The 9th Circuit Court of Appeals has upheld the lower court's decision to quash The President's Temp Travel Ban E.O.

 

Known as "the 9th CIRCUS court", the heavily leftist court has had more of their decisions overturned than any other in the Nation.

They actually upheld the ruling made by a judge who had NO LEGAL RIGHT to even address / stop Trumps E.O. !

That alone proves how bad and rotten they truly are in The 9th....  they're  a crime.

Where were they for all ho'bummer's UNLAWFUL E.O.s.....?

 

The President will let US know shortly how they plan to address this extreme miscarriage of justice.

If I had to put money on the outcome, I would have won. Always thought this was on its way to the SCOTUS. I would have been surprised for the 9th Circuit to rule any other way...Sad thing is that this court is truly political in most if not all of its decisions...that is why it has the highest percentage of cases overturned at the SCOTUS.

April 12, 2009 – Upon learning that they had patronized a strip club, a Muslim man shoots and kills his brother-in-law and another man in Phoenix, Arizona.

June 1, 2009 – In a drive-by shooting, Abdulhakim Mujahid Muhammad – a convert to Islam who had traveled to Yemen and was deported to the U.S. for overstaying his visa – opened fire on U.S. soldiers standing in front of a Little Rock, Arkansas, recruiting office. Muhammad killed one private and injured another. April 14, 2010 – A Muslim convert, James A. Larry, 33, became angry that his family would not convert to Islam and shot his mother, pregnant wife, infant son and two nieces in Marquette Park, Illinois. He pleaded guilty to multiple counts of murder, attempted murder and the intentional homicide of an unborn child. “He was upset at his wife and their family — he felt disrespected that they would not join his religion,” Assistant State’s Attorney Jim McKay said. “It didn’t matter if they were young or old, pregnant or not. He wanted them dead.” Larry also shot his 13-year-old nephew in the face, but the boy survived. April 30, 2011 – Rahim Abdul Alfetlawi, 46, shot his step-daughter in the head at point-blank range in Warren, Michigan, after she refused to strictly adhere to Muslim customs. The family claimed the motive was not religion.

Sept. 11, 2011 – Three Jewish men are discovered in Waltham, Massachusetts, with their throats slit from ear to ear and nearly decapitated. Authorities believed the murders were not random, and thousands of dollars in cash and marijuana were left at the scene. According to reports, authorities believe Boston Marathon bombers Tamerlan Tsarnaev and his younger brother, both Muslims, may have been responsible for the triple homicide.

Jan. 15, 2012 – A Jordanian Muslim man, Ali Mahwood-Awad Irsan, 57, gunned down Iranian medical student, Gelareh Bagherzadeh, a friend of his daughter and a Christian convert who widely denounced Islam. He later killed his Christian son-in-law after his daughter married him without permission. Assistant Harris County District Attorney Tammy Thomas told a district judge, “He said, ‘I killed that b–ch, and you’re next. No one insults my honor as a Muslim and gets away with it.'”

 Feb. 7, 2013 – Yusuf Ibrahim, 28, shot two Coptic Christians to death and beheaded them in Buena Vista, New Jersey. March 31, 2013 – Reshad Riddle walked into an Ashtabula, Ohio, church and fatally shot his father after an Easter service. After the shooting, witnesses say, walked through the church holding the gun and shouted that the slaughter was “the will of Allah. This is the will of God.”

April 15, 2013 – Muslim Chechen brothers Dzhokhar Tsarnaev and Tamerlan Tsarnaev detonate two pressure cooker bombs during the Boston Marathon, killing three people and injuring an estimated 264 others. After the bombing, they killed an MIT policeman, stole an SUV and exchanged gunfire with police. Tamerlan was shot and his brother drove over him with the stolen SUV. Tamerlan was pronounced dead at the scene. After a manhunt, police found Dzhokhar hiding in a boat in a man’s backyard. Dzokhar has been sentenced to death.

Aug. 4, 2013 – A Muslim convert, Daymond Agnew, 34, went to an Ace Hardware store on a “mission from Allah to help people” before he fatally stabbed employee Daniel Joseph Stone 17 times.

March 6, 2014 – Registered sex offender James Cosby, 46, is accused of bludgeoning his lesbian daughter to death and shooting her lover in Port Bolivar, Texas. Police believe he then dumped the bodies near a ferry gate. In his bedroom, Cosby had the Quran open to a page that says homosexuality is a sin, family advocate Quanell X told KHOU-TV. “It’s quite unfortunate but he had a real, real warped understanding, in my opinion, of the religion of Islam and its position on the *** lifestyle and what one should do,” Quanell X said.

April 27, 2014 – A 30-year-old Muslim man, Ali Muhammad Brown, is accused of shooting to death two men in Seattle and a man in New Jersey. According to local reports, he told police the killings were “vengeance” for U.S. actions in the Mideast. According to court documents, he said they were “just kills” and that he was “just doing my small part” as a self-styled jihadist.

Sept. 25, 2014 – Alton Nolen is accused of beheading a woman in Moore, Oklahoma. Co-workers reported that Nolen had been trying to convert them to Islam. Nolen reportedly used “some Arabic terms” during his attack and had an interest in beheadings. Nolen told a judge, “I’m Muslim. My question is, do you have any Muslims that can represent me as a Muslim?”

May 3, 2015 – In Garland, Texas, Pamela Geller, along with her group the American Freedom Defense Initiative, hosted a “Draw Muhammad” event. Elton Simpson and Nadir Soofi of Phoenix responded to a call to “avenge the prophet” and traveled to Garland, where they were shot and killed by a security guard after opening fire in an apparent attempt to get into the building. Well, after hashing through that legaleaze it appears to me that the 9^th Circus did not even mention or address the law cited for the EO.  It is as if Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. doesn’t exist.

They did set up the strawman muslum ban to use as an excuse for issuing their ruling, but rather than actually rule on the law they based their decision on Our decision is guided by four questions:  “(1) whether the stay applicant has made a strong showing that he is likely to succeed on the merits; (2) whether the applicant will be irreparably injured absent a stay; (3) whether issuance of the stay will substantially injure the other parties interested in the proceeding; and (4) where the public interest lies.”. 

Too bad their decision was not actually based on the Constitutional Law cited in the EO.  Sad part is this is not a surprise to anyone.

So when the last time was the Judicial 1/3 of our government has come under checks and balances?  I mean, if you are overturned 86% of the time I could make a case you have violated your oath to uphold the Constitution.  Founders check for judges is the same as the check on the President.  If an Appellate Court has a 14% correct rate it is time to impeach some political hacks with a black robe fetish.  Could easily say goodbye to Ginsberg too.  After she stated she considered foreign laws in her decisions she should have been removed from SCOTUS immediately.

Not that it would have made a difference in the 9th Circus where all decisions are based on predetermined loonie leftie principals by judges who think they are legislators, but after hearing the US Attorney's arguments on Tom Sullivan's radio show, there was not even a modestly cogent case made.  Lot's of stuttering, fully intimidated by the judge's improper and irrelevant questions, and had no answers for the same factual questions posed by the judges in the two earlier hearings.  The judges can't be fired, only impeached; but that US attorney should never again see the inside of any courtroom anywhere.  

 

It is now time to quash this inane side show.  The Executive order has already been administratively amended by Trump to exclude from its terms all current holders of green cards and visas.  NO new EO is needed to effectively exclude all others (i.e., those now outside the US who are not holding valid current "admissions" slips).  Just a word to the higher level State Department Officers who have final approval authority that their approval of any new docs for people from those countries will NOT be signed until they have been conformed to the new vetting requirements, the publication of which is pending.  There is no official formal authority needed for this as no non-citizen has any inherent right to enter the US, and slow walking paper work is the default methodology of every Federal bureaucrat.

 

Pursing this now totally irrelevant EO any further will only jeopardize or delay the confirmation of the Supreme Court nominee, as the dems would like nothing better than to have this idiotic case go up and be effectively upheld by another 4-4 vote.  Moreover, the original stay and the 9th's assertion that their stay applies throughout the US is total baloney.  The same bs was filed in numerous States, but in all cases so far is as yet unheard or have been thrown out.  Circuit Court of Appeals rulings are effective only within the Circuit making the ruling, and the Supreme Court often does not agree to hear hot issues until their is a conflict between the Circuits.  

 

No new EO is needed, but should do a slow walk petition for a full en banc rehearing in the 9th, which would become moot when the EO, by its terms, expires before such a hearing would be held, which would result in dismissal of the case without a decision.  Thus, the POTUS position could quite properly be that he did not, in fact, lose the case because the merits were never argued, and only preliminary procedural issues were ever argued, but never resolved as the underlying issue became moot.  And in the mean time, no NEW entry permits need be issued to anyone from anywhere that satisfactory screening and vetting cannot be performed.

You know what this actually shows? This shows that the states and their universities are dependent on foreign workers rather than US citizens. As such the actual irreparable harm is toward the citizens of the USA and the states in the legal case. No US company should be dependent on foreign born workers to complete their business objectives unless those business objectives are 1) the location of the business resides outside of the USA and 2) the business objective is directly related to a foreign based objective. The American Worker is the one harmed by this as is clearly illustrated when there is irreparable harm in such a fashion that a business cannot continue to progress towards its objectives because of the dependency laid at the feet of foreign workers. Time to hire American!

If judges were right 100% of the time, there would be no need for Courts of Appeal and the SCOTUS.  Legislative, Executive, Judicial.....for a reason people, and total control of all 3 by the POTUS isn't it.
