The Hague: Iraq News Network - International Criminal Court decided to refer the Iraqi Prime Minister Nuri al-Maliki, a group of senior aides to court on charges of genocide. Mr. Mohammed Al-Kaabi, the spokesman of the Court for the Middle East that among the associates of al-Maliki, who Torteurahalthm to court Lt. Gen. Farouk al-Araji, director of the Office of Maliki's military and Lt. Gen. Ali Ghaidan, the commander of the ground forces and Saadoun al-Dulaimi, the defense minister and the agency, Adnan al-Asadi, senior agent of the Ministry of Interior and the intelligence chief Zuhair Gharbaoui team Qassim Atta, director of operations at the intelligence service and the team called Hgati head of counter-terrorism. If this is true then there is no way Maliki will be allowed to be PM again. I'm hoping that this is an indication of the direction things are going. Maliki is done, its known already and charges are on the way from the international court.

I was just watching a documentary last night on the things that the Nazis did to people during WWI and some that were punished for their actions. I sadly have a feeling that History has repeated itself in Iraq. Maybe not the same methods, but certainly the same results. Targeting people for their looks, religion and who they did business with.

 

I know some people were brought to Justice (if we can call it that) Lets hope we are able to do the same for anyone responsible for unspeakable crimes against humanity.

 Prosecutor of the International Criminal Court, Fatou Bensouda, re-opens the preliminary examination of the situation in Iraq
 

Today, 13 May 2014, the Prosecutor of the International Criminal Court (“ICC”), Mrs Fatou Bensouda, announced that she has decided to re-open the preliminary examination of the situation in Iraq, previously concluded in 2006, following submission of further information to the Office of the Prosecutor in January 2014 in accordance with article 15 of the Rome Statute. The new information received by the Office alleges the responsibility of officials of the United Kingdom for war crimes involving systematic detainee abuse in Iraq from 2003 until 2008.  Iraq is a not a State Party to the Rome Statute, however, the ICC has jurisdiction over alleged crimes committed on the territory of Iraq by nationals of States Parties. The re-opened preliminary examination will analyse, in particular, alleged crimes attributed to the armed forces of the United Kingdom deployed in Iraq between 2003 and 2008.

During the preliminary examination, the Prosecutor shall consider issues of jurisdiction, admissibility and the interests of justice, in order to decide whether or not the criteria to open an investigation under article 53(1) of the Rome Statute have been met.  No decision on the opening of an investigation will be taken until a thorough analysis of all the relevant information is completed by the Office.

Background

On 9 February 2006, Mr Luis Moreno-Ocampo, the then Prosecutor of the ICCannouncedhis decision not to seek authorisation to initiate an investigation of the situation in Iraq because based on the information available to the Prosecutor at the time, the required gravity threshold of the Rome Statute was not met. In that decision, the Prosecutor indicated that this conclusion could be reconsidered in the light of new facts or evidence, in accordance with article 15(6) of the Rome Statute.

On 10 January 2014, the Office of the Prosecutor received a new communication from the European Center for Constitutional and Human Rights (“ECCHR”) together with the Public Interest Lawyers (“PIL”), alleging the responsibility of officials of the United Kingdom for war crimes involving systematic detainee abuse in Iraq from 2003 until 2008. The United Kingdom deposited its instrument of ratification of the Rome Statute on 4 October 2001. The ICC has therefore jurisdiction over war crimes, crimes against humanity and genocide committed on the territory of the United Kingdom, or by UK nationals as of 1 July 2002, representing the date of the entry into force of the Rome Statute.

Based on an initial assessment of the information received, the 10 January 2014 communication provides further information that was not available to the Office in 2006. In particular, the communication alleges a higher number of cases of ill-treatment of detainees and provides further details on the factual circumstances and the geographical and temporal scope of the alleged crimes. The Prosecutor will therefore conduct a preliminary examination in order to analyse the seriousness of the information received, in accordance with the requirements of article 15(2) of the Rome Statute, and ultimately determine whether there is a reasonable basis to proceed with an investigation.

Maliki is reported to have been wrangling with his own party to give immunity to him and 15 others if he chooses NOT to pursue the third term nomination. I hope the world courts nab him quick.

I am late.  Had a birth and death in the family same day.  So full of mixed emotions and now I am happy to see that this is finally coming to fruition.  This is why maliki "NEEDED" A 3RD TERM.   He needed immunity.   Now that he has no place in the GOI his goose is cooked.  I look for him to run but who will have him?  Iran?  Most likely.  If he is never in the news again the Iraqi people will never forget.  He has put a real hurt on that country by trying to be Saddam.  How dare he use the US to put him in complete control and form his dictatorship.  Life is so strange.  There are 3 men I give credit to for this.  Allawi, Najafi, and Sadr.  Allawi for never giving up, even though folks we calling him names, he was trying to wake folks up.  Najafi for his wisdom while working around this tyrant and his goons in the parliament and able to pass some of the important laws and close in on him.   Last but not least, Sadr.  Of all folks, he was the first one to call him out in parliament that was a shiite.  Allawi was the first shiite to call him out on all the agreements maliki made and never followed through with.  I don't want to count this is gospel, but geez, it is the best step so far in the right direction.  He did as Saddam and he should be tried as Saddam was.

 

 

One more thing, I just hope junior is on that list.  (ahmed)

Ramadi / NINA / Five people, from one family, were injured on Wednesday 14, May due to the fall of artillery shell on their home in the center of Fallujah. 

A security source told the reporter of the National Iraqi News Agency / NINA /: "The artillery shell landed in the courtyard of the house in the Nazzal neighborhood at the center of Fallujah, injuring five residents of the house, including a child and a woman." / End


This matters.  As does Nouri's War Crimes.  He is using collective punishment in Falluja (collective punishment is a legally defined War Crime).  Saying that terrorists are in Falluja, Nouri uses this to bomb residential neighborhoods -- again, a War Crime.  National Iraqi News Agency notes that five civilians -- all from the same family -- were injured in  today's bombing of civilian neighborhoods. 
 

In other violence today,  National Iraqi News Agency reports 1 person was shot dead in Ghazaliya,1 police member was shot dead in Shiekh Hamad Village, a Mosul roadside bombing left four people injured (two were police members), another roadside bombing south of Mosul left two people injured, an Abu Ghraib bombing left four people injured3 members of a police patrol were shot dead in Tikrit, a Jurfis-Sakhar roadside bombing left four Iraqi soldiers injured, a second Jurfis-Sakhar roadside bombing left 1 Iraqi soldier dead and two more injured,  an Alrifai roadside bombing left 2 Iraqi soldiers dead, a Mosul roadside bombing killed 1 police member and left three more injured, a Hit suicide bomber took his own life and the life of 1 police member with four more left injured, a Baquba attack left 4 police members dead and four more injured1 intellignece officer was shot dead in Balad, a Badush roadside bombing left three people injured, a mosque guard in Mehajeran was shot dead, and 1 corpse was discovered dumped in the streets of Abu Ghraib. In her much more complete rundown of today's violence (much more complete than mine) Margaret Griffis (Antiwar.com) counts 40 dead and forty-seven injured.
