Q: Did the terms of Texas's admission to the Union include permission to withdraw if it found statehood not to its liking?

It is said of Texas (and, occasionally, Vermont) that it received a letter or document of permission to withdraw from the Federal Union if it so chose. In the case of Texas, this permission is sometimes said to have been granted at the time of Texas's admission as a state. Other times it is said to have been included in the terms readmitting Texas to the Union after the Civil War.

In fact, Texas received no special terms in its admission to the Union. Once Texas had agreed to join the Union, she never had the legal option of leaving, either before or after the Civil War.

The early years of the United States had seen a great deal of debate over whether states could, in fact, legally withdraw from the Union. During the War of 1812 it was New England that wanted to secede from the rest of the country. Later, it was the Southern states. Secessionists argued that states were sovereign and had the right to withdraw from the Union. Opponents countered that the Constitution created a sovereign union that, once entered into, could never be broken. Eventually, the question was put to the test and settled permanently on the battlefields of the Civil War.

The Presidential Proclamation declaring peace between the United States and Texas after the Civil War, dated August 20, 1866, states very clearly in the following passage that no state had the right to leave the Union (emphasis added in all capitals):

And whereas,

the President of the United States, by further proclamation issued on the second day of April, one thousand eight hundred and sixty-six, did promulgate and declare, that there no longer existed any armed resistance of misguided citizens, or others, to the authority of the United States in any, or in all the States before mentioned, excepting only the State of Texas, and did further promulgate and declare that the laws could be sustained and enforced in the several States before mentioned, except Texas, by the proper civil authorities, State, or Federal, and that the people of the said States, except Texas, are well and loyally disposed, and have conformed or will conform in their legislation to the condition of affairs growing out of the amendment to the Constitution of the United States, prohibiting slavery within the limits and jurisdiction of the United States;

And did further declare in the same proclamation THAT IT IS THE MANIFEST DETERMINATION OF THE AMERICAN PEOPLE THAT NO STATE, OF ITS OWN WILL, HAS A RIGHT OR POWER TO GO OUT OF OR SEPARATE ITSELF FROM, OR BE SEPARATED FROM THE AMERICAN UNION; and that, therefore, each State ought to remain and constitute an integral part of the United States;

On March 30, 1870, Congress passed the Act to admit the State of Texas to Representation in the Congress of the United States. Likewise, this act contains no language that would allow Texas to unilaterally withdraw from the United States.

Some facts and fiction for Texans who want state to secede from U.S.

WASHINGTON — More than 85,000 people have signed an electronic petition to the White House asking President Barack Obama to allow Texas to ”withdraw from the United States of America.”

In other words … SECESSION !!!!!

”To do so would protect its citizens’ standard of living and re-secure their rights and liberties in accordance with the original ideas and beliefs of our founding fathers which are no longer being reflected by the federal government,” the online petition states.

Texas patriotism, perhaps. But this secession business is not simply a social media exercise. It takes blood, sweat and tears — emphasis on the blood.

Here are some facts and frequently believed misconceptions about Texas secession:

Fact or fiction? As a condition of its admission to the Union, Texas was given the unilateral power to return to its former Lone Star Republic status if it so chose.

FICTION.

Texas Gov. Rick Perry is responsible for spreading this widely held misconception. Three years ago, he declared, ”When we came into the Union in 1845, one of the issues was that we’d be able to leave if we decided to do that.”

That’s just plain not true.

Texas has no right to secede. The bottom line is that any state — or confederation of states — can illegally secede from the Union. But the result, as we discovered in 1861, is Civil War.

Fact or fiction: Texas is permitted to divide itself into five states.

FACT.

The 1845 Joint Resolution for Annexing Texas affirms Texas’ right to divide itself into five states if it chooses. Texas has never tested the treaty of annexation. But it is possible that 10 U.S. senators could, at some point, represent the current territory of Texas.

Fact or fiction: Rick Perry favors secession.

FICTION.

At a 2009 Tea Party event in Austin, Perry made news when he said he would understand why some people in Texas might want to leave our ”great Union.”

”If Washington continues to thumb their nose at the American people, you know, who knows what may came — what may come — out of that,” he said.

You know where that was leading. But the governor has never — ever — endorsed secession. And after the secession petition took off , Perry’s press secretary, Catherine Frazier, underscored his opposition to secession.

”Gov. Perry believes in the greatness of our union and nothing should be done to change it,” she said. ”But he also shares the frustrations many Americans have with our federal government.”

Fact or fiction: There is widespread support in Texas for secession.

FICTION.

Secession fervor south of the Red River? Not quite. More like a loud but small minority.

There hasn’t been any recent polling, but a 2009 Rasmussen Reports survey found that 31 percent of Texans say the state has a right to secede but just 18 percent of Texans would vote to secede from the U.S. if given a choice. Three-fourths of Texas citizens said they oppose secession.

That 18 percent figure is identical to the percentage of Americans who say they favor allowing their state or region to secede from the nation, according to a 2008 Zogby poll. So Texas is no more secessionist than, say, Alaska. Or Rhode Island.

Fact or fiction: Rick Perry is already the commander-in-chief of Texas Armed Forces.

FACT.

Although Perry is almost the only governor to describe himself that way, he is in fact the commander of the Texas National Guard, which includes 25,500 members of the Texas Army National Guard, the Texas Air National Guard and Texas State Guard. He also is the commander of the Texas Rangers.

But, as President Dwight Eisenhower proved when he integrated Little Rock’s Central High School more than five decades ago, the commander-in-chief in Washington can nationalize National Guard forces and require them to follow orders from the president, not the governor.

Fact or fiction: The Texas Legislature has the authority to nullify federal laws it dislikes.

FICTION.

Like secession, nullification is one of those extra-legal concepts that were hotly debated during the decades leading up to the Civil War. South Carolina provoked a constitutional crisis in 1832 by adopting an ”Ordinance of Nullification” to protest a protective tariff enacted by Congress. Federal lawmakers responded with a Force Bill empowering President Andrew Jackson to use military power against South Carolina, which in turn repealed its Ordinance of Nullification on March 11, 1833.

Nullification threats have occurred sporadically in the past 180 years, including states opposed to enforcing the Fugitive Slave Act of 1850. Today, some states are effectively nullifying federal drug laws by legalizing marijuana for medicinal or recreational purposes. And Republican legislators in states such as Texas are threatening to block enforcement of Obamacare. The issue may yet reach the U.S. Supreme Court.

Maggie... As a Texan, I take offense to your statement. Normal? If waking each day at 5 in order to work diligently providing my neighbors with an energy source that fuels their cars, heats their homes, allows their lights to come on, and provides a base material for the production or packaging of just about everything they need to live is not normal then I guess I'm odd. If supporting my hot wife and providing for our 6 kids on a daily basis without government assistance is not normal, then I guess I'm an outcast. If having the ability to grow my own food and harvesting wildlife for consumption is not normal then I guess I'm weird. If wanting parasite, freedom sucking, lying, lazy politicians to leave me alone to my own devices means I'm not normal then so be it!!! However, know this!!! When the scheisse hits the fan and you liberals have no one else to take money from and control through overbearing governmental control, don't come looking for help from us non-normal Texicans!! We will be the ones doing just fine because we've spent a lifetime learning how take care of ourselves!!!!

As a Texican, I am not for secession. However, I did sign the petition. Why? Washington needs to understand the level of our displeasure! Texas has balanced its budget and made itself a friendly environment for business and innovation. Our federal government through its obtrusive intervention of over regulation continues to do the opposite. 1200 days I do believe without a budget...

I guess I am a Texan but I'm not mad. I don't know that I am normal either. I only know when I rolled into Texas I was informed that I was not in the US and I lived in the Free State Of Van Zandt. They told me they never "legally" joined in the Union. Well, I didn't want to fight it, it's like this, when in Rome do as the Romans. I never bothered to look it up, and I didn't care. I didn't think I would be here this long. I don't care who secedes, there were all kinds of stuff said about the results of the election. If Romney won, they were leaving the country. Why do people put that kind of stuff in the news? To get attention, to show their ignorance. If they really felt that way, then just do it, don't talk smack. It's their business, why they telling the world? Heck I voted for Romney, I ain't leaving. I have no plan B cause I didn't win. I will vote again in the next elections God willing. It the congress I worry about. They can really hurt us. Since i am middle class, they have hit us really hard. Take a look at your phone bill, electric bill, they got more taxes than the tax code it self. If were to be socialist, then ya better raise the taxes. Thats how it works. IF not, ya better get rid of unfunded programs. But hey, SS is funded but they stole the money for years and years and now it's not funded. Whatever. One day at a time. So, I guess I am far from normal. :)

Maggie, Maggie sometimes your sweet as ever and sometimes I'm baffle by some of your comments.

I will give you the benefit of the doubt, in you really not meaning that we Texans are not NORMAL. I do I have to agree with stonewall, I find that statement offensive. I would dare not tell anyone that their not normal. That's just mean. :( If anything your comment would make more people mad than the post itself.

Now that we know that 70,000 + Texans have signed the petition, and whether it comes to fruition or not, I would suggest each and every one of you write/bombard your representatives, let them know we will not stand for weak leaders, including themselves, that they are replaceable and we will continue to replaced them until we have the God fearing representative we want to represent the people.

Texas Constitution (adopted in 1876) or the terms of annexation. (in Article 1, Section 1)

"Texas is a free and independent State, subject only to the Constitution of the United States..." (note that it does not state "...subject to the President of the United States..." or "...subject to the Congress of the United States..." or "...subject to the collective will of one or more of the other States...")

Neither the Texas Constitution, nor the Constitution of the united States, explicitly or implicitly disallows the secession of Texas (or any other "free and independent State") from the United States. Joining the "Union" was ever and always voluntary, rendering voluntary withdrawal an equally lawful and viable option (regardless of what any self-appointed academic, media, or government "experts"—including Abraham Lincoln himself—may have ever said).

Both the original (1836) and the current (1876) Texas Constitutions also state that "All political power is inherent in the people ... they have at all times the inalienable right to alter their government in such manner as they might think proper."

Likewise, each of the united States is "united" with the others explicitly on the principle that "governments derive their just powers from the consent of the governed" and "whenever any form of government becomes destructive to these ends [i.e., protecting life, liberty, and property], it is the right of the people to alter or to abolish it, and to institute new government" and "when a long train of abuses and usurpations...evinces a design to reduce them under absolute despotism, it is their right, it is their duty, to throw off such government, and to provide new guards for their future security."

Stonewall by the way comes from one of my heros. Thomas "Stonewall" Jackson. Yes, I'm a redneck who named his first born son after a Confederate General! The reasons are too numerous to list but the most of which was his devout faith in the one true God, his love and care for his fellow man and his desire to rise up through self determination and hard work from the depths of poverty.

Maggie, One thing I can tell you about Texas, it's a whole new culture to me. i was in shock. Back in the day you had good neighbors, well in today you still have that in Texas. They can hold their own, and they will make it if the sh@t hits the fan. They are very resourceful. The housing crash didn't hit here like it did all over the states. Mainly because it was not bubbled like in CA, FL, and AZ. Homes don't appreciate like they do in the major artery cities. Even Dallas & Houston didn't get the big bubble. I have to admit for a bunch of rednecks, they got their chit together. They taught me a few things. It never fails that those who leave here, always come back. Some Never leave, and have never been out of the state. They value one special thing and it's all they need, their love of family. Serious. We all love our families, but I come from Los Angeles to small town in Texas, and the best way to put it, is they do it right. There is always time for grandma, sister, mom, dad, uncle, to just watch the grass grow. I am redneckized with a shot of city. It's a heartland. You have you share of not normals, but most are friendly and neighborly. Heck every time I bought a house the neighbors would come and bring all kinds of goodies and give you the everyones phone number on the block. People wave when you drive down the street. It's different, but I like it. The weather is a different story. :o

I might be asking a dumb question, but just like everywhere else in the world you can't hold one hostage. If Texas, Hawaaii, or Florida wants to leave, then they can. Right?

If the rules changed since you joined, then you don't need to ask, you just do it. If they want to fight, well, another civil war. See, I ain't no historian for sure and very ignorant on these type of matters. I know the rights of being part of the US but leaving?

What is the true and correct on this?

What is America? Is it just a geographical location on a map? I think not! America is an ideal born out of a fierce desire for liberty and independence! America is the greatest exercise in experimental political science! Nothing like it had ever been tried and none ever expected it to succeed but those doubters never fully grasped the deep rooted belief in freedom!!! A government for the people by the people! A government that allowed its people the opportunity to be anything or anyone they wanted to be without intrusion. America was designed and instituted in such a way that government itself should fear the people and not the people fearing the government! It's because of the American ideal that so many from every walk of life and from every corner of the earth risked life and limb to come here searching for the dream! Where is this America??? It can still be found in my neck of the woods where a mans worth is still judged by the content of his character and that character is found in his creator and in his desire to exercise liberty and freedoms by working hard to provide for his own, chipping in to help a neighbor, and being accountable for his actions! Why d Texans want to secede? Because we want America back!!!!
