The head of the Integrity Commission: The legal system's decay caused the release of 3,500 accused and convicted of corruption

The head of the Integrity Commission Hassan al-Yasiri, the high rates of corruption in Iraq to the erosion of the legal system, and stresses that this system is not strong to combat corruption rampant in the country.
The official in charge of detecting corruption believes that several bills whose legislation would reduce corruption rates, including the law on graft, the right of access to information law, and the Code of Criminal Procedure.
On the other hand, says Yasiri, "The law of amnesty caused the death of us, after the inclusion of 3542 accused and sentenced to 113 cases by," noting that the body is the only body that opposed the legislation of the law and made proposals to avoid the exit of those covered by corruption and ban participation of those covered by amnesty to run for elections, With no use.
In an interview with Al-Mada, two days after the body issued its annual report for 2017, the head of the Integrity Commission complained about legal and administrative procedures that hampered the Commission's work, including the lack of legislation that obliges officials to disclose their financial liabilities. "There is no legal provision criminalizing those who did not disclose Financial liabilities ".
The Commission revealed in its report, it removed the risk of loss of more than one trillion dinars. The report detailed information on arrest warrants and over 6,000 orders, some of which included senior officials, including ministers and general managers and the like.
The Integrity Commission publishes quarterly and annual reports. And the follower of this file, did not find a significant development to undermine corruption between the folds of those reports, as the report did not differ much from previous reports in the weight of numbers.
The report of the Integrity Commission for 2017 indicates that the rates of corruption and institutional chaos are still at "red" levels, warning of the seriousness of the immediate phase in Iraq.
"What has been presented in the 2017 annual report is done by the Integrity Departments of all countries of the world in the context of its high statistics," said Yasiri.
He added that "the Commission dealt with the year 2017 with more than 20 thousand communications and criminal case and news, where was completed (16180) of the total of what it looked at the period from January 1 to December 31 last year," pointing out that " The criminal cases investigated by the Commission amounted to (8537) cases, of which judicial proceedings (6488) cases, a rate of (76%). "
The annual report presented by the authority last Wednesday, attended by regulators, government officials and parliamentarians, pointed out that the judicial orders issued in 2017 amounted to (6261) orders from which (4580), including 35 recruitment orders against ministers and their rank. For those with special grades and general managers and their rank (306).
In the case of judicial orders, 2133 were executed, of which 996 were executed, of which 17 were against ministers and their rank, while 138 were against special rank holders and general managers.
The head of the Integrity Commission commented on these figures, saying that "the Commission has announced earlier its new measures in the fight against corruption, and we have raised the red lines, and the proof is that we are not talking, but we provide practical evidence, where we achieved with the Deputy Prime Ministers when they were in power , As well as we have achieved with Directors General and Ministers. "
"Yasiri said that" the work of the Commission ends at the time of investigation and referral to the judiciary, but with regard to the release of convicts and sentenced, it is concerned with the parties concerned and not our business. "
The annual report presented judicial orders to ban travel amounting to 315 decisions, including the banning of 5 ministers and 29 people with special grades and general managers and their rank.
The report included seizures of 57 crimes in Basra, 39 in Baghdad, 33 in Nineveh and 164 operations carried out by the investigation offices of the Integrity Commission in other governorates.
The annual report referred to the number of persons covered by the amnesty, reaching 3,542 accused and sentenced in 113 cases, as well as 752 convictions and 468 sentences for release.
"We have repeatedly said that this will affect the work of the Integrity Commission, and therefore we are the only party in Iraq that has opposed the inclusion of cases of corruption in the law," the head of the Integrity Commission said bitterly.
"We have made proposals not to include convicted or accused of corruption in the amnesty law, and we have also submitted a draft law on not allowing the amnesty law to stand for election, but the parties have not yet decided on these proposals," Yasiri said.
In the file of real estate, assets and funds belonging to the state through investigation and follow-up, according to the report, the property was re-owned (15) properties in the province of Karbala, estimated at forty-three billion Iraqi dinars, after the existence of rigging and falsification of ownership, 40 former officials out of a total of 88 officials from the funds and assets belonging to the State in their custody and not returned to the institutions concerned. "
As well as the return of ownership of other properties belonging to ministries after some of the forgery of their title and transfer to other people, as well as the teams of the Commission to follow up the allocation of some land and real estate contrary to the law, as the work of these teams resulted in the Secretariat General of the Council of Ministers to form a new committee to return Consider the allocation of these lands.
"We have submitted drafts to the concerned parties, including laws on graft, political parties, the right of access to information, the principles of criminal trials and other laws," said Yasiri. "The legal system is dilapidated in Iraq and can not fight corruption.
"The Authority has worked in the same period exclusively on 420 files of fugitives wanted in cases of corruption, prepared 98 files opened this year, and worked on 76 files to recover the money smuggled prepared 8 files."
The head of the Integrity Commission said that his body "received (23655) a form for disclosure of financial disclosure. The percentage of the response of the presidents of the republic, the ministers, the parliament and the judiciary was 100 percent, the vice presidents of the republic 100 percent, the deputies of the parliament speaker 100 percent and the ministers 90.91 percent. Reveals the ministers, "noting that" the proportion of response to the heads of bodies and entities not associated with the Ministry amounted to 82 percent, not five of them were disclosed, and the proportion of the candidates of the members of the House of Representatives 35 percent. "
"There is no legal provision to criminalize those who have not disclosed their financial liabilities, but that comes within a legal obligation, and those concerned must respond to those procedures," said Yasiri. The deputies proposals for draft laws on the development of a text in the Penal Code criminalizes the reluctance of deputies not to disclose their financial liabilities, but unfortunately, this law has not been enacted so far.
The annual report revealed the response of 115 deputies to the disclosure form, while 210 deputies abstained in 2017. He
also noted that 9 governors disclosed their financial contributions from a total of 15 governors. In the paragraph on heads of provincial councils, the number of respondents was 11 out of a total of 15.
Najaf and Muthanna ranked first with 100%, Kirkuk second with 94.9%, followed by Wasit with 81.5%, Baghdad with 70.2%, Diwaniyah with 59.3%, Basra with 58.8% , Karbala 46.2%.
The percentage of completion in Dhi Qar province was 40%, Babel 33.3%, Al Anbar 24.1%, Maysan 23.1%, Saladin 6.9%, Diyala 3.6% and Nineveh List 0%.

Officials and dozens of parliamentarians evading financial receivables are legally blocking

Officials and dozens of parliamentarians evading money that are legally hampered by evidence

Twilight News

Shivak News / The Legal Committee in the Iraqi parliament, submitted a draft law "Where do you get this?" To the escape of deputies from the disclosure of their financial liabilities.
Iraqi parliamentarians have begun discussing a new law entitled "Where do you get this from?" To fight corruption and resolve suspicions about the theft of public money, but it faces a campaign of deputies and government officials to block him.
The law, if approved by the legislative institution, will return to the treasury of the Iraqi government large sums estimated at hundreds of billions of dollars.
Although the law is still under discussion in the Iraqi parliament, its application by the authorities threatens to expose the corruption files between Iraqi lawmakers and officials, which explains the campaign to stop it.
A member of the legal committee Zana Said to Twilight News, that the draft law "where you this" was introduced, because of the evasion of nearly 200 deputies in the Iraqi parliament from disclosure of their financial liabilities according to the Integrity Commission, adding numbers of officials outside parliament.
"Those concerned are benefiting from the absence of a legal text to pursue them."
He said that "the proposal of the law will have a significant role in the fight against corruption and the relevant authorities can enrich it with its proposals and observations before the second reading in parliament."
According to the draft law, which I read first, it would apply to staff members from the rank of Director-General, and the personal balances of those persons would be considered to be in doubt if they were not commensurate with what the official or staff member received.
The law also requires officials at the highest levels to submit the disclosure of financial disclosure clearly, and punish those who fail to submit this disclosure by stopping his salary.

The Parliamentary Security Committee is not aware of the first regulation

Bright Resan Feb 07, 2018

 06qpt965.jpg

BAGHDAD (Reuters) - Iraqi authorities on Tuesday published a new list of internationally wanted "terrorist" leaders led by the leader of the Islamic State, Abu Bakr al-Baghdadi, as well as five Arab nationalities.
"These names are more dangerous than the first list published by the authorities on Sunday," a senior Iraqi official was quoted as saying by AFP. "These are wanted for international justice, not just the Iraqi judiciary." "Those listed have completed their international legal procedures and have taken immediate measures to arrest them," the official said, speaking on condition of anonymity. "These files were issued by the International Sanctions Committee at the United Nations and INTERPOL International."
The list includes nine Iraqis and five Arab nationalities, including Saudis, Qataris, Jordanians and Yemenis, and includes the most wanted internationally, the leader of the «state», Ibrahim Awad Ibrahim Ali al-Badri Samarrai known as Abu Bakr al-Baghdadi.
The list also includes deputy leader of the "state" and the second man in the organization, Abdul Rahman Mustafa al-Qaduli, known as "Abu Alaa al-Afri", who comes from the province of Nineveh, which was "the capital of the Caliphate" during the period of control of the organization on vast areas of the country.
For the first time last Sunday, the Iraqi authorities released the names of 60 of the most wanted men belonging to the state, al-Qaeda and the ousted Baath Party. The names of Saddam Hussein's daughter, Raghad, now living in Jordan, appear in the list.
In 2014, the state managed to control a vast area of Iraq, including the provinces of Nineveh, Anbar and parts of Kirkuk, Salah al-Din and Diyala. Iraqi forces liberated these cities after three years of fighting, with support from the US-led international coalition.
Among the names on Sunday's list were princes, breakers, financiers, supporters, assassins and improvised explosive devices, who are still in hiding despite the end of military operations in the country. Among them were Fares Muhammad Yunus al-Mawla, who is referred to as "the governor of the Upper Euphrates" and the head of the military authority for cutting Zammar and Mosul dams, as well as Salah Abdul Rahman al-Abush, the general supplier of the state of Kirkuk and the military official of al-Zub province. Among them is Saddam Hussein Hamoud al-Jubouri, a "prince" of southern Mosul and al-Shorouk, as well as Mahmoud Ibrahim al-Mashhadani, a former officer in Saddam Hussein's regime.
The list includes Fawaz Mohammed al-Mutlaq and three of his sons, a former officer of Saddam's Fedayeen, a paramilitary organization formed in the 1990s.
Among the most prominent leaders of al-Qaeda, the name of the military leader in Kirkuk, Ahmed Khalil Hassan, and Abdul-Nasser al-Janabi, Mufti and financier of the organization in the area of Jarf al-Sakhr south of Baghdad, which was previously called the "triangle of death."
As for the former regime, Mahmud Younis al-Ahmad, one of the leaders of the party, came to the top of the list in 2003.
This is the first time that the secret authorities have released the names of those wanted for terrorism.

Internationally sought to restore the wanted

In a related context, called on the Committee on Security and Defense parliamentary, yesterday, the Iraqi Foreign Ministry, to pursue the list of wanted with the rest of the States, while confirming that the authorities did not know the Committee on the list, stressed the importance of not to exploit the file in the «election campaign».
Despite the publication of the list of names, but the Security and Defense Committee in the Iraqi Council of Representatives, the control of the Iraqi security establishment, denied knowledge.
MP Majid al-Gharawi told Al-Quds Al-Arabi that al-Baghdadi's name was not wanted by Iraq and all the countries of the world, since the organization he leads is banned in the world.
He added that "the Iraqi government will follow up this in cooperation with INTERPOL in all relevant countries, which harbor those wanted to put pressure on their governments," calling on the Ministry of Foreign Affairs to «move peacefully on this file through external meetings - both in the Arab League or foreign ministers, At the level of the United Nations, in preparation for a decision to commit these countries to the need to hand over those wanted and stop all financial and intellectual supplies to them ».

Election campaigning

On the date of launching the list, in conjunction with the near date of the elections, Al-Gharrawi said that «these actions should have taken place earlier», adding that «many of these issues are not without electoral propaganda».
He pointed out that «Abadi announced earlier his war on corruption, but we want him to be applied on the ground, through his seriousness in this file and the arrest of these corrupt».
As for his colleague in the parliamentary security and defense committee, MP Ali al-Metwati revealed to al-Quds al-Arabi that the committee "did not review the list announced by the government regarding the names of those wanted," but stressed that "the security forces have sufficient information about this matter."
I consider that «the announcement of names and circulation at the moment is not in place now».
He added: "If there is evidence, we in the Security and Defense Committee, we support any direction in order to maintain the security of Iraq."
