Separating school bathrooms based on sex is constitutional, court rules

The U.S. Court of Appeals for the 11th Circuit ruled that separating bathrooms based on sex doesn't violate the Constitution or Title IX, a decision with repercussions for the nationwide debate over transgender issues.

The ruling is likely to have widespread consequences in Alabama, Florida, and Georgia.

 

The case, Adams v. Sch. Bd. of St. Johns Cty, revolved around whether or not St. Johns County School Board in Florida violated a transgender student's rights by prohibiting the student, a biological female who identifies as a boy, from using the boys' bathroom at Allen D. Nease High School. The court ruled en banc that the United States has a long tradition of segregating certain spaces, such as bathrooms, on the basis of sex, without falling afoul of either the equal protection clause of the 14th Amendment or Title IX, which prohibits sex-based discrimination in education. As such, the student's rights weren't violated.

 

"Separating school bathrooms based on biological sex passes constitutional muster and comports with Title IX," Judge Barbara Lagoa, who was appointed by President Donald Trump, wrote for the court. Four judges appointed by Democrats dissented from the opinion.

Kristi Noem, R Gov - SD, Backs Bill to Protect Minors From Transgender Surgeries and Medical Interventions

South Dakota Republican Gov. Kristi Noem has announced her support for House Bill 1080, a measure which would prohibit controversial transgender medical interventions such as hormones and surgery for minors.

“Governor Noem supports this legislation and will be watching as the legislature works through the process,” Ian Fury, Noem’s chief of communications, told The Daily Signal in a statement Wednesday.

H.B. 1080 aims “to prohibit certain medical and surgical interventions on minor patients.”

The Brunson brothers’ case is back in the news.  These brothers are behind a lawsuit that claims that numerous politicians on both sides of the aisle violated their oaths of office by not investigating evidence of fraud in the 2020 election. 

 

The Supreme Court is set to reconsider whether to hear a lawsuit alleging President Biden, Vice President Kamala Harris, former Vice President Mike Pence, 291 House members, and 94 senators violated their oaths of office by refusing to investigate evidence of fraud in the 2020 election before certifying Biden as the victor on Jan. 6, 2021, allowing for Biden and Harris to be “fraudulently” inaugurated.

The plaintiff, Raland J. Brunson, seeks the defendants’ removal from office for violating their oaths.

Members Of Congress Urge Biden To Send F-16s To Ukraine

 

The letter went on to request the Biden Administration send Ukraine the F-16s that they have requested so that they can have air superiority.

“We write to respectfully request that your Administration provide Ukraine with increased air superiority capability, including the F-16 Fight Falcon aircraft requested by Kyiv,” the congressmembers wrote.

According to the Committee for a Responsible Federal Budget, the United States has already sent Ukraine more than $113 billion.

The money has been divided into humanitarian, financial aid, but the biggest was military aid to the country. The U.S. has already sent Ukraine advanced air defense systems, armored fighting vehicles, and most recently the M1 Abrams tanks worth over $400 million.

The letter had received some bipartisan support and was signed by Representatives Jared Golden (D-Me.), Jason Crow (D-Colo.), Mike Gallagher (R-Wi.), Tony Gonzalez (R-Texas), Chrissy Houlahan (D-Pa.), Jim Costa (D-Calif.), Jimmy Panetta (D-Calif.), Susan wild(D-Pa.),Bradley Schneider(D-Il.),Elissa Slotkin(D-Mi.), August Pfluger(R-Texas), Don Bacon (R-Ne.), Marcy Kaptur(D-Ohio), Abigail Spanberger (D-Va.), Lloyd Doggett (D-Texas), and Rob Wittman (R-Va.).

So far, the Biden administration has stated that they will not be sending the F-16 fighter aircrafts to Ukraine. However, Biden has stated multiple times that he, along with NATO, will continue to support the country in its fight against Russia.

Speaking to Fox News anchor Ashley Strohmier, Bailey discussed the policies that he has put in place in his city and how he avoids the mistakes other California cities are making in regard to the homeless crisis that has taken hold of the state.

 

“The policies that are in place at the regional and statewide level that are tolerating this type of behavior that is personally destructive and also destructive to the surrounding communities are really enabling this situation to increase throughout our entire state, and throughout our entire region,” said Bailey.

 

“Changing these policies will actually have a major impact,” he added, speaking from his own experience.

 

The city of Coronado works closely with the local police force and a homeless service provider to force the homeless population to either get the help they need or move out of the city. They also fund “reasonable” services to help people get “back on their feet.”
