Marco Rubio Introduces Constitutional Amendment To Ban ObamaCare

AUTHOR Warner Todd Huston

Florida’s junior Senator, Republican Marco Rubio, has introduced an interesting idea. Why not add an amendment to the U.S. Constitution that would essentially ban nationalized healthcare insurance plans like Obamacare?

His proposal would say something like: “Congress shall make no law that imposes a tax on a failure to purchase goods or services.”

This would make Obama’s individual mandate invalid and would prevent the government from forcing citizens to buy government approved insurance.

“ObamaCare is a disastrous policy that is not only destructive to job creation, it will also unleash the corrupt and scandal-ridden IRS on taxpayers simply for not buying health insurance,” Rubio said in a statement about his plan.

Rubio feels that we should “put our faith in the American people,” and insisted that we, the people, are smart enough to make out own healthcare choices without the iron boot heel of government on our necks to force us to make the “right” choice.

“Let’s do everything we can to keep the IRS out of our health care and stop future congresses from forcing private citizens to spend their hard-earned money on products or services Washington is forcing on them,” Rubio said.

Of course, a Constitutional amendment is quite difficult to achieve. Such an amendment must be ratified by three-quarters of the states in order to pass muster and since the sold-out Supreme Court already upheld Obamacare, Rubio’s amendment would have to refight that battle, too.

Congressman Steven Palazzo (R-MS) has introduced an idea similar Rubio’s. Palazzo has introduced H.J. Res. 28, called the “Proposing an amendment to the Constitution of the United States to limit the power of Congress to impose a tax on a failure to purchase goods or services.”

Rubio is not alone in thinking that ObamaCare doesn’t bode well for the American public. The American public thinks so too, with a recent CNN poll showing that 54% of Americans oppose ObamaCare. TheLabor unions that helped get Obama into the White House aren’t so thrilled either, and are opposing its implementation. Doctors are literally turning their backs on it. Even Sen. Max Baucus, one of ObamaCare’s architects, calls it a “train wreck.” Of course, that’s true with any socialist project: it looks great on paper when it has something for everybody – all for free, of course – but invariably fails when it meets real-world people, costs, and government inefficiency.

I'm becoming pretty impressed with Senator Rubio, he has a good understanding and a systimatic belief in the constitution and wants to see the American people thrive in this country... I think that a Cruz-Rubio or a Rubio-Cruz presidental ticket in 2016 might not be a bad idea in itself...

Great idea. Unfortunately our corrupt government would have to pass it.

There are two ways to pass a constitutional amendment; the Constitutional Convention route does not require any involvement from the Federal Gov...only the states are involved.
