It’s bewildered to me that as much as AM has talked about HCL over the years that he has been so silent. Hasn’t even popped in since Friday. I hope all is well with him and his family.

Agreed Idplzr, very bewildering indeed! Maybe he is checking and double checking all systems are ready for launch! Still will be happy to hear his take on all of this most recent news. Hopefully all is well and he will make some comments and answer some questions on Wednesday!

Article 2 of the law establishing the company consists of the capital of the company of (400) billion dinars paid by the government with the approval of the Council of Ministers and the company to increase its capital on the proposal of its Board of Directors and the approval of the Council of Ministers after the presentation of the economic feasibility study. 
As stated in Article 5 of it "The Iraqi National Oil Company invests all the oil and gas areas in all the territory of the Republic of Iraq and its territorial waters and continental shelf, and may share with others the approval of the Council of Ministers if it finds it better to achieve its purposes and has the right to borrow from inside or outside Iraq to finance its investments inside Iraq

The Finance Committee announced on Tuesday that the law of the National Oil Company included allocations of 10% of oil imports in the form of bonds distributed to citizens and the implementation of the law after six months of its legislation.

"The law of the National Oil Company, which was voted by the House of Representatives within the benefits of the Iraqi people of oil and distributed to him in the form of shares," Committee member Zahir al-Abadi told the agency.

He added that "the law provides for the allocation of 10% of oil revenues distributed in the form of shares of citizens and 90% of the state treasury," adding that "the receipt of citizens of those funds be through bank accounts open to every citizen in government banks and fall after his death."

The oil ministry announced on Wednesday that the National Oil Company will manage the mining, marketing and infrastructure development sectors, saying it will seek to eliminate bureaucracy.

The spokesman for the ministry, Assem Jihad, told "Economy News" that the National Oil Company will be a national company seeking to develop the oil industry in Iraq as well as management of the sectors of extraction and marketing operations as well as the development of infrastructure. 
He added that it will include Iraqi oil companies in addition to the Iraqi marketing company, pointing out that it will adopt competence and experience in the management of joints and seeks to eliminate bureaucracy and will be one of the largest international companies.

Jihad pointed out that the ministry will take the role of "supervisor and plan and intervention is limited to the joints related to the public good."

On the management of fields in the Kurdistan region, he stressed that "the law of the National Oil Company indicates that it is a national oil company responsible for all oil activity within the borders of Iraq, including the Kurdistan region," noting that the company the right to work outside Iraq to achieve the highest benefit and the lowest costs.

He described the oil minister, earlier, the process of voting on the law as "historic decision, which aims to optimize investment for the management of national wealth and protection and development in accordance with programs and mechanisms developed by the honest effort and national administration."

The House of Representatives voted last Monday on the National Oil Company's proposed law.

A member of the Committee on Oil and Energy parliamentary Jamal Koger, on Thursday, that the oil sector will not be entirely at the disposal of the National Oil Company, while the ministry will be the first supervisor of the work of this company.

 

"The oil sector will not be entirely at the disposal of the National Oil Company," he said, adding that "the ministry will be the first supervisor of the work of this company."

 

"The director of the National Oil Company enjoys the privileges of the minister but can not act as the oil minister is acting," he said, noting that "the company's law requires a period of one month to pass all its needs and start work in it."

The Council of the province of Maysan today the Presidency of the Republic not to ratify the law of the National Oil Company, which was approved by parliament last Monday.

The head of the oil committee in the province of Maysan Rahi Albzuni said in a press statement on Thursday that the Council sent a letter to the Presidency of the Republic called for not to ratify the law of the National Oil Company, explaining that the book included the call of the Presidency of the Republic not to ratify the law to marginalize the productive provinces, 112 of the Constitution.

The head of the energy committee for oil and gas in the province of Maysan, Rahi Albzuni that the reason for the call of the provincial council Maysan federal government not to ratify the law of the National Oil Company, which voted by the House of Representatives recently. Because of the objection, "in order to bypass Article 112 of the Constitution first and second and give only representation of the Territory in the Board of Directors of the company and the marginalization of oil-producing provinces,

He explained that "article" 112 "the  federal government and the region and the provinces produced one level management of oil and gas extracted from the existing fields and the federal government and the governments of the provinces and provinces producing together to draw strategic oil policies.

He pointed out that the House of Representatives gave the right to the region in the board of directors of the company without producing provinces, which is a right for generations in the provinces and bypass the Constitution.

The Council of the province of Maysan had earlier lifted a letter to the Presidency of the Republic in which he demanded not to ratify the law of the National Oil Company to marginalize the productive provinces and exceeded article 112 of the Constitution.

SECTION FIVE: POWERS OF THE REGIONS

CHAPTER ONE: REGIONS

Article 112:

The federal system in the Republic of Iraq is made up of a decentralized capital, regions and governorates, and local administrations.

Article 113:

First: This Constitution shall approbate the region of Kurdistan and its existing regional and federal authorities, at the time this constitution comes into force.

Second: This Constitution shall approbate new regions established in accordance with its provisions.

Article 114:

The Council of Representatives shall enact, in a period not to exceed six months from the date of its first session, a law that defines the executive procedures to form regions, by a simple majority.

Article 115:

One or more governorates shall have the right to organize into a region based on a request to be voted on in a referendum submitted in one of the following two methods:

A. A request by one-third of the council members of each governorate intending to form a region.

B. A request by one-tenth of the voters in each of the governorates intending to form a region.

Article 116:

The region shall adopt a constitution that defines the structure of the regional government, its authorities and the mechanisms of exercising these authorities provided that it does not contradict with this Constitution.

Article 117:

First: The regional authorities shall have the right to exercise executive, legislative, and judicial authority in accordance with this constitution, except for those powers stipulated in the exclusive powers of the federal government.

Second: In case of a contradiction between regional and national legislation in respect to a matter outside the exclusive powers of the federal government, the regional authority shall have the right to amend the application of the national legislation within that region.

Third: Regions and governorates shall be allocated an equitable share of the national revenues sufficient to discharge its responsibilities and duties, but having regard to its resources, needs and the percentage of its population.

Fourth: The regions and governorates shall establish offices in the embassies and diplomatic missions, in order to follow up cultural, social and developmental affairs.

Fifth: The Regional Government shall be responsible for all the administrative requirements of the region, particularly the establishment and organization of the internal security forces for the region such as police, security forces and guards of the region.

CHAPTER TWO: GOVERNORATES THAT ARE NOT INCORPORATED INTO A REGION

Article 118:

First: The governorates shall be made up of number of districts, sub-districts and villages.

Second: Governorates that are not incorporated in a region shall be granted broad administrative and financial authorities to enable it to manage its affairs in accordance with the principle of decentralized administration. This will be organized by law.

Third: The governor, who is elected by the Governorate Council, is the highest executive official in the governorate to practice his powers authorized by the council.

Fourth: A law shall regulate the election of the Governorate Council, the governor and their powers.

Fifth: The governorate council shall not be subject to the control or supervision of any ministry or any institution not linked to a ministry. The governorate council shall have an independent finance.

Article 119:

Powers exercised by the federal government can be delegated to the governorates or vice versa, with the consent of both governments and shall be regulated by law.

Bahr al-Ulum added that "the law of the National Oil Company will include under its misguided six oil companies, namely Basra oil, oil of the south and oil Maysan, Dhi Qar oil, Wasit oil and North oil as well as the marketing company oil (Sumo), the second law is to draw oil policies, Management of extractive industry in the country ".

For his part, said the oil expert Hamza Jeweler that the pursuit of the adoption of the law of the National Company and the formulation of oil policy is to limit the management of oil and gas, however, the federal government, as indicated by the Constitution in one of its provisions that oil and gas belongs to all the Iraqi people and thus will make all the oil companies operating in the Kurdistan region Working under the federal government and thus the federal government was able to preserve the oil wealth from the dominance of influential politicians in the Kurdistan Regional Government.

"The approval of the two laws before the end of the current parliamentary session will pave the way towards the passage of the law of oil and gas, which lasted 11 years and was not approved because these laws will go half way towards the adoption of the law the President is oil and gas."
