  2. March 15, 2013 Link:http://www.ekurd.net/mismas/articles/misc2013/3/kirkuk778.htm KIRKUK, Iraq's border with Kurdistan region,— The people of Kirkuk won’t be voting in the Iraqi elections because of ongoing issues about whom the area belongs to. Frustrated, some are saying Kirkuk should forget Iraq and become an autonomous region. It was almost twenty years ago that Omar Nour ad-Din was forced to leave his home in Kirkuk by members of Saddam Hussein’s Baath party. The former Iraqi leader was trying to change the composition of the city by forcing Kurdish locals out and bringing Arabs in. And ad-Din, accused of being linked to Kurdish nationalists, was forced to leave everything behind. Although he has since returned to Kirkuk, an Arab family moved into his house and he has never been able to return. Ad-Din is just one of thousands who have been waiting for some kind of resolution to this long-standing issue. In 2003, that resolution seemed to be coming closer, with the creation of Article 140 of the new Iraqi constitution, post-Saddam Hussein. The Article was supposed to remedy the expulsions, ethnic cleansing and Arabisation that Hussein’s regime had undertaken, through three main steps. And the deadline for the implementation of Article 140 was the end of 2007. However up until now nothing has happened and it’s been five years since that deadline expired. Kirkuk remains in limbo and because of this, its citizens won’t be able to vote in the upcoming provincial elections – this is due to these ongoing disagreements about rules for ethnic representation. And today in Kirkuk the leaders of the various different ethnic components in the city seem to have widely varying opinions on Article 140. Some think it’s time to give up on the clause, other’s think it’s essential to work through it. Sunni Muslims Arabs in the province believe that Article 140 should be considered void. “Article 140 is a mistake in the Constitution,” says MP Omar al-Jibouri from the Iraqiya bloc. “And it should be amended. It is no longer applicable,” al-Jubairi says, because Kurdish authorities have been encouraging Kurdish families to come back into Kirkuk to serve their own purposes. Of course, the Kurdish politicians, who would like to see Kirkuk become part of the semi-autonomous region of Iraqi Kurdistan, feel differently. And they say that the Kurdish who are returning to Kirkuk are simply those who were forced to leave before. “Article 140 is part of the Constitution and is not invalid. Anyone who thinks it is no longer applicable is going against the Iraqi Constitution and the rule of law,” Khalid Shwani, an MP from the Kurdish alliance in Baghdad,www.ekurd.net argued. “It is the responsibility of Iraqi MPs to cooperate in getting this Article implemented. If Article 140 was implemented I believe that Kirkuk would immediately become part of the Kurdish region,” he concluded. And the third group with a stake in Kirkuk, the ethnic minority Turkmen, remain in the middle of this dispute. Najat Hussein, a Turkman politician who sits on the provincial council in Kirkuk, describes Article 140 as frozen for the time being because of the circumstances. All of the wrangling over Article 140, followed by the inactivity, has seen locals becoming more and more frustrated. And recently there have been calls to make Kirkuk an autonomous region all on its own. One of the supporters of this idea is local political analyst, Ihsan Najm ad-Din. He believes that all of the political parties involved are wasting time and that they don’t seriously want to resolve the problem of Article 140. “The ideal solution is that the people of Kirkuk form their own autonomous region away from the influence of political forces,” ad-Din says. However until the different Iraqi political forces decide on any of those options, it seems that Umar - and thousands of people like him - will have to keep waiting until a decision is reached about their future
  3. Good article. Thanks K98. Imo, it would be in the best interests of all parties to resolve the Kurdish-Iraqi issues, and I think they will. I think most of this is simply political posturing. I don't think the Kurds will separate from Iraq, but nothing moves fast over there, and who knows how long it will take to work it out? My hope is quickly. RSS

  14. Exclusive: U.S. plans to let spy agencies scour Americans' finances Link: http://www.reuters.com/article/2013/03/13/us-usa-banks-spying-idUSBRE92C12720130313 By Emily Flitter and Stella Dawson and Mark Hosenball NEW YORK/WASHINGTON | Wed Mar 13, 2013 6:51pm EDT NEW YORK/WASHINGTON (Reuters) - The Obama administration is drawing up plans to give all U.S. spy agencies full access to a massive database that contains financial data on American citizens and others who bank in the country, according to a Treasury Department document seen by Reuters. The proposed plan represents a major step by U.S. intelligence agencies to spot and track down terrorist networks and crime syndicates by bringing together financial databanks, criminal records and military intelligence. The plan, which legal experts say is permissible under U.S. law, is nonetheless likely to trigger intense criticism from privacy advocates. Financial institutions that operate in the United States are required by law to file reports of "suspicious customer activity," such as large money transfers or unusually structured bank accounts, to Treasury's Financial Crimes Enforcement Network (FinCEN). The Federal Bureau of Investigation already has full access to the database. However, intelligence agencies, such as the Central Intelligence Agency and the National Security Agency, currently have to make case-by-case requests for information to FinCEN. The Treasury plan would give spy agencies the ability to analyze more raw financial data than they have ever had before, helping them look for patterns that could reveal attack plots or criminal schemes. The planning document, dated March 4, shows that the proposal is still in its early stages of development, and it is not known when implementation might begin. Financial institutions file more than 15 million "suspicious activity reports" every year, according to Treasury. Banks, for instance, are required to report all personal cash transactions exceeding $10,000, as well as suspected incidents of money laundering, loan fraud, computer hacking or counterfeiting. "For these reports to be of value in detecting money laundering, they must be accessible to law enforcement, counter-terrorism agencies, financial regulators, and the intelligence community," said the Treasury planning document. A Treasury spokesperson said U.S. law permits FinCEN to share information with intelligence agencies to help detect and thwart threats to national security, provided they adhere to safeguards outlined in the Bank Secrecy Act. "Law enforcement and intelligence community members with access to this information are bound by these safeguards," the spokesperson said in a statement. Some privacy watchdogs expressed concern about the plan when Reuters outlined it to them. A move like the FinCEN proposal "raises concerns as to whether people could find their information in a file as a potential terrorist suspect without having the appropriate predicate for that and find themselves potentially falsely accused," said Sharon Bradford Franklin, senior counsel for the Rule of Law Program at the Constitution Project, a non-profit watchdog group. Despite these concerns, legal experts emphasize that this sharing of data is permissible under U.S. law. Specifically, banks' suspicious activity reporting requirements are dictated by a combination of the Bank Secrecy Act and the USA PATRIOT Act, which offer some privacy safeguards. National security experts also maintain that a robust system for sharing criminal, financial and intelligence data among agencies will improve their ability to identify those who plan attacks on the United States. "It's a war on money, war on corruption, on politically exposed persons, anti-money laundering, organized crime," said Amit Kumar, who advised the United Nations on Taliban sanctions and is a fellow at the Democratic think tank Center for National Policy. SUSPICIOUS ACTIVITY The Treasury document outlines a proposal to link the FinCEN database with a computer network used by U.S. defense and law enforcement agencies to share classified information called the Joint Worldwide Intelligence Communications System. The plan calls for the Office of the Director of National Intelligence - set up after 9/11 to foster greater collaboration among intelligence agencies - to work with Treasury. The Office of the Director of National Intelligence declined to comment. More than 25,000 financial firms - including banks, securities dealers, casinos, and money and wire transfer agencies - routinely file "suspicious activity reports" to FinCEN. The requirements for filing are so strict that banks often over-report, so they cannot be accused of failing to disclose activity that later proves questionable. This over-reporting raises the possibility that the financial details of ordinary citizens could wind up in the hands of spy agencies. Stephen Vladeck, a professor at American University's Washington College of Law, said privacy advocates have already been pushing back against the increased data-sharing activities between government agencies that followed the September 11 attacks. "One of the real pushes from the civil liberties community has been to move away from collection restrictions on the front end and put more limits on what the government can do once it has the information," he said. Michael German, senior policy counsel for the American Civil Liberties Union, said that U.S. officials had floated a similar scheme to pool such data a decade ago, but that funding for the plan was later withdrawn by Congress. He said one of the problematic aspects of the plan is that there is "wiggle room" on how the information will be used. In the past, the National CounterTerrorism Center, which is supposed to ensure that critical threat information is shared among various agencies, was obliged to "promptly identify and purge any innocent U.S. person information." But the guidelines were subsequently loosened so that "not only can they keep the data for a number of years, but they can continue to use it," German said. Once spy agencies get such data, German said, "it's in a black hole. Time and again, we have evidence, unfortunately well after the fact, that somebody's civil rights have been violated, that the intelligence community simply ignores the rules."

The Iraqi source early in a statement quoted by Elaph »that Iran has entered the line crisis between Baghdad and Erbil, which erupted sharply Thursday after the approval of the House of Representatives on the country's budget for the current year 2013 the absence of the Kurds and their disapproval by not included a clause stipulating payment amount 4 billion dollars to foreign oil companies operating in the Kurdistan region, he insists the Kurds. The source noted that the Iranian delegation expensive by Qassem Soleimani Iranian official for the Iraqi file squad commander of Jerusalem in the Iranian Revolutionary Guard is currently contacts shuttling between Baghdad and Arbil, where he met there with Massoud Barzani, president region, Barham Saleh, deputy secretary-general of the Patriotic Union of Kurdistan led by President Jalal Talabani. He explained that the delegation had told them ready Prime Minister Nuri al-Maliki implement the demands of the Kurds in exchange for not feet to withdraw their ministers from the government, which will lead to its downfall, especially with the start of Ministers Iraqi withdrawal from recently. The source said that a solution is being studied now between the three parties to approve the payment of the amount four billion dollars to foreign oil companies in Kurdistan and to be in a special supplement attached to the budget law is a vote in parliament later. He pointed out that the entry of Iran in the crisis this comes a feeling of Tehran difficult situation experienced by Iraq as a result protests and demonstrations taking place in western provinces and northern a popular movement that could explode violent generally Iraqi authorities at any time, especially in light frictions that take place between the protestors and security forces which erupted in the cities of Fallujah a few days ago in Mosul last beer and led to the fall of the number of dead and wounded. Iran has called on countries in the region not to interfere in the crisis in Iraq, said Iranian Foreign Ministry spokesman Ramin Mehmanparast «it is incumbent on all countries to stand by the government and the Iraqi people together and avoid a crisis line to devote ethnic and sectarian differences there. He warned countries in the region from the repercussions of the Iraqi crisis «which will affect countries in the region, particularly the intervening negatively and which supports the project sectarian» Mtansla of his country's position in this direction. Added the Iranian official that «the people and political currents Iraqi enjoy political maturity appropriate that Saahlhma out of the crisis through dialogue and roads democracy. And said «that there are suspicious movements in the region aimed at finding differences and stirring sectarian strife between the components of the countries as well as create a tense atmosphere between the countries of the region in order to reach a state of chaos and instability in the region. ( My comments: I am no fan of Iran, but let's face facts. Iran is to Iraq, as Mississippi is to Alabama; In other words ...next door. The Iranian influence will always be there, if you think it wont, then I suggest you do a bit more studying. I like what I have highlighted in red. If true, it could keep this keg of TNT between the kurds and everyone else from exploding. The comments that were highlighted in blue were simply because I thought it rather humerous that the words Iran and democracy could be in the same sentence. My personal feelings are that the Iraqis in general are not big fans of ours and I certainly don't hear them chanting, USA, USA, USA ! The Iranians on the other hand are their next door neighbors, generally the same type of religion and cultural thinking. At this point, I don't give a rat's hiney who mediates this problem, and if Iran can pull it off, so be it. Yes, I know Iran wants to take over Iraq, but lets face it...Right now Iraq is totally being run by Maliki who is nothing but an Iranian puppett ( IMO anyway), so I say if Iran can help get the Kurds and the rest of the country to stay together...so be it.... We all say the main thing is " Do what will help Iraqs people" I agree, but c'mon guys, I did not invest my hard earned money into dinar just for the good of the Iraqi people, and if you tell me you did for that reason, and not to make money, I say you are full of it. ( With all due respect of course) lol. Ok, you can agree with my statements or disagree, as I said, just my opinion) . End of my rant. Thanks for putting up with me, RSS
  16. OK, if I am interpreting this correctly, it sounds like the Kurds will go back to the Parliment for no other reason but to cause desention. Someone correct me if I'm wrong. I hope I am. There are enough childish games being played in the Government without the Kurds causing more problems. I realise all fractions of their govt want as much as they can get, and the Kurds are no different. However, that being said, they got their 17% in the budget. I hear everyone talking about those poor Kurds. I say B.S. Get your butts back to work. You are hurting your own people as well as all the people of Iraq with this stupid Mexican ( no Hispanic pun intended) standoff ! Not to mention the fact that I'm getting tired of waiting on MY money!! I know many of you have differing opinions on this, but thats mine. This whole thing could be over if these people would just grow up. RSS
