okay so they say that they will abide by the constitution...here are a couple things from the constitution...

 

Second: The responsibility placed upon the executive branch of the Iraqi Transitional Government stipulated in Article 58 of the Transitional Administrative Law shall extend and continue to the executive authority elected in accordance with this constitution, provided that it completes (normalization and census and concludes with a referendum in Kirkuk and other disputed territories to determine the will of their citizens), in a period not to exceed (the 31st of December 2007).

Article 137: Legislation enacted in the region of Kurdistan since 1992 shall remain in force, and decisions issued by the government of the region of Kurdistan - including court decisions and agreements - shall be considered valid unless it is amended or annulled pursuant to the laws of the region of Kurdistan by the competent entity in the region, provided that they do not contradict with the constitution.

 

Kurdistan is a semi-autonomous region in the constitution that has control of its borders, has its own constitution, laws, etc. There are many items that have not been implemented according to the constitution, and if abadi says their agreements will be done according to the constitution then they better address article 140 which is the disputed territories and that means to hold a referendum in those areas and the people get to decide where they belong. Then you have the regions and governants that are to receive an equitable share of the oil and they also get a portion of the grants, loans, etc from the imf, world bank, or from any country that wants to provide a loan to iraq. Everything that baghdad gets is to be divided among the regions and provinces. They havent been doing that. They havent established the federation council which are made up of reps from the regions and provinces and is the upper legislative branch of the government. They also do not have the right to take out a governor of a province without the consent or vote of the provincial government. 

 

That is why kurdistan said that iraq has violated over 50 articles of the constitution. There are many many laws that are suppose to be passed that have to do with finishing the constitution and that has not been completed yet either. If abadi wants to make some real headway then he needs to bring tremendous pressure to the parliament for the fulfillment of the laws that will finish the constitution and also the decentralization to the provinces and give them their full rights. 

 

Im sure i will get negged on this post as that seems to be the norm as of late, but i also want some to understand that although abadi is a good leader their are laws that are being broken and laws that are not being fulfilled. 

 

And to say that the peshmerga couldnt defend their borders against isis and had to resort to the u.s. and iran is really not the whole truth. Barzani went to the u.s. because baghdad would not supply them with the weapons they needed to fight with. The kurds freed the yazidi's on mount sinjar all by themselves and they are the ones who freed the disputed areas and held those areas to keep isis from being able to return. Doesnt anyone remember all the articles where the kurds were hollering for military help from baghdad and they never got it. Finally baghdad says okay but everything you give them has to come through baghdad. Well that became a debacle so the u.s. began supplying the kurds directly because baghdad was not giving them what the u.s. was sending. To say that the kurds were not one of the most instrumental parts of getting rid of isis is really just crap i guess in my opinion. When they started this campaign against isis the u.s. would only trust the kurds to call in air strikes because the iraqi forces were using the air strikes to hit kurd positions and the militias in with the iraqi army were committing atrocities against the sunni's. We cant all forget that. Abadi has been working with the kurds for over 3 years and it was the kurds vote that pushed abadi over the threshold to get him to being the prime minister and he so easily forgets that. Now all of sudden the kurds are bad, they are corrupt, they do this and that , but yet abadi lets maliki and his gang of thugs run free in that country and they put maliki as a vice president? Soleimani has been all over iraq and we have seen the pictures to prove it. Abadi is going against a un sanction in allowing this guy to step one foot on iraqi soil. The u.s. has once again bled and died in that country and he seems to forget that too. I guess i would like to just see a little more appreciation from iraq in regards to what the coalition forces have done for them along with the kurds. Now all of a sudden we have news articles saying how the citizens will be so happy because abadi is taking control of the whole country, but yet they all just voted to become independent. Sounds crazy to me. I hope for all of our sakes that abadi can push iraq to its final destination and heed the advice from his arab partners along with the u.s., and also abide by the sanctions being placed on iran and to quit making deals that only enriches the iranians at the expense the iraqi's. jmo.....

So it would appear that 140 is now a non-issue......basically Abadi has also kicked HCL thur the uprights.....so lets see what happens next.

Kurdistan is a semi-autonomous region in the constitution that has control of its borders, has its own constitution, laws, etc. There are many items that have not been implemented according to the constitution, and if abadi says their agreements will be done according to the constitution then they better address article 140 which is the disputed territories and that means to hold a referendum in those areas and the people get to decide where they belong. Then you have the regions and governants that are to receive an equitable share of the oil and they also get a portion of the grants, loans, etc from the imf, world bank, or from any country that wants to provide a loan to iraq. Everything that baghdad gets is to be divided among the regions and provinces. They havent been doing that. They havent established the federation council which are made up of reps from the regions and provinces and is the upper legislative branch of the government. They also do not have the right to take out a governor of a province without the consent or vote of the provincial government. 

 

That is why kurdistan said that iraq has violated over 50 articles of the constitution. There are many many laws that are suppose to be passed that have to do with finishing the constitution and that has not been completed yet either. If abadi wants to make some real headway then he needs to bring tremendous pressure to the parliament for the fulfillment of the laws that will finish the constitution and also the decentralization to the provinces and give them their full rights. 

 

Im sure i will get negged on this post as that seems to be the norm as of late, but i also want some to understand that although abadi is a good leader their are laws that are being broken and laws that are not being fulfilled. 

 

And to say that the peshmerga couldnt defend their borders against isis and had to resort to the u.s. and iran is really not the whole truth. Barzani went to the u.s. because baghdad would not supply them with the weapons they needed to fight with. The kurds freed the yazidi's on mount sinjar all by themselves and they are the ones who freed the disputed areas and held those areas to keep isis from being able to return. Doesnt anyone remember all the articles where the kurds were hollering for military help from baghdad and they never got it. Finally baghdad says okay but everything you give them has to come through baghdad. Well that became a debacle so the u.s. began supplying the kurds directly because baghdad was not giving them what the u.s. was sending. To say that the kurds were not one of the most instrumental parts of getting rid of isis is really just crap i guess in my opinion. When they started this campaign against isis the u.s. would only trust the kurds to call in air strikes because the iraqi forces were using the air strikes to hit kurd positions and the militias in with the iraqi army were committing atrocities against the sunni's. We cant all forget that. Abadi has been working with the kurds for over 3 years and it was the kurds vote that pushed abadi over the threshold to get him to being the prime minister and he so easily forgets that. Now all of sudden the kurds are bad, they are corrupt, they do this and that , but yet abadi lets maliki and his gang of thugs run free in that country and they put maliki as a vice president? Soleimani has been all over iraq and we have seen the pictures to prove it. Abadi is going against a un sanction in allowing this guy to step one foot on iraqi soil. The u.s. has once again bled and died in that country and he seems to forget that too. I guess i would like to just see a little more appreciation from iraq in regards to what the coalition forces have done for them along with the kurds. Now all of a sudden we have news articles saying how the citizens will be so happy because abadi is taking control of the whole country, but yet they all just voted to become independent. Sounds crazy to me. I hope for all of our sakes that abadi can push iraq to its final destination and heed the advice from his arab partners along with the u.s., and also abide by the sanctions being placed on iran and to quit making deals that only enriches the iranians at the expense the iraqi's. jmo.....

I think a lot of Abadi's hesitation to do to much for the Kurds was Barzani's ability to drive the Kurds to straight into bankruptcy. It would be hard for the Prime Minister to go along with anything Barzani was asking for knowing good and well how much Barzani was pulling off the top of the Kurds income, and to what extent Barzani was breaking laws, making deals, and stealing oil from Iraq, as well as money from his own constituents. Not to mention that when his term was up 2 years ago he choose to stay in as long as he wanted and further dismantled the Kurdish Parliament to make it so! In essence there was indeed no Kurdish government for Abadi to even work with. He was working with the King of Kurdistan. The Barzani family made all of the decisions. What Kurdish Constitution are you referring to. The same one Barzani himself disreguarded??? Then there was the issue of drawing up a new map of the Middle East to satisfy Barzani's dreams of a Kurdish State, apparently to include the Syrian and Turkish Kurds also? I'm sure Turkey's concerns were not imagined...  There was so many things in play in that huge mess in the disputed areas that someone had to do something beside step aside for the King of Kurdistan to do as he pleased...  imho

That's why we need

 

1. Mr. Donald Trump a.k.a The President of the United States send back all person who created Iraq Constitution back to Iraq and make conference to 'school' back all Iraqi politician about Iraq Constitution.

 

2. All law related with Iraq wealth including Hydrocarbon Law and Oil National Company Law must be presented at House Of Representative, vote, pass and implement as soon as possible (as soon as tomorrow, sound joke right) to prevent all catastrophe incident like today happened again. United Nation must enforce this mandatory to Iraq Government before end of 2017.

 

3. Reinstate back Iraq Dinar as soon as possible to give back wealth to Iraq citizen. Nobody complaining if they get their wealth back. They already suffer enough for 40-years of war and mismanagement. Let's end this before end of this year, Mr. Haider Abadi a.k.a Iraq Prime Minister.

 

4. Then, start back reconstruction of Iraq into state of the art country.

 

Of course, all of this can be done if Iran don't interrupt Iraq to move on. After that complete, if Iran want to have bilateral trade due to economic sanction not affected border trade, just move on.

 

If we see back, Iran is currently at level of poor country due to economic sanction and mismanagement. Why Iraq want to rely to such country? That's no need for that. Iran suppose to rely to Iraq, not the other way.

Turkish Prime Minister Ibrahim Kalan said Wednesday that the Turkish government is not prepared to impose a blockade on the Kurdistan region, adding that the border crossings will be controlled and managed by the Iraqi government.

"The Iraqi government must protect the lives of the Turkmen and rebuild the district of Tal Afar and the city of Mosul and return the Turkmen families to their areas," Kalin told reporters.

On the border crossings between Iraq and Turkey, Calin said that "the Iraqi government controls all border crossings between Iraq and Turkey."

On the relations between the Kurdistan region and Baghdad, a spokesman for the Turkish presidency told reporters that "Turkish President Recep Tayyip Erdogan will meet in a timely manner with the President of the Kurdistan Regional Government, Najirvan Barzani and hold an important meeting with him."

The Kurdistan Regional Parliament announced on Wednesday the entry of a decision to withdraw the President of the region Massoud Barzani to take effect.

MP Bari Mustafa said in a statement to "Mawazin News," that "from today the position of the President of the Kurdistan region is vacant, and powers divided on the three presidencies of legislative, executive and judicial within the region."

Mustafa added that "all sections and departments and the body of advisers attached to the presidency of the region have been canceled, until elections are held after 8 months."

She pointed out that "the blocks of change and the Islamic Group and the deputies of the National Union are considering the idea of abolishing the presidency of the region is final, and be dealing in the fateful decisions of the Parliament of Kurdistan."

In a letter to Barzani sent to Parliament on Sunday, October 29, he said: As for the post of President of the Territory after 1/11 I refuse to continue in this post, and may not amend the law of the presidency of the Territory and there is no extension of the presidency of the Territory.

Iraqi Prime Minister Haidar al-Abadi has set the date for the start of dialogues with Iraqi Kurdistan.

By گzarc Bolton News , Ebadi said the dialogues will begin after the stability of the situation in the disputed areas, border control and ports and cancel the referendum final.

This came at a time when he stressed that Zuf Bushra was freeing all Iraqi lands from the hands of the Wahhabi group. He said at his weekly conference on Tuesday evening: "The focus is now on settling the situation in the disputed areas, controlling the borders and then starting political and official dialogues. Between Baghdad and Erbil, according to the conditions that have been put recently, including the cancellation of the referendum in a final, not postponement or freezing, and be dialogues according to the Constitution and one Iraq.

Abadi added that "the Constitution is clear and provides for the maintenance of the border by the federal authority exclusively, and yet there are understandings on the deployment of joint detachments in some areas where our citizens are Kurds to increase confidence."

Abadi warned of "the presence of media in Kurdistan incited and incite the killing of federal forces," stressing that "the preservation of the lives of all Iraqis without exception, and we directed the forces not to collide and reduce as much as possible."

US congressmen launch campaign to support Kurdistan region
 

A number of members of the US Congress on Wednesday launched a campaign to support the Kurdistan region against attacks by factions of the Iranian-backed popular militia and Iraqi forces.

Ron Disentis, Trent Franks, former US President Trump's foreign affairs adviser Sabastian Gorka, as well as a number of politicians and military personnel.

According to the correspondent of Kurdistan TV 24 "will participate in the campaign today a press conference."

The campaign aims to pressure US President Trump to support the Kurdistan region and protect it against attacks by factions of the militia backed by Iran, and participants will demand increased support of the Peshmerga forces to be able to protect all components of the Kurdistan region.

Relations between Erbil and Baghdad have deteriorated recently after Kurdistan held a referendum on independence last month, which Baghdad called "unconstitutional" and resorted to holding current alliances with Iran and Turkey to besiege and pressure Kurdistan.

Baghdad imposed collective punishment on the territory of Kurdistan and used military force and took over a lot of Kurdish areas outside the administration of the region, which was under the control of the Peshmerga, especially Kirkuk.

Popular militias have taken control of Kirkuk and its environs since the middle of this month and the city is witnessing an unprecedented security breach when the city was under the control of the Peshmerga.

Tens of thousands of Kurds have fled the city since the Popular Popular militia and its allies took control of the city and its environs, while scores of violations by Kurdish militants against Kurdish civilians and others have been reported in those areas.

Talabani, the son of Jalal Talabani, Lahore and Aras Sheikh Janki, the nephew of Talabani, a PUK official, held a secret agreement with the Popular Popular Army and the Iranian Revolutionary Guards. They withdrew large forces from their wing inside the Kurdistan National Army from contact lines with Iraqi militia and Iraqi security forces The other in Kirkuk on the 16th of this month without a fight that allowed the advance of these hostile forces towards Kirkuk and take over after the collapse of the Peshmerga defenses as a result of this treason.

Former Kurdistan Region President Massoud Barzani on Wednesday issued a statement on the killing of journalist Arqan Sharif in the province of Kirkuk, saying it 'a model of the Chauvinist curriculum'. 

Barzani said that "on the night of 29/30 of October 2017, the journalist and photographer in Kurdistan TV Arkan Sharif in the district of Daquq, which is under the control of the gunmen of the popular crowd, was brutally murdered inside his house by a group of armed masked. 

He added that 'the assassination of the journalist Arkan Sharif is a very clear example of the Chauvinist approach, which imposed itself by force of arms and wrongly on the Kurdish areas outside the administration of the region,' he said. 

"Barzani said that 'the responsibility for the assassination of the pillars of Sharif and the torture of the citizens of this region rests with the forces that imposed themselves on the region contrary to the law and the Constitution'.

Iraqi Kurdish President Masoud Barzani departed office on Wednesday, leaving his nephew Nechirvan Barzani to reconcile with the central government in Baghdad, with regional neighbors and with rival Kurdish parties after the recent referendum on independence, according to Reuters.

Nechirvan Barzani, who has served alongside his uncle as prime minister, will now be the main authority figure in the executive of the Kurdish autonomous region, following Masoud Barzani’s departure as president, Kurdish officials said.

“The prime minister will be the key person during this transitional period,” said Hoshyar Zebari, a former Iraqi foreign minister, now advisor to the Kurdish government and senior member of the ruling Kurdistan Democratic Party (KDP).

The elder Barzani, a 71-year-old veteran guerrilla leader, had run the Kurdish autonomous region with a firm hand since 2005, during which it prospered while the rest of Iraq was mired in civil war.

But he announced his resignation on Sunday, effective on Nov. 1, after a Sept. 25 referendum on independence backfired, prompting the central government to send troops to recapture territory held by the Kurds in Kirkuk.

The referendum and government backlash have also revealed deep divisions among the Kurds themselves. During his resignation speech, Masoud Barzani accused several political figure of “high treason” for yielding territory without a fight.

His nephew Nechirvan, 51, who has served as prime minister for all but three years since 2006, is seen in Kurdish politics as a less polarising figure, having warmer relations than his uncle with rival Kurdish parties.

Good relationship with Erdogan

He also has a close working relationship with Turkey’s President Tayyip Erdogan, who has backed Baghdad in the central government’s dispute with the Kurds since the referendum.

The Kurdish regional parliament voted on Sunday to divide the president’s powers among parliament, the judiciary and the cabinet, until parliamentary and presidential elections are next held. The elections were originally scheduled for Nov. 1 but postponed last month until next year.

Before the referendum, Barzani’s son Masrour was seen as his likely successor, but he has been damaged by his backing of the secession vote, which soured relationships with Baghdad and regional powers who opposed it.

On Monday, the United States commended Masoud Barzani for stepping down and said it would actively engage with Nechirvan Barzani and his deputy, Qubad Talabani, a member of the rival political faction with whom he maintains a good relationship.

UK Foreign Secretary Boris Johnson also spoke with Nechirvan Barzani on Monday to encourage dialogue with Baghdad. He also met with met with the French and Germany ambassadors to Iraq, Bruno Aubert and Cyrill Nunn, on Tuesday.

As prime minister, Nechirvan Barzani has been central to brokering the semi-autonomous region’s oil dealings, now in jeopardy following Iraq’s recapture of disputed territories on Oct. 16, including the oil-rich city of Kirkuk.

Despite no longer being president, Masoud Barzani will not be retreating from public life, government officials said.

In his televised address on Sunday announcing the end of his presidency, Barzani said that he would remain a Peshmerga, or Kurdish fighter, and will continue to battle for his people’s lifelong dream of independence. He will also remain head of the ruling party and will still sit on the High Political Council, a non-governmental body which emerged after the referendum.

ERBIL — Chancellor of the Kurdistan Region Security Council (KRSC) Masrour Barzani stated on Wednesday that Iraq’s measures taken against Kurdistan Region are political and unconstitutional.

Barzani received on Wednesday the British Ambassador to Iraq Frank Baker and his accompanying delegation.

The British diplomat said that his country is willing to further strengthen its relations with the Kurdistan Region. He hoped that the military conflicts between Erbil and Baghdad come to an end and both sides engage in dialogue to settle the pending issues under the Iraqi constitution.

Barzani stated that Baghdad has been using the military to suppress the legitimate aspirations of Kurds for a century, arguing that all the military efforts were futile.

Baghdad should consider peaceful solutions and dialogue rather than imposing itself with military force, Barzani said.

Barzani also pointed out that the measures taken by Baghdad against Kurdistan are politically motivated and clear violations of the constitution.

“If Iraq’s constitution is supposed to be implemented, then it has to be implemented in its entirety,” he said.

The Chancellor Barzani hoped that the military negotiations between Erbil and Baghdad would soon be shifted to political and administrative talks and the tensions come to an end.
