In the past several weeks, the Kirkuk Provincial Council and the major Kurdish political parties seem to have revived the long-stagnant Article 140 process. Last month, the Kirkuk Provincial Council passed a resolution to fly the Kurdistan flag from Kirkuk’s official buildings and on Monday (April 2), just after the Iraqi Parliament annulled the measure, the Provincial Council passed another resolution calling for Iraq’s parliament to hold a referendum under Article 140 of the Iraqi Constitution, a move that Provincial Council President, Rebwar Talabani, called a “last chance” for Baghdad to implement the Article. This resolution was followed by an official visit of a joint KDP-PUK delegation to Baghdad to negotiate a referendum on the independence of the Kurdistan Regional with the federal government on Tuesday (April 3). While these events inspire hope for territorial unity, and perhaps independence, they raise an important question: Can the KRG and Iraqi federal government commit to holding an honest and fair referendum? Or have the Kurdish elites already decided that the unity and independence of the Kurdish-inhabited territories of Iraq is inevitable, regardless of the outcome of the constitutional processes?

There is enough blame to go around for lack of progress on Article 140. The Article and its annex, Article 58 of the Transitional Administrative Law (TAL), are sufficiently vague to render it impractical for resolving Iraq’s territorial disputes. Both are silent as to whether referenda should be conducted at the provincial, district or sub-district level; a decision that could greatly impact the fate of small populations of territorially-concentrated Kurds and other minorities in the Arab-majority provinces. Aside from Kirkuk, the other disputed territories are not mentioned specifically. In addition to a sloppily written constitution, Kurdish partisan rivalries, the war against ISIS, and the dissolution of the KRG’s Parliament have also impeded efforts to fully execute the article’s terms. However, the most important reason for Article 140’s failure has been that neither Baghdad nor the KRG can fully commit to it.

Contributing to the failure of commitment has been the difficulty of determining their original demographic composition due to shifting provincial borders, the insufficiency of past census data and the Arabization of those areas under the Ba’ath regime, and most recently, the influx of Arab refugees into the disputed territories. While the KRG accuses the federal government of continuing to manipulate the demographic composition of these areas, the ethnic Turkman, Arab, Yazidi and Christian communities of Nineveh, Kirkuk and Diyala counter that the KRG is engaging in its own demographic manipulations to influence the outcome of elections and the referenda on their status. Whether this is true or not, Kurdish officials have maintained that the areas under their administrative control are historically Kurdish lands. Thus, while the Kurdistan Region has, and continues to, reaffirm the need to carry out the normalization-census-referendum processes stipulated in Article 140, KRG officials have stated repeatedly and unequivocally, both formally and informally, that they are unwilling to relinquish control of territories in Diyala, Nineveh and Kirkuk provinces that lie outside of the KRG proper. Given these facts, it is fair to question whether the KRG would honor the results of a referendum if they contravened the Region’s territorial claims and required that its authorities withdraw from areas it currently administers, or if a referendum can even be held given the problematic normalization process. Indeed, Kirkuk’s resolution to officially raise the Kurdish flag signified that the KRG considers the accession of Kirkuk to be a non-negotiable fait accompli: Kirkuk is Kurdish regardless of the outcome of a census or referendum.

Frustration with the lack of progress on the normalization, census and referendum processes, which were due to be completed nearly ten years ago, has led to the growing consensus among Kurds that the status of Kirkuk or the question of its demographic composition will never be determined constitutionally and therefore, its accession to the KRG must be assured by other means, up to and including a unilaterally declared referendum on the status and independence of the Kurdish-inhabited territories. Therefore, while it is unclear if the resolution of the Kirkuk Provincial Council this week will be recognized by the Iraqi government as legally binding, it presents an ultimatum: if Baghdad does not adhere to its long-overdue Constitutional obligations, the Provincial Council and the KRG will be justified in taking extra-constitutional action to ensure Kirkuk’s, and the other territories’, unification with the Region.

While the recent activity in the Provincial Council has renewed hope that Kurdistan will be united, it is also important that the Kurdish elites be honest about their political goals. If the Kirkuk Provincial Council or the KRG get the referendum they ask for, they must accept the results. If there is a chance that they cannot accept these results for whatever reason, the KRG must approach Baghdad to divide territory in such a way to avoid future conflict and resolve potential economic quarrels. Under such circumstances, the intractability of the territorial disputes between the KRG and the federal government will require an unusually creative solution to avoid future conflict, one that may be elusive to the parties.

Thanks for this late night post. There certainly seems to be a lot of simultaneous progress and activity between this thread, the recovery of $70+Bb  of stolen funds, the new pipeline and the oil presently enroute to Russia, the nearly complete elimination of the dasholes, the observation of MasterCard and Bloomberg showing IQD rates and references (which we hope will go up asap), the visit from the U.S. Congress group, and the meetings referenced above.

One thing is certain, a lot of high level people in Iraq got used to living a certain life-style through corruption and theft, and that is being heavily suppressed, which means they will have to cooperate and get along and play nice if they want to maintain that lifestyle through legitimate means. GO RV and do it now!!!
