A parliamentary surprise: Budget has become constitutional for this reason

BAGHDAD - The parliamentary legal committee confirmed on Monday that President Fuad Masum exceeded the legal limit of 15 days to approve the budget lawafter sending it to the Presidency of the Republic, noting that the budget has become constitutional according to the law .

The Committee member Sadik al-Laban said in a press statement that "infallible exceeded the period of time stipulated by the Constitution in accordance with Article 73 paragraph 3, which sets it by 15 days to ratify the federal budget," noting that "the Federal Budget Law has been ratified by law and the government directly to implement its terms And published in the Official Gazette .

Al-Labban added that "the points of opposition identified by the infallible in the budget will be the responsibility of the Presidency of the parliament in its discussion or neglect," explaining that "Parliament has been close to the legislative term and I expect that will not discuss those points of contention ."

He added that "the 31 points of disagreement came before infallible and not from the Presidency of the Republic," pointing out that "the constitutional text did not refer to the possibility of rejecting the budget by the infallible ."

The President of the Republic Fouad Masum refused to approve the financial budget for the current year 2018, after it was approved by parliament.

The presidential press office announced that President Fuad Masoum decided to return the draft budget law to the House of Representatives.

For his part, Prime Minister Haider al-Abadi said that no one has the right to stop the general budget of the country after the vote of the House of Representatives.

"We hope that we will receive a copy of the budget from the presidency to be in force," Abadi said, according to his press office.

Parliament points to a lack of an infallible return to the budget: the winds will go on

A member of the parliamentary legal committee Zana Said said on Sunday that the reservations of President Fuad Masum on the budget of 2018 will go to include the wind if not submitted to the Federal Court.

And ratified the Iraqi parliament on a budget worth 88.5 billion dollars for the year 2018, despite boycotting Kurdish parliamentarians to vote in protest against the reduction of financial allocations for the Kurdistan Region of Iraq. 

The budget was based on oil exports expected to reach 3.9 million barrels per day, producing Kurdistan Region 250 thousand barrels per day of them. The budget set the reference price of the barrel at $ 46. 

The Iraqi budget plan expected revenue to reach 77.5 billion dollars, while the projected deficit was estimated at 10.6 billion dollars with 20.8 billion dollars allocated for investments.

It was supposed to pass the Iraqi budget before the beginning of 2018, but several key points of disagreement between the central government on the one hand and Sunni Arabs, and Arab Shiites and Kurds on the other prevented the draft budget on time.

Pure speculations and conjecture here but a potential explanation of the passage of the budget and the token resistance by the Iraqi President is the Kurdish allocation of 12.67% is actually 17% AND the revalue rate of 1 IQD = 2.6 USD simultaneously occurs if the 2.6 is taken out of the middle of 12.67%???!!!

12.67%...what is it? Obvious. It's PM Abadi signalling the Kurds: get in line, make deals, come to agreements, pass oil laws, or we will not give you money, and you will suffer. And in the end, it will work. Why? Kurds have no choice. And right now Abadi took control of the roads and airports and oil wells, and the Peshmerga....so he is in control, and his control gets stronger every day. Kurds have no allies. Kurds have no way to get their oil out. The are a land locked country. The Turks hate them. The Iranians hate them. Turmp does not support them. So the Kurds are painted in a corner. And if Nuri Maliki gets back into power, he will screw the Kurds over so badly, they will regret it for 1,000 years. The time for playing stupid games is over. The Kurds will sign, will support the government, will come to agreements, or they will be punished forever, starting with only being given 12% of the budget, instead of the 17% they deserve, but will not get, if they continue to act like idiots.

The representative of the State of Law Ali Al-Aliq, Thursday, that the deductions of salaries of employees are valid during the current month, while explained that the continuation of the work because of the budget of 2017.

"The salaries of employees continued during the current month as a result of the work of the budget of 2017," he said, adding that "deductions will be canceled in the coming days after the issuance of guidance by the government to implement the budget 2018."

He added that "the reason for the continued deduction of salaries came as a result of delaying the adoption of the federal budget law for 2018," explaining that "the budget has become a constitutional and will be implemented in the coming days."

On Saturday, March 3, 2018, the House of Representatives voted to abolish deductions from the salaries of state employees in the draft budget bill for 2018.

Speaker of the House of Representatives Salim al-Jubouri called on members of parliament to attend next Tuesday's session to complete the legislation and the important laws prepared for the vote at a time when the parliamentary legal committee called on the government to work in the federal budget as being "in force" after its ratification by the House of Representatives, While the Committee requested the Presidency of the Council of Representatives to send a letter to the Ministry of Justice to publish the budget in the newspaper "facts" official. 

"The House of Representatives is continuing to perform its duty and assume its responsibilities stipulated by the Constitution and the law until the end of its session," Jubouri said, adding that "there are many important laws to be voted and it is necessary to invest the remainder of the current session With a view to their adoption and not to be deferred to the next session. "

The parliamentary information service said in a statement on Saturday: "The House of Representatives will hold next Tuesday its regular session," adding that the session will include the completion of voting on the laws contained in the agenda. 

On the other hand, said a member of the parliamentary legal committee Hamdiya Husseini said in a press statement: "The presidency of the Republic is obliged to ratify the budget within 15 days from the date of receipt of the House of Representatives," noting that "the 15-day period ended and the budget today is valid." 

Husseini pointed out that "the work of the budget law in the current form does not carry any legal side," asserting "the futility of the House of Representatives to vote again on the budget," adding that "the central government from the legal point of now to implement the budget items and work, The constitutionality of the infallible ratification is over. "

Tuesday will be a vote on important laws, like HCL n among others. Also, I anticipate the lower denoms to be distributed to all iraqi citizens (kurdish included) this upcoming week. RV happily thereafter. The rate will show up again in all exchanges...only this time will be the starting rate, March 29-April 3 2018. Exciting week ahead of us. Hope this is it folks!

Tuesdays have been a banner day for the IQD at the exchanges this past month! And now Jabouri has bumped up the final Parliamentary session to this coming Tuesday.... coincidence? Man oh Man oh Man, I HOPE SO !!!!!
