yezidis.


"State institutions, security institutions... we want them to enter the state institutions; this way they would protect their own areas ... and contributors to the security portfolio in their own home areas," he said.

Halbousi spoke of the diverse Nineveh Plains, where he acknowledged "an external" presence.

"These areas are so much interacting with one another, with these components; we have to start at the political level, of course from the top down," he said.

Halbousi also explained foreign countries to assist in reconciliation, but along humanitarian lines instead of political.

"We work with the legislature and the government and the international community to split the humanity aspect from the elector aspect — any pragmatic election issue they have all the right to elect anyone who would represent them. Whoever they want to elect, of course, we have to respect that," he said.

He blamed longstanding sectarian politics for a delay in the full formation of the government of Baghdad, but argued that because "the Iraqi people don't trust these parties anymore" the tide is turning.

"Delays in the formation of the Iraqi government are not about conflicting interests. There is a personal stubbornness and a fight of wills between the blocs,” Halbousi claimed.

The executive branch of government is needed to help in combatting decades-old corruption, he argued.

"All the files since 2003 until now will be dealt with and reopened ... All findings will be revealed to the Iraqi public clearly ... I commend [the justice system] and praise them for what they did in complementing the three presidencies on the bureaucracy file," he claimed.

He implored for the Iraqi diaspora to play a more positive role within the country.

"They have a clearer and a good picture of Iraq. The sectarian aspect is much, much less outside of Iraq," he claimed. "...even if they are in conflict with each other, as soon as they leave, generally speaking, the environment is much, much, much better," he said.

"There are just so many tribes in Iraq,” the speaker said. “They are extended everywhere in Sunni and in Shiite areas. The Iraqi community outside of Iraq, they have to somehow reflect that image that they will contribute positively in the civil reconciliation in Iraq..."

ERBIL, Kurdistan Region – The Parliament of the Kurdistan Region is due to meet on Saturday to debate the amendment of the presidential law and reactivation of presidency office. But it is unclear whether the second-largest party, the Patriotic Union of Kurdistan (PUK), will participate.

“The PUK has not yet decided whether or not to take part in it. This depends on relations between the PUK and KDP,” PUK leadership member Arez Abdulla told Rudaw TV on Friday. “It is unlikely it will participate in the session if the session is held exclusively to debate this [presidency] question.”

He detailed why the PUK’s status is unclear. 

“Because we don’t yet have an agreement to take part in the government, nor have reached an agreement on how the law should be amended,” he said.

The president of the Kurdistan Region previously has commanded all security forces, acted as head of state, and held tremendous sway.

“… the presidential law should be completely changed so that it fits with current situations and a parliamentary system,” Abdulla added.

He said dialogue between the KDP and PUK continues and they want to be a true partner in governance across the Kurdistan Region.

The PUK effectively is concerned with being shut out of the official security, intelligence, military, and Peshmerga apparatus; thus, leaving the PUK forces as party forces and not a part of the government. 

“If we don’t have a role in running these departments, we don’t feel like we are participants. For example, the president of the region is from the KDP, the prime minister is from the KDP, the head of the Department of Foreign Relations is from the KDP too. In case a delegation goes abroad or comes here, one wouldn’t feel like there is a coalition government here. Rather, one feels like only one political party runs this country, while we want to be allies,” Abdulla said.

The last time the PUK and KDP splintered, they fought a bloody civil war in the 1990s and then operated two de facto regional party governments until they reconciled following the US liberation.

“The departments given to the PUK should be important and strategic and should have a role in running the KRG,” he added.

The PUK regained its position in last year’s election as the Kurdistan Region’s second-largest — ahead of the Change Movement (Gorran) whose speaker of parliament was barred from entering the legislature and could never keep control of the Peshmerga ministry from the KDP.

Gorran and KDP reached an agreement last week that the PUK called “a wrong step.” 

“The KDP and Gorran (Change Movement) have an agreement between them and they can form the government themselves. And we haven’t hampered this process. There are no legal obstacles before them. They can form the government without the PUK and we haven’t closed this door,” he said

The PUK, according to Abdulla, believes the KDP with its 45 seats in the 111-seat legislature is not willing to proportionally share power.

“We understand the PUK has 21 parliamentary seats and the KDP knows this too, but the influence and position of the PUK should be taken into account. And the KDP has so far taken this into account, but this should reflect on government institutions so that we together can pass this phase,” he said

KDP already has set conditions for a bill to amend the presidency law and to ratify a constitution. The PUK is yet to attend a session of parliament. 

The PUK politburo met in Erbil on Friday to discuss the posts the KDP had earlier suggested for the PUK and PUK spokesperson Latif Sheikh Omar told Rudaw following the meeting “we are closer to reaching an agreement.”

As it is a regional parliament, the disputed areas and supposed backroom agreements about their future, in particular oil-rich Kirkuk, also are a part of the KDP-PUK impasse. 

“I think not only the PUK, but all the parties should take part in this government and form a strong coalition government here and should have unanimity in Baghdad and disputed areas. But we still have disagreement on this with the KDP. There is mutual understating, but we haven’t reached a solution to the issue of Kirkuk, Baghdad and many other aspects,” Abdulla said.

The PUK, following with tradition, obtained the chiefly ceremonial role of president of Iraq. However winning 6 of 11 seats in Kirkuk in the Iraqi election (ignoring the Christian minority seat), the PUK sees Kirkuk as their powerbase where the acting, appointed Arab governor will be replaced by a person approved by the PUK, as the KDP chose not to run in the “occupied” city.

The Kurdistan Islamic Union bloc announced on Friday, the submission of five draft service laws to the Legal Committee in the Parliament of the Kurdistan region. 
The bloc said in a statement read / Mawazin News / it, "The ratification of the Kurdistan Regional Parliament on those five laws will benefit the citizens, and is scheduled to be read in the coming parliamentary sessions of parliament." 
"The laws are one related to childhood, the other to amend and legislate laws on human rights, the third is a draft law on government reform, and the fourth is to regulate the employment sector, salaries, benefits and allowances, and the fifth housing project."

The Kurdish Democratic and National parties, Saturday, will hold a crucial meeting in Erbil, while the meeting will see the party Talabani Party Barzani demands from the positions assigned to him in the Kurdistan Regional Government. 
A source told Mawazine News that "the two Kurdish parties will hold a crucial meeting this evening in Erbil," pointing out that "the Patriotic Union will present during the meeting demands on the democratic positions assigned to him in the provincial government."

The Kurdistan Islamic Union bloc on Saturday expressed its opposition to what is included in the draft law amending the law of the President of the Kurdistan Region provided by the Kurdistan Democratic Party and its allies.

"The bloc will participate in the parliamentary session scheduled for today, but it is the adoption of the draft law to amend the presidency of the region is a legal breach," said the head of the bloc, Jawdat's partners in a statement to reporters today from parliament.

He added that "we will not support the revival of this post according to the project submitted, which is contrary to the permanent Iraqi constitution."

"The Islamic Union bloc does not object to the position, but the authority granted in the project to be voted on," Jawdat said.

He noted that the Parliament of the Kurdistan Region left projects submitted by the Kurdistan Islamic Union and the Kurdistan Islamic Group and the block "movement of the good generation" and this is another legal breach.

"The draft law gives the President of the Kurdistan Region absolute powers and can not be held accountable for it."

began, just before, the session of the Parliament of the Kurdistan region, to discuss the law of the presidency of the region amid demands for its postponement. 
A Kurdish source said in an interview with "Mawazin News" that "the parliament of Kurdistan began the session devoted to discuss the law of the presidency of the region and the completion of the first reading of it." 
"The bloc of the Islamic Union and the Islamic Group and the movement of the new generation demanded to postpone the first reading to next week, to discuss within these blocks in an expanded manner." 
And gave 68 members in the Parliament of the Kurdistan region, the proposed law of the presidency of the region
