Court: Obama's Bypass of Congress

To Fill Labor Jobs 'Unconstitutional'

Reuters

U.S. Court of Appeals for the D.C. Circuit calls President Obama's move to bypass Senate to fill job posts on labor panel unconstitutional — administration promises appeal.

A 3-judge panel of the United States Court of Appeals for the District of Columbia Circuit handed the Obama administration a major defeat today, ruling that President Obama’s appointment of three members to the National Labor Relations Board last year violated the Appointments Clause of the Constitution, which says that the president “shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law.”

Here’s a key section from Chief Judge David Sentelle’s majority opinion:

The [National Labor Relatinons] Board conceded at oral argument that the appointments at issue were not made during the intersession recess: the President made his three appointments to the Board on January 4, 2012, after Congress began a new session on January 3 and while that new session continued. Considering the text, history, and structure of the Constitution, these appointments were invalid from their inception. Because the Board lacked a quorum of three members when it issued its decision in this case on February 8, 2012, its decision must be vacated. [Citations omitted.]

The case stemmed from a canning company’s challenge to a NLRB ruling, but the implications stretch well beyond one particular labor dispute. If the Supreme Court lets the D.C. Circuit’s ruling stand, either by upholding it or refusing to hear the inevitable appeal from the Obama administration, nearly a year’s worth of NLRB decisions will be rendered worthless.

Why people keep celebrating a puppet who consistently breaks our laws

is astounding.

I guess being ignorant also means they have no idea that what they are

supporting is wrong.

Wrong for Democracy, wrong for Freedom,

wrong for Independence, wrong for The U.S.of A.

This administraton is so hell-bent on removing Independence in exchange for

complete dependency.

Guess that's what his supporterters are always celebrating. <_<

Sad. :(

It's obvious the same people that have an agenda with the gun laws , actually have an agenda with our current president and find anything he does wrong, but here's a list of the presidents that wrote the most executive orders.

I posted this on another thread, but its worth reposting because it comes from HARVARD..., a liberal hub!

Quoting the article:

"A new study conducted at Harvard University shows that in America,

Liberals have a significantly lower IQ than Conservatives. The study was

conducted on 100,000 registered voters in 40 different states over the

last twelve years, and has concluded its results.

The first part of the study lists the correlation between political

beliefs and intelligence. Subjects of the study were chosen at random

and requested to come to an unmarked van to take a test and answer some

questions for a reasonable amount of money.

Of the 100,000 people, there were people from many doctrines, from

conservative to liberal to marxist to fascist. Socialists came out on

bottom, with an average IQ of 87. The second worst were Liberals and

then Marxists, with 88 and 89 respectively. Conservatives received an

average score of 110, which is significantly above average. "

Also,

"

Other parts of the study included the daily activities of the various

people based on their doctrines. Apparently, Liberals are five times

more likely to commit a crime, steal or cheat on a test than anybody

else except for Socialists, 52% of which have committed a major felony

while being watched. Conservatives not only did not commit any crimes,

but they actually prevented them, as the few events where a Conservative

was threatened by a thief or mugger was hindered by a concealed

handgun. Also, Communists are the most likely to commit rape or sexual

assault, second to socialists.

"

It's the IQ folks!!

I think you'd have to actually look at the reason for the executive order. Like were they in order to circumvent the Constitution?
