Thought about putting this under my favorite Hidabeast lie, but it deserves its’ own thread.  If you remember Hildabeast’s original statement was that there was no classified information on her server. That evolved to there was no information marked classified on her server, which evolved to the current version which is there was no information that was marked classified at the time it went on her server.  No matter which version you look at, they are all lies.  It can not be denied that there was TOP SECRET messages on her unsecured server.  And regardless of the lie du jour, according to this article it doesn’t matter

Petraeus was prosecuted for much less than this, and now I see they want to demote him retroactively ( http://www.thedailybeast.com/articles/2016/01/18/exclusive-pentagon-may-demote-david-petraeus.html ), yet Hidabeast is still the odds on favorite to win the Dem nomination.  What a sad demonstration by those that put “progressivism” and party before what’s right for the Country.  RV ME

 

Inspector General: Clinton emails had intel from most secretive, classified programs

 

EXCLUSIVE: Hildabeast Clinton's emails on her unsecured, homebrew server contained intelligence from the U.S. government's most secretive and highly classified programs, according to an unclassified letter from a top inspector general to senior lawmakers.

 

Fox News exclusively obtained the unclassified letter, sent Jan. 14 from Intelligence Community Inspector General I. Charles McCullough III. It laid out the findings of a recent comprehensive review by intelligence agencies that identified "several dozen" additional classified emails -- including specific intelligence known as "special access programs" (SAP).

 

That indicates a level of classification beyond even “top secret,” the label previously given to two emails found on her server, and brings even more scrutiny to the presidential candidate’s handling of the government’s closely held secrets.

 

“To date, I have received two sworn declarations from one [intelligence community] element. These declarations cover several dozen emails containing classified information determined by the IC element to be at the confidential, secret, and top secret/sap levels,” said the IG letter to lawmakers with oversight of the intelligence community and State Department. “According to the declarant, these documents contain information derived from classified IC element sources.”

 

Intelligence from a "special access program,” or SAP, is even more sensitive than that designated as "top secret" – as were two emails identified last summer in a random sample pulled from Clinton's private server she used as secretary of state. Access to a SAP is restricted to those with a "need-to-know" because exposure of the intelligence would likely reveal the source, putting a method of intelligence collection -- or a human asset -- at risk. Currently, some 1,340 emails designated “classified” have been found on Clinton’s server, though the Democratic presidential candidate insists the information was not classified at the time.

 

“There is absolutely no way that one could not recognize SAP material,” a former senior law enforcement with decades of experience investigating violations of SAP procedures told Fox News. “It is the most sensitive of the sensitive.”

 

Executive Order 13526 -- called "Classified National Security Information" and signed Dec. 29, 2009 -- sets out the legal framework for establishing special access programs. The order says the programs can only be authorized by the president, "the Secretaries of State, Defense, Energy, and Homeland Security, the Attorney General, and the Director of National Intelligence, or the principal deputy of each."

 

The programs are created when "the vulnerability of, or threat to, specific information is exceptional,” and “the number of persons who ordinarily will have access will be reasonably small and commensurate with the objective of providing enhanced protection for the information involved," it states.

 

According to court documents, former CIA Director David Petraeus was prosecuted for sharing intelligence from special access programs with his biographer and mistress Paula Broadwell. At the heart of his prosecution was a non-disclosure agreement where Petraeus agreed to protect these closely held government programs, with the understanding “unauthorized disclosure, unauthorized retention or negligent handling … could cause irreparable injury to the United States or be used to advantage by a foreign nation.” Clinton signed an identical non-disclosure agreement Jan. 22, 2009. 

Fox News is told that the recent IG letter was sent to the leadership of the House and Senate intelligence committees and leaders of the Senate Foreign Relations Committee, as well as the Office of the Director of National Intelligence (ODNI) and State Department inspector general. 

 

Representatives for the ODNI and intelligence community inspector general had no comment.

 

In a statement, State Department spokesman John Kirby said, “The State Department is focused on and committed to releasing former Secretary Clinton’s emails in a manner that protects sensitive information. No one takes this more seriously than we do.”

 

The intelligence community IG was responding in his message to a November letter from the Republican chairmen of the Senate intelligence and foreign relations committees that questioned the State Department email review process after it was wrongly reported the intelligence community was retreating from the “top secret” designation.

The intelligence agencies now have their own reviewers embedded at the State Department as part of the Freedom of Information Act (FOIA) process. The reviewers are identifying intelligence of a potentially classified nature, and referring it to the relevant intelligence agency for further review. 

 

There is no formal appeals process for classification, and the agency that generates the intelligence has final say. The State Department only has control over the fraction of emails that pertain to their own intelligence.

 

While the State Department and Clinton campaign have said the emails in questions were “retroactively classified” or “upgraded” – to justify the more than 1,300 classified emails on her server – those terms are meaningless under federal law.

 

The former federal law enforcement official said the finding in the January IG letter represents a potential violation of USC 18 Section 793, “gross negligence” in the handling of secure information under the Espionage Act.

Hidabeast and her minions are sticking to the “nothing marked confidential” version of her lie in order to keep the non-thinking  believing she did nothing wrong.  The huge problem with this pathetic defense is that she signed an NDA when she became SOS, an NDA that has now been shown to be violated 24 times (and counting).

 

The Hidabeast camp has also shown they have no new plays in the playbook.  I have now heard three of her mouthpieces try to make the claim the IG is playing politics and is in cahoots with the GOP (never mind that the IG is an Obummer appointee).  So be prepared for the “Ken Starring” of Intelligence Community Inspector General I. Charles McCullough III since Hildabeast has no other paw to stand on.  RV ME

 

 

 

Clinton Signed NDA Laying Out Criminal Penalties for Mishandling of Classified Info

 

Dem presidential candidate and top aides signed NDAs warning against ‘negligent handling’ of classified information

As the nation’s chief diplomat, Hidabeast Clinton was responsible for ascertaining whether information in her possession was classified and acknowledged that “negligent handling” of that information could jeopardize national security, according to a copy of an agreement she signed upon taking the job.

 

A day after assuming office as secretary of state, Clinton signed a Sensitive Compartmented Information Nondisclosure Agreement that laid out criminal penalties for “any unauthorized disclosure” of classified information.

 

Experts have guessed that Clinton signed such an agreement, but a copy of her specific contract, obtained by the Competitive Enterprise Institute through an open records request and shared with the Washington Free Beacon, reveals for the first time the exact language of the NDA.

 

“I have been advised that the unauthorized disclosure, unauthorized retention, or negligent handling of SCI by me could cause irreparable injury to the United States or be used to advantage by a foreign nation,” the agreement states.

 

Clinton received at least two emails while secretary of state on her personal email server since marked “TS/SCI”—top secret/sensitive compartmented information—according to the U.S. intelligence community’s inspector general.

 

The State Department said in September that Clinton’s private email system, set up at her Chappaqua, N.Y., home, was not authorized to handle SCI.

 

The Democratic presidential frontrunner defended her unauthorized possession of SCI and her sending of emails containing classified information by claiming that the information was not marked as classified when it was sent or received.

 

The language of her NDA suggests it was Clinton’s responsibility to ascertain whether information shared through her private email server was, in fact, classified.

 

“I understand that it is my responsibility to consult with appropriate management authorities in the Department … in order to ensure that I know whether information or material within my knowledge or control that I have reason to believe might be SCI,” the agreement says.

 

The Clinton campaign did not immediately respond to a request for comment on the NDA.

 

According to government security experts, the type of information that receives a TS/SCI designation is sensitive enough that most senior government officials would immediately recognize it as such.

 

“TS/SCI is very serious and specific information that jumps out at you and screams ‘classified,’” Larry Mrozinski, a former U.S. counterterrorism official, told the New York Post in August. “It’s hard to imagine that in her position she would fail to recognize the obvious.”

 

Additional emails on Clinton’s server contained information that was “born classified,” according to J. William Leonard, who directed the U.S. Information Security Oversight Office from 2002 to 2008.

 

“If a foreign minister just told the secretary of state something in confidence, by U.S. rules that is classified at the moment it’s in U.S. channels and U.S. possession,” Leonard told Reuters in August.

 

Clinton’s NDA spells out stiff criminal penalties for “any unauthorized disclosure of SCI.” The FBI is currently investigating whether Clinton’s private email server violated any federal laws.

 

In addition to her SCI agreement, Clinton signed a separate NDA for all other classified information. It contains similar language, including prohibiting “negligent handling of classified information,” requiring her to ascertain whether information is classified and laying out criminal penalties.

 

It adds, “I will never divulge classified information to anyone unless: (a) I have officially verified that the recipient has been properly authorized to receive it; or (b I have been given prior written notice of authorization” from the proper authorizes.

Cheryl Mills and Huma Abedin, Clinton’s two top aides, also signed copies of the classified information NDA.

 

Mills sent classified information to officials at the Bill, Hidabeast, and Chelsea Clinton Foundation in 2012, an email released by the State Department in September shows.

 

Mills’ NDA required her to inquire about the classification of information in her possession if she was unsure about its status. However, her attorney said that she “presumed” that the information she sent to the foundation was unclassified because it had been sent to her at her unclassified State Department email address.

Not only is she toast, she's burnt toast.  Like rats on a sinking ship her worshiping minions are quietly backing away looking for anytype of political flotsam that will keep them out of Club Fed.

 

Too bad for them though - the prosecutorial rule goes something like this; "The first one to confess gets leniency, mercy and very likely completely forgiven.  The rest are going to hell."

 

And now the shell game shifts with the investigators knowing exactly where the pea is, but the slimy arrogant teat suckers don't.

 

Can you imagine how many of those bastards will be staring at their ceiling tonight trying to go to sleep wondering if they should turn states evidence now but, not quite sure if it's too late...
