Iraqi Supreme Court Rules in Maliki's Favor

Iraqi Prime Minister Nuri al-Maliki today accused the country’s president for “breaching” Iraqi constitution by not assigning premiership to his State of Law bloc, which finished first in April’s parliamentary elections. Maliki made the remarks in a surprised speech televised live on national TV. Maliki added he will lodge a complaint against President Massoum, without giving any details.

 
Sharqiah News reported on Sunday night that the government’s security forces have encircled the residence of President Massoum. There are also reports that Maliki’s forces have besieged the residence of speaker of parliament. Iraqi Special Forces are seen in several locations in Baghdad. 
 
US Assistant Secretary of State Brett McGurk just tweeted the administration’s support for Iraqi President Fuad Massoum:
 
“Fully support President of Iraq Fuad Masum as guarantor of the Constitution and a PM nominee who can build a national consensus,” said McGurk. (Twitter/@brett_mngurk)

UPDATE: The state TV said the Iraqi Supreme Court said on Monday that Prime Minister's Maliki's State of Law bloc is the largest faction in the Iraqi Parliament. The ruling supports Maliki's demand that he should be asked to form the next government.

I read this and felt....UGH   what is wrong with this guy.  Why do you feel you need to stay, just greed?  The Iraqi people were doing the happy dance cause they  think you are gone..  Just go away, for them.  But then I noticed the date of article.  Alot has happened since..

This is confusing me.

 

I'm sure I read that Maliki filed with the court on Tuesday. Yet the article says on Monday and then again it says it's surrounded Abadi's residence. But this all happened before he was announced???

 

Then again the top of the page says Aug 10th which was before Abadi was announced as the nominated PM.

 

I think that's it's good you put it in the rumors sections because this looks like a blog and not news.

It's not. The article was from Monday. The court denied that it had issued such a ruling. Abadi was appointed the next day, and today, Maliki is threatening a new lawsuit, so obviously, he didn't win a lawsuit on Monday.

He says Iraq should handle their own problems right ?

Ya Monday after the president failed to name Maliki within the time frame allotted 15 days by the constitution from the day the president was chosen president

Maliki filed the case when Sunday ? And Monday the article was written so sometime in there the court made a ruling

It seems that the president ignored the ruling

That's the day Maliki made his speech and put out security forces incase their would be a coup attempt on maliki

I wonder what's going to happen now

He not only violated the constitution but ignored the Supreme Court of Iraq ruling

What a way to start off his new job as president by defying the law and constitution in his first task to full fill his position as president

I guess they were right

The court did not rule that State Law was the largest bloc, as these articles suggest, or Abadi would not be the nominee, and Maliki is threatening to file a new lawsuit based on your argument that Masoum filed a day late. Two different cases, one of which has been turned down by the court, and the other of which has yet to be filed. Incidentally, Maliki lost his argument on the largest bloc because he made the same argument, in 2010, that his adversaries in the National Alliance made a month ago, and Maliki won in 2010, so the court would be overturning precedent if it ruled in SoL's favor now, so the court fell back on its ruling from 2010 that National Alliance is the largest bloc. This argument about Masoum being a day late is laughable, considering Maliki took 10 months to be nominated in 2010.

Did you read malikis speech Sunday why he filed the law suit ?

Because he missed the 15 day deadline

Ok he said he would file it on Sunday

 

I didn't see that, but if he filed it Sunday, that's what he's talking about today. He wants the results of the decision on that case before he will leave. The articles posted in this thread all reference the previous "largest bloc" issue that was resolved when the court refused to issue a new ruling and fell back to its ruling from 2010.

But Maliki said on August 13 that Abadi's appointment was a "violation" of the constitution and "had no value."

Maliki said in his televised weekly address, "I confirm that the government will continue and there will not be a replacement for it without a decision from the Federal [supreme] Court."
