BAGHDAD (Reuters) -

The first of July is a normal day for all but 328 Iraqis, most of whom are disappointed and deprived of privileges for four years, some of them for eight years and more. Few today consider this a threat to their freedoms. Judicial process prevented its implementation of "parliamentary immunity".

The parliamentary session, which ended its life and powers on Sunday, issued judicial warrants for the arrest and summoning and lifting the immunity of a number of deputies, but none of them were implemented for political reasons and deals between the parliamentary blocs prevented the appearance of any deputy before the judiciary.

In this regard, legal expert Amir al-Da'idi told Al-Ghad Press that "with the end of the parliament's life as of today, 328 deputies have become immune to parliamentary immunity, and therefore anyone connected to a particular case or before the judiciary has the right to prosecution. The former deputy as an ordinary citizen away from parliamentary immunity. "

"Every deputy has indications that the judiciary can prosecute him without the need for a request to lift the immunity of the parliament as it has already disappeared," he said. "Every citizen or body that has a case against a deputy has the right to request his appearance before the courts."

"The law gives immunity to deputies for four legislative years, but after the session, a normal citizen returns without immunity," said Mohammed Khalidi, the winning deputy of the Bayrak al-Khair coalition.

He stressed that "some of the deputies were issued arrest warrants and will be carried out the memoirs against them."

Former deputy of the coalition of state law, Mohamed Chihod, noted in his speech to "tomorrow," that "immediately after the disappearance of immunity from the MP begins the Iraqi judiciary to activate the arrest warrants of those wanted for the judiciary and the accused."

"In the past, al-Hail was unable to investigate the MPs' parliamentary arrest warrants, and since this immunity has been lifted, the judiciary can arrest the suspects immediately."

"This is the first day of the end of the third parliamentary session. It is very normal for anyone, whether parliamentarian or not. Even if he has immunity. "

He pointed out that "procrastination of the case of its effectiveness is depending on the type of case and the magnitude of the charges documented."

"Issues relating to the public prosecution are motivated by public prosecution, but if they are an invitation on the other hand as institutions, individuals or companies, the judiciary should be reviewed to be implemented by those bodies," a friend concluded.

Iraq enters the first legislative vacuum after 2003 .. and Jubouri comment
[Oan- Baghdad]
entered Iraq on the first Sunday of July in a legislative vacuum for the first time since the fall of the ousted regime in 2003, with the end of the third session of the Parliament waiting for a manual sorting of the votes of the legislative elections held on 12 May.
The deputy speaker of the former House of Representatives Aram Sheikh Mohammed at the end of a deliberative session attended by 127 deputies out of 328, "the end of the third session of the House of Representatives."
The session was chaired by former Speaker of the House of Representatives Hammam Hamoudi, in the absence of his former president Salim al-Jubouri.
"During four difficult and challenging years, the parliament has achieved dozens of historical laws, and has established a solid tradition that has managed to polarize the blocs and through an encouraging stage to the liberated bank of Iraq," Jubouri said in a tweet on Twitter late Saturday night. For 328 deputies were heroes in the test of ordeal. "
According to several sources, the deputies sought in the meeting yesterday to achieve a quorum to vote on a bill extending the mandate of the current parliament, but a copy of the draft, indicating that the amendment was dedicated to counting and manual hand counting of the votes of the legislative elections only.
The Electoral Commission announced last week that the recount in the legislative elections held in Iraq on 12 May last will be partial in the areas where complaints were filed inside and outside the country.
Laith Hamza, spokesman for the 9-member commission appointed by the Supreme Judicial Council instead of former members of the Commission on the grounds of suspicions of fraud, announced that "the process of manual counting and sorting will begin on Tuesday" corresponding to the third of July.
The process will be conducted in the presence of the members of the Independent High Electoral Commission and within the electoral office of the governorates of Kirkuk, Sulaymaniyah, Erbil, Dohuk, Nineveh, Salaheddin and Anbar respectively, and for the rest of the provinces will be followed and according to the dates determined by the Commission.
With regard to the funds that were transferred to Baghdad, will be counting and sorting in Baghdad, according to Hamza.
At the conclusion of the parliamentary session yesterday, the deputies gathered from different blocs to take pictures of the memorial and Silvie, and exchanged some greetings and hug in a friendly step.
He considered the legal expert Haider Sufi that the decision will not lead to "a big change, may change in three to four seats within each block, but remains that the blocks that have forty to fifty seats can not form a government alone without forming an alliance."
After each legislative election, the winning blocs are locked in long negotiations to form a majority government.

War: The Constitution defined two cases of the caretaker government

The legal expert Tariq Harb, on Sunday 1 July 2018, called on the Electoral Commission to use the staff of the Ministries of Education and Higher Education in the process of counting the votes manually to resolve the currency quickly, while stressing that the government continues as a government full powers and the integrity of the authorities and competencies because the Constitution identified two cases (61) and (64) to withdraw the confidence and dissolve parliament only.

Corrupt deputies rush to escape after the expiration of powers of immunity

BAGHDAD (Reuters) - The escape of deputies accused of "terrorism and corruption" came ahead of the lifting of their immunity by hours by July 1, 2018, a member of the coalition of state law Mohamed al-Chihod said on Sunday (July 1, 2018).

"A number of MPs accused of corruption and terrorism fled before the parliamentary immunity was lifted in a few hours," Chihud told media outlets.

"The Iraqi judiciary is supposed to address the government on preventing the travel of deputies accused of corruption and terrorism and those who have legal proceedings until they prove their innocence," he said.

He stressed that "the judiciary should take its role in achieving the right and punish those involved in corruption and terrorism, and prevent their escape outside Iraq."

"The Iraqi constitution set conditions and controls to lift the immunity of the members of the House of Representatives," said the former MP in the Iraqi parliament, noting that "the MP if he is accused of a felony waives immunity without discussion."

The immunity known in all international constitutions is the constitutional protection granted by the Constitution to the People's Deputy in Parliament so that it can perform its full constitutional function (as a legislative authority) away from the influence of the executive power on members of Parliament by means of intimidation or intimidation, as defined by the Wikipedia.

Iraqis are clearly aware of how this right to immunity has been exploited by MPs to bypass laws and regulations.

Iraqi parliamentarians rally after parliament ends

Pre - empted the Iraqi parliamentarians declare an end to the age of parliament formally, and left out of the country, fearing corrupted files may follow them after the lifting of their immunity, while officials confirmed the absence of a real intention to hold corrupt in the country.

An official at the Baghdad International Airport for the "new Arab", "Last week saw the travel of about 45 deputies from different blocs, and paid only tickets without return," noting that "the deputies traveled to different countries, including Iran, Turkey, Egypt and other countries "He said.

He pointed out that "some of the traveling MPs were their families accompanied by them, and others their families mainly outside the country for some time," noting that "there is no prohibition against any of the traveling MPs."

Parliament gave immunity to its deputies over four years, representing the age of the parliamentary session in the country, while immunity expires upon the expiration of the parliament.

For his part, the MP for the State of Law, Mohamed Chihod, in a press statement, the existence of "20 deputies involved in files of corruption and terrorism during the parliamentary session ended," noting that "the files of these deputies will be referred to the judiciary, if the legal cover and immunity from them."

He pointed out that "political niceties and understandings prevented the accountability of these deputies involved in those files, which caused the loss of the public right of the state and the citizen," calling on the government to "hold them accountable according to the law."

Politicians confirm that the government is not serious about holding these MPs accountable, even if they had the intention to hold them accountable, to prevent them from traveling.

The leader of the decision coalition, Emad al-Qaisi, told the "new Arab" that "the government and the responsible authorities opened the door to these deputies to escape, and were supposed to be prevented from traveling until each of them provide a patent from government agencies, including the judiciary," noting that " This scene repeated over all previous parliamentary sessions, did not prevent any government MPs to travel, and did not ask them to resolve their files.

"This shows that the papers are mixed in the country, that corruption will not leave the country, and that the new deputies and officials will also be protected from legal accountability."

It is noteworthy that the presidency of the Iraqi parliament, had announced, on Saturday, the end of the life of parliament during its current session, and formally dissolved, according to the Iraqi constitution.

Iraq has no parliament in the custody of a government with broad powers

Could justify a military coup or the formation of an emergency government ...

 01/07/2018 - 15:46

Iraq has no parliament in the custody of a government with broad powers

Iraq entered the legislative vacuum on Sunday, the day after the end of the parliament's day yesterday, and became in the hands of the government, which now enjoys broad political powers.
Iraq had passed such tests during the previous two governments in 2010, where the government remained without a parliamentary cover for about 8 months until the formation of the government of Nuri al-Maliki II, and in 2014 the government remained for about three months until the formation of the current Haider Abadi government.
According to legal expert Tariq Harb, «the current government will continue to exercise its full powers and in all fields, areas and authorities». "The process of legislation and oversight is related to the next parliament," Harb said.
Many had published excerpts and calls and called for demonstrations to counter what they considered a constitutional vacuum that could justify a military coup or the formation of an emergency government. But the Ministry of the Interior announced its rejection of any demonstration without taking the fundamental approvals from the official authorities.

The Iraqi parliament will pass a number of important laws for the next session (the NEW parliament)

The Iraqi parliament is passing important laws for the next session July 1, 2018

A member of the Finance Committee of the former parliament Massoud Haider said on Sunday that a number of important laws within the Finance Committee have been deported to the next session of the House of Representatives.

The Iraqi parliament has ended its third session after the failure of attempts by deputies and deputies to extend the legislative life until the ratification of the Federal Court on the results of the elections of the House of Representatives, which took place on May 12, 2018

Haider told the news that the most important of these laws is "the Financial Management and Public Debt Law A very important law for the Iraqi state and the Social Security Act to activate the rights of the private sector and the law of the Federation Council and the Civil Service Law.

"At the level of the House of Representatives it is necessary to mention the law of oil and gas."

"The electoral law must be amended and the Commission must change the electoral system in Iraq in general because the current system is not consistent with the nature of Iraqi society."
