The House of Representatives votes on two bills and ends the reading of four bills

At the beginning of the session, President al-Jubouri referred to the decision of the Federal Court as a result of the referendum on September 25 last nullifying the impact and baseless, noting that the House of Representatives strengthens the Masdar of the Federal Court and commends the parliamentary committee responsible for follow-up members of the Council participating in the referendum and its report To the Presidency of the Council, calling for the attendance of all members of the House of Representatives to the meetings that the judiciary to follow up what is assigned to it in accordance with the report of the parliamentary committee, which is based on some of the procedures in which the violations of legal and constitutional. 
The Council voted to postpone the inclusion of a parliamentary request submitted by 150 deputies, including the dissolution of Kirkuk Governorate Council on the agenda of the session.
President al-Jubouri stressed the need to preserve the lives of citizens and protect the peace and communal coexistence in the province of Kirkuk away from escalation. 
For his part, Mr. Eaaram Sheikh Mohammed, Deputy Speaker of the House of Representatives on the existence of previous requests from the deputies related to several decisions, including the cancellation of decisions of the dissolved Revolutionary Command Council of Kirkuk within the current escalation situation, but the opinion of the presidency of the Council focuses on preventing escalation between components, With components in the Kirkuk Provincial Council and are in the process of solving problems in the Council, proposing to give members of the Kirkuk Provincial Council an opportunity to solve problems away from escalation. 
The Presidency decided to postpone the completion of the vote on the draft law on the provincial and district elections and submitted by the two legal committees, regions and governorates not organized in the province to the next session, provided that the differences are agreed on the Kirkuk provincial elections.
The Presidency of the Council postponed the vote on Judge Mowaffaq Mahmoud al-Obeidi as head of the Public Prosecution and Judge Jassim Mohammed al-Amiri as head of judicial supervision based on a letter from the Supreme Judicial Council, which was voted on the agenda of the session.
The Council voted on the draft law on the accession of the Republic of Iraq to the Convention on International Interests in Mobile Equipment and its Protocol on matters relating to aircraft equipment and declarations supplementing its accession to the Republic of Iraq submitted by the Committees on Foreign Relations, Services and Reconstruction with a view to overcoming the problems of obtaining funding for civilian aircraft and equipment Transfer of property rights, leasing and secured asset financing, establishment of an international registration system for the protection of international guarantees on mobile equipment and enhancement of the independence of Raf involved in related processes for the purpose of accession to the Convention.
The Council completed the vote on the draft law of accession of the Republic of Iraq to the Convention on Freedom of Association and Protection of Trade Union Organization No. 87 of 1948. (Committee on Foreign Relations, Committee of Civil Society Organizations, Labor and Social Affairs Committee). With a view to promoting freedom of association as a means of improving conditions for the establishment of peace and the right to establish, join and protect trade unions and the right to join international workers 'and employers' organizations and for the purpose of acceding to the Convention. 
The Presidency postponed the vote on a resolution on the compensation of the families of the victims, the injured and the owners of the houses and structures affected by the earthquake of November 12, 2017.

The Presidency decided to postpone the first reading of the proposed law of the Iraqi National Olympic Committee, submitted by the Youth and Sports Committee, that a final meeting with the Olympic Committee for the purpose of reaching a final version of the proposed law. 
The Council completed the first reading of the proposed law of the House of Representatives and its formations submitted by the legal and financial committees in order to clarify the constitutional and legal status of the President and members of the House of Representatives as required by the Constitution and to indicate some aspects of the relationship between him and other authorities and the establishment of the General Secretariat and its composition.
Al-Majas ended the reading of a report and discussion of the proposed law on the protection of teachers and teachers submitted by the legal and education committees. 
In the interventions of Ladies and Gentlemen MPs MP Riyad Gharib emphasized the importance of protecting the teacher and providing the appropriate environment in terms of economic and security in order to build a conscious generation and promote the educational and educational reality.

MP Hassan Salem considered the law proposal as very important in providing protection to teachers for their role in building generations, calling for forming a union for educational supervisors and protecting them. 
MP Mutashar al-Samarrai called for tackling the bad phenomena, including the promotion of fraud in exams, which requires tightening of the sanctions, calling for working to protect the teacher and teacher and provide the requirements for a decent life.
In response to the interventions, the committee stressed the importance of taking into account the interventions of the ladies and gentlemen of the deputies for the purpose of maturing the proposed law pointing out that the penalties in line with the Penal Code will be amended to penalties up to 5 years and less than a year for anyone who attacks the teacher or teacher, General.

Law amending the law of elections of the Iraqi Council of Representatives No. (45) for the year 2013

2017/11/20 In the name of the people Presidency On the basis of what was approved by the House of Representatives and ratified by the President of the Republic based on the provisions of item (I) of Article (61) and Article (III) of Article (73) of the Constitution The following law was issued: No. (2017) The first reading of the law to amend the law of elections of the Iraqi Council of Representatives No. (45) for the year 2013 Chapter One Definitions, objectives and flow Article (1) For the purposes of this Law, the following expressions shall have the meanings hereby set forth. Council: Iraqi Council of Representatives. Commission: Independent High Electoral Commission.
 
Voter: An Iraqi who meets the legal and eligibility requirements for voting in elections. Exiled Voter: The Iraqi who was forcibly evicted from a permanent residence to another place inside Iraq after 9/4/2003 for any reason whatsoever.
 
Primary voter register: The register containing the names and data of the voters, which are prepared and published by the Commission to view and submit appeals Final voter register: A record of irrevocable voter names and statements published after the end of the objection period.
 
Candidate: is every Iraqi has been officially accepted by the Electoral Commission for elections to the membership of the Iraqi Council of Representatives.
 
Single List: The list for which one individual is entitled to run for election and to be registered with the Commission.
 
Open List: The list containing the names of the candidates declared. The electoral district: Each specific area has been allocated a number of seats in accordance with the provisions of this law.
 
Election Center: The place designated by the Commission within the electoral district to conduct the voting process.
 
Article (2) This law aims to:
1 - Participation of voters in the selection of their representatives in the Iraqi Council of Representatives.
 
II. Equality in electoral participation.
 
Third: Ensuring the rights of voters and candidates in electoral participation.
 
Fourth: Ensure the fairness, freedom and impartiality of the elections.
 
Fifth: Providing legal protection for the stages and procedures of the electoral process.
 
Article (3) This law applies to the elections of the Iraqi Council of Representatives.
Chapter II ( Voting right )
 
Article (4) I. Election Every Iraqi who has met the conditions provided for in this Law shall be entitled to exercise this right without distinction as to race, race, nationality, origin, color, religion, creed, belief, opinion, economic or social status. Each voter shall exercise his right to vote for free, direct, secret and individual elections.
 
Article (5) The voter must be:
First: Iraqi nationality.
II. Full eligibility.
Third - At the age of eighteen years in the year in which the elections are held.
Fourthly, he shall be registered in the register of voters in accordance with the provisions of this law and the regulations and procedures issued by the Commission.
 
Article (6) Voting takes place in one day throughout the Republic of Iraq.
 
Article (7) First: Elections of the House of Representatives must be held 45 days before the end of the previous electoral cycle at least. The elections of the Iraqi Council of Representatives shall be held for its third session no later than 1/5/2014. The date of the elections shall be determined by a decision of the Council of Ministers and in coordination with the Independent High Electoral Commission, endorsed by the House of Representatives and issued by presidential decree and announced by all media before the scheduled date for a period not less than 90 days.
Chapter III (Right of nomination)
 
Article (8) The candidate for membership in the Chamber of Deputies shall be required to add the following conditions to the voter:
First, he must be at least 30 years of age at the time of nomination.
Secondly, it should not be covered by the law of accountability and justice or any other law to replace it.
3- He should be good conduct and not convicted of a crime that violates honor.
(4) He must have a preparatory certificate as a minimum or equivalent.
Fifthly, it should not have been illegally enriched at the expense of the homeland or public money.
VI. He should not be a member of the armed forces or security institutions when he is nominated.
Proposed Amendment Article (8) The provisions of paragraph (1) and paragraph (4) of this Article shall be repealed and replaced by the following: First: He must be at least 28 years of age at the time of nomination. Fourth: To have a university degree equivalent to the nomination.
 
Article (9) Firstly, the Commission shall send the lists of candidates to the National Commission for Accountability and Justice for decision within fifteen (15) days from the date of receipt. Candidates are subject to the approval of the Commission.
 
Article (10) The number of candidates on the list does not exceed the number of seats allocated to the electoral district. the fourth chapter ( Constituencies )
 
Article (11) The Council of Representatives consists of (328) three hundred and twenty-eight seats distributed (320) three hundred and twenty seats on the provinces according to administrative limits according to the table annexed to the law and (8) eight seats, including quota (quota) of the components.
 
The following components shall be granted a quota (quota) calculated from the allocated seats, provided that this does not affect their percentage in the case of their participation in the national lists as follows:
(5) five seats distributed to the provinces (Baghdad, Nineveh, Kirkuk, Dahuk and Erbil).
B - The Yazidi component (1) one seat in the province of Nineveh.
C) The Mandaean Sabean component (1) one seat in Baghdad governorate.
(D) the network component (1) one seat in Nineveh Governorate.
Thirdly, seats reserved for the Christians and the Mandaeans shall be within one constituency.
 
Article (12) The nomination shall be in the manner of the open list and the number of candidates shall not be less than three. The voter shall have the right to vote for the list and the candidate and one of the candidates.
 
Article (13) First, the number of female candidates should not be less than 25% in the list, and women should not be less than 25%.
Second: When presenting the list, it is necessary to take into account the sequence of women by one woman after every three men.
 
Article (14) The seats on the competing lists are distributed according to the modified Saint Leco system as follows:
First, the correct votes for competing lists shall be divided into serial numbers (6,1, 9,7,5,3 ... etc.) and the number of seats assigned to the electoral district.
Second, this shall ensure that women receive at least 25% of the seats.
3 - The distribution of seats within the list of rearranging the sequence of candidates based on the number of votes obtained by each of them, and be the first winner to get the highest votes and so for the rest of the candidates.
Fourth: In the case of equal votes of candidates for the last seat is resorted to the lottery in the presence of candidates or representatives of the blocks concerned.
 
Article (15) First - If the vacant seat belongs to a woman, it is not required to be replaced by a woman unless it affects the representation of women. Second: If the vacant seat belongs to a political entity or a list that has exhausted the candidates, the seat shall be allocated to another candidate for a political entity that has obtained the minimum number of votes for a seat.
 
Chapter V (Voter register)
Article (16) First: The Commission shall register the voters for those who meet the conditions stipulated in this law. Second: The Commission shall prepare and update the primary voter register in cooperation and coordination with the UNHCR offices in the region and the governorates. Any person who meets the conditions of the election shall have the right to request the registration of his name in the primary register of voters and to verify his name if he is not present.
IV. Registration shall be done in person or in accordance with the instructions of the Commission.
V. The voter may not be registered in more than one constituency. The Independent High Electoral Commission during the modernization of the voter register must use mobile teams on citizens' homes to ensure that as many citizens as possible participate in the modernization process.
 
Article (17) The Commission relies on the preparation of the voters register on the latest database of voters register prepared according to the ration card database with updated in the voter registration centers until the census of the population.
 
Article (18) The voter register for each constituency with the names of voters in alphabetical order is shown by UNHCR in a prominent place within the registration centers for easy access.
 
Article (19) First: Any person whose name is not mentioned in the primary voter register or if there is a mistake in the data relating to his registration shall submit an objection to the National Office of the High Commission or its branches in the governorates to include his name or correct his data in the register.
Second: The objection shall be submitted in writing in accordance with the provisions of this law within a period determined by the Commission starting from the date of presentation of the primary voter register in the constituencies.
III. The Office of the Commission shall decide on the objection within a period determined by the Commission and its decision shall be subject to objection before the Board of Commissioners and its decision shall be subject to appeal in accordance with the law.
 
Article (20) The initial record shall be final and the balloting shall be carried out after the expiry of the term of objection or the resolution of the objections submitted thereon. The Commission shall publish it in the registration centers after the period determined by it. Chapter six (Electoral propaganda)
 
Article (21) Free election propaganda is guaranteed to the candidate under the provisions of this law, starting from the date of approval of the lists of candidates by the Commission and ends before (24) hours from the start of the ballot.
 
Article (22) Election propaganda is exempted from any fees.
 
Article (23) First, the Municipality of Baghdad and the concerned municipalities in the governorates shall determine, in coordination with the Commission, the places in which electoral propaganda is prohibited and prohibit the publication of any advertisement, programs or pictures of the candidates in polling stations and stations.
 
Second: The political entities participating in the elections must remove the electoral propaganda and the instructions issued by the Commission.
 
Article (24) It is prohibited to organize the election meetings held by the candidate or his supporters, the purpose of which is to publicize the candidate during the period specified in this law in the buildings occupied by the various ministries and departments of the state.
 
Article (25) The exploitation of the buildings of ministries, various state institutions, places of worship and religious symbols is prohibited for any propaganda or electoral activities of political entities and candidates.
 
Article (26) It is prohibited to use the official logo of the State in meetings, advertisements, electoral leaflets, writings and drawings used in the electoral campaign.
 
Article (27) Employees of the State Departments and local authorities shall not use their professional influence or resources of the State, its means or organs for the benefit of themselves or of any candidate, including its security and military organs, by electoral propaganda or by influencing voters.
 
Article (28) It is prohibited to practice any form of pressure or coercion or to grant material or moral gains or promises in order to influence the election results.
 
Article (29) It is prohibited to spend on electoral advertising from public funds or from the budget of ministries or waqf funds or from external support funds.
 
Article (30)
I. No candidate shall, on the day of the voting, distribute work programs, publications, cards or other documents himself or through others.
Secondly, no person working in the State or local authorities may, on the day of the vote, distribute work programs by himself or through others.
Thirdly, advertisements or distribution of work programs, publications or cards may not be placed in the name of a candidate not registered in the lists of candidates approved by the Commission.
 
 
Chapter VII (Electoral crimes)
 
Article (31) A penalty of not less than (6) six months and a fine of not less than (250,000) two hundred and fifty thousand dinars shall be punished by imprisonment for a period not less than (6) months and not exceeding (1000000) First - deliberately inserting a false name, names or characteristics in the voter register or deliberately not to include a name contrary to the provisions of this law.
Second, he has decided to include his name or the name of another without the required legal conditions, and it is proven that he knows this and anyone who decides not to include another name or delete it.
Thirdly, he cast his vote in the election knowing that his name was included in the voter register in violation of the law or that he had lost the legal conditions required to exercise his right to elections.

Article 32 The following shall be punished by imprisonment for a period of not less than one year:
I. Use force or threat to prevent a voter from using his or her right to vote or to abstain from voting.
(Ii) Give, offer or promise to give a voter an interest to himself or to others to induce him to vote in a particular way or to abstain from voting.
Third - Before or requesting interest for himself or for others who was charged with performing public service in the electoral process.
Fourthly, any voter behavior or reputation with a view to influencing the views of the electorate in the election result shall be published or broadcast among the voters.
Fifth - He entered the electoral headquarters with a firearm or a victim in violation of the provisions of this law.
VI. Spoiling, slapping or beatings of workers at polling stations.
Seventh - tampering with the ballot boxes or voter registers or any documents related to the electoral process.
Eighth - Nominated for more than one constituency or electoral list.
 
Article (33) Shall be punished by imprisonment for a period of not less than one year and a fine of not less than (1000000) million dinars and not more than (5 million) five million dinars or both penalties:
I. Acquires, conceals, executes, destroys, spoils or steals ballots or voter records or otherwise results in any way. Second, he violated the freedom of elections or his regime by force or threat. Article (34) A penalty of imprisonment for a period of not less than one month or a fine of not more than (1000000) million Dinars shall be imposed on whoever suspended the data, photographs or special electoral bulletins outside the places allocated to them.
 
Article (35) A penalty of imprisonment for a period of not less than one month and not more than one year or a fine of not less than (1000000) million dinars and not exceeding (5 million) five million dinars or both penalties shall be imposed on:
I. Intentionally attacking the photographs of the candidates or their programs published in the places assigned to them to another account or a specific body with the intention of harming this candidate or influencing the conduct of the electoral process.
Second: Declare the withdrawal of one or more candidates from the electoral process, knowing that this is not true in order to influence voters or turn the votes of the candidate.
(3) Attacks on electoral propaganda, which are permitted by law for any reason, whether it be a defect, ripping or otherwise, or any such behavior.
 
Article (36) The commencement of election offenses provided for in this Law shall be punishable by the penalty of the full offense.
 
Article (37) In the case of proven political entity's contribution to the commission of any of the electoral crimes stipulated in this law, a fine of JD (25000000) twenty five million dinars.
 
 
Chapter VIII (General and final provisions)
 
Article (38) The counting process, the counting of votes and the completion of its forms shall take place immediately after the end of the voting process at each polling station. The representatives of the political entities shall be provided with a paper copy thereof after being authenticated by the director of the electoral station. The form shall be placed in a place dedicated to the media at each polling station. Re-counting of all stations and polling stations and provides representatives of political entities paper copies of the results of counting and sorting.
 
Article (39) The elections may be postponed in one or more districts if the circumstances so require. The postponement shall be at the request of the Council of the Elections Commission and by a decision of the Council of Ministers and by the approval of the Council of Representatives.
 
Article (40) The special vote shall be 48 hours before the date of the general ballot, and shall include:
First: The employees of the Ministry of Defense, Interior and all other security agencies according to special procedures established by the Commission and approved on official lists provided by the competent authorities included in the special vote 60 days before the date of the poll and their names are removed from the general register of voters.
Second: The inmates and detainees based on lists submitted by the Ministry of the Interior and Justice within a period not less than thirty days from the date of the ballot and their names shall be removed from the general register of voters.
Third: Patients who stay in hospitals and other clinics and shall be based on lists provided by these authorities before the direct in the ballot according to the procedures of the Commission.
Fourth: The displaced shall vote according to the latest official statistics provided by the commissioner of the Ministries of Immigration and Displaced Persons and the merchants under which the displaced has the right to vote in the place where he resides and vote for his original department.
Fifth: Iraqis vote abroad in favor of their governorates according to procedures established by the Commission.
 
Article (41) The elections shall be held in Kirkuk, Salah al-Din, Ninewa, Baghdad, Basra, Dhi Qar, Babil, Sulaymaniyah, Anbar, Arbil, Diyala, Najaf, Wasit, Qadisiyah, Maysan, Dohuk, Karbala and Muthanna.
Second: The Chamber of Deputies shall form a committee of the governorates mentioned in paragraph
(1) above if the increase in its records (5%) is five percent of the total number of representatives of the members of the House of Representatives for that governorate and the membership of a representative of the Ministry of Planning, To review and verify the error and the increase in the voter registers and according to the official data and standards contained in this law to correct the voters register, and the Committee shall complete its work within one year from the date of its operation. The results of the elections in the governorates mentioned in paragraph (1) above shall not be counted before the completion of the audit of the voters' registers in them as the basis for any future electoral process or precedent for any political or administrative situation.
 
Article (42) The following criteria shall be adopted for the implementation of the provisions of Article (41):
First, the difference between the number of registered in the 2004 register before the update and the number of registered in the 2014 elections.
II. The audit of the difference is conducted in (i) above and in additions for years (2004, 2005, 2006, 2007, 2008, 2009, 2010, 2011, 2012 and 2013) with the following focus:
A) Population additions (births, deaths and transfer of entries from the governorate) for the period from 2004 to 2013.
B - returnees according to official records.
(C) any other demographic changes during this period;
Thirdly, the auditing process shall be based on the validity of the restrictions, their legality and the illegal cases, and the number of differences and the seats represented shall be calculated.
The number of members of the Council of Representatives representing the governorates mentioned in Article (41) shall be determined by the percentage of population to be adopted by the Council after subtracting the number of seats resulting from the violations.
Fifth: The owners of the governorate shall be considered the correct numbers and the registration of numbers outside the maintenance of the national quota.
 
Article (43) In the event of the adoption of electronic voting, the instructions issued by the Commission shall be approved for the conduct of the polling, counting and counting.
 
Article (44) The Council of Ministers and the Ministry of Finance shall allocate the funds allocated for the elections to the Independent High Electoral Commission within (15) fifteen days from the date of determining the date of the ballot.
 
Article (45) The Ministries of Education, Higher Education, Scientific Research, the Accountability and Justice Commission and all relevant departments must answer the Commission's inquiries about the validity of candidacy within a maximum period of fifteen days. Article (46) The Commission may issue instructions to facilitate the implementation of the provisions of this law.
 
Article (47) The Law of Elections of the Council of Representatives No. 16 of 2005 and its amendments shall be repealed.
 
Article (48) The provisions of this Law shall not be in conflict with the provisions of this Law and shall be effective from the date of its ratification and shall be published in the Official Gazette. Positive reasons With a view to holding free, fair and transparent elections in order to genuinely represent the will of the voter and to allow for legitimate competition, away from external influences and for the purpose of advancing the democratic process This law was enacted.

 Speaker of the House of Representatives Dr. Salim al-Jubouri said that the next Monday will witness the start of the questioning of a number of ministers. 
The 33rd regular session held yesterday, attended by 174 deputies, voted on two bills and completed the reading of 4 bills. 
Jubouri confirmed during the session, the allocation of meetings next week and from Monday to question a number of ministers on the requests submitted by a number of deputies. 
In the file of Kirkuk, Jabouri stressed the «need to preserve the lives of citizens and the protection of peace and communal coexistence in the province of Kirkuk away from escalation».
