(Reuters) - Britain's Prime Minister's envoy Christian Turner issued a statement on the meeting with Prime Minister Haider al-Abadi, who disagreed with his statement. 

Turner and his delegation met with Abadi on Tuesday. "During the meeting, the two sides discussed enhancing the relations between the two countries and the political, security and economic situation and restoring stability to the liberated areas," the office said. 

The statement added that Turner "blessed the victories achieved on a supporter, stressing his country's support for the unity of Iraq and Britain is committed to support Iraq in the process of stability of liberated areas." 

However, a statement issued by the British delegation said today that Turner met Abadi, Defense Minister Irfan al-Hayali and Interior Minister Qassim al-Araji. 

Turner said his country has not changed its commitment to Iraq's security and supports efforts to stabilize the liberated areas.

Turner said according to the statement to the importance of starting the start of dialogue between the Iraqi government and the Kurdistan Regional Government within the framework of the Iraqi constitution to build a promising future and stable components of Iraq.

ERBIL, Kurdistan Region (Kurdistan 24) – An Iraqi MP on Wednesday revealed that a delegation from the Kurdistan Regional Government (KRG) will visit the Iraqi capital Baghdad next week.

Jasim al-Bayati, a parliament member from the State of Law bloc, said a KRG delegation will visit Baghdad to begin dialogue over the outstanding issues between Erbil and the Iraqi government.

Bayati, who has close links with Iraqi Prime Minister Haider al-Abadi, told Iraqi media that meetings between the Iraqi government and the KRG will “identify a mechanism for dialogue over the conflicting points and stranded issues.”

According to the MP, there are several issues that will be discussed between Erbil and Baghdad including the federal budget, oil revenues, border crossings, and status of airports.

Meanwhile, following a series of meetings with Kurdish political parties on Tuesday, KRG Prime Minister Nechirvan Barzani stated that a visit to Baghdad had not been scheduled yet.

“We will visit Baghdad as a government delegation where all Kurdish political parties in the cabinet shall participate,” the Prime Minister told the press.

“All political parties that were consulted have agreed on three main principles,” PM Barzani said, adding they were all opposed to the formation of two administrations in the Kurdistan Region, supportive of talks with Baghdad, but against any unilateral discussions with the Federal Government of Iraq.

Ties between Erbil and Baghdad have considerably deteriorated since the Kurdistan Region’s Sep. 25 independence vote which saw 93 percent of voters favoring secession.

The United Nations Security Council on Wednesday held a special session on the situation in Iraq,in which the UN Special Representative for Iraq, Jan Kubic, gave a briefing on the political, security and humanitarian developments in Iraq and the role of the United Nations Assistance Mission for Iraq (UNAMI) in these developments. .

In his briefing to the council, Kubic said that the mission offered assistance to Erbil and Baghdad for rapprochement between them, stressing the need to start a dialogue to get out of the crisis and settle the differences between the two sides.

Kubic explained that all outstanding issues between the federal government and the Kurdistan Regional Government should be resolved through constructive dialogue between them, leading to permanent solutions based on the Constitution, and also guarantees all the constitutional rights of the Kurdistan Region and its citizens.

Pointing out that the UN mission in Iraq received reports of violations in Tuz Khurmato and Kirkuk on 16 October, calling on Iraq and the Kurdistan Region to conduct an impartial investigation into any events that occurred after that date in the disputed areas and hold those responsible responsible.

Kubic stressed the need to lift the air embargo imposed by the federal government in Baghdad on airports in the Kurdistan Region.

The official also pointed out that the Iraqi forces and the Peshmerga forces have achieved victory over a supporter. Pointing out that the organization of Dahedh was militarily defeated but not yet fully completed.

On the subject of legislative elections and provincial councils in Iraq, Kubic said elections can not be held and conditions in Iraq are turbulent and many Sunni communities are displaced.

The adviser to the President of the Republic for Cabinet Affairs, Abdullah Aliawi, on Thursday, the date of the Kurdish delegation's negotiating visit to the capital Baghdad.

 The truce announced by Prime Minister Haider al-Abadi with the Peshmerga forces in the disputed areas has been holding for almost a month on the suspension of military operations.

During the last period, the Kurdistan Democratic Party confirms that meetings of technical delegations did not stop. Other Kurdish parties, however, question continuing negotiations.


The main party in the region denies reaching an agreement with Baghdad to withdraw the Peshmerga to the 2003 borders, stressing that the agreement was limited to "stop the war." 
Officials in response to US pressure are likely to maintain calm on the northern and eastern seam lines and prevent Baghdad from using force. 
Officials are talking about "secret dialogues" the US side was waging with Erbil to persuade them to back down from the "referendum" in exchange for Baghdad's commitment to calm. And believes that these dialogues paved the way for the recent Federal Court decision unconstitutional referendum. They assert that the federal forces are ready to deploy in several disputed Nineveh towns. 
The Kurdistan Democratic Party denies that the Kurdistan Regional Government has rejected the court's decision, and confirms its readiness to conduct a dialogue with Baghdad, which will determine the fate of areas of tension.
Baghdad has given the Peshmerga forces, late last month, 24 hours to withdraw from the border area of Vishkhabur. This came in the context of armed clashes between the two parties during which heavy guns were used. 
Before the deadline, Prime Minister Haider Abadi announced the suspension of the military operation 24 hours, leaving the field of technical committees to determine the map of the deployment of federal forces in coordination with Kurdish officials. 
The army chief of staff, Gen. Osman al-Ghanmi, has held three rounds of negotiations with security officials in the region. 
The two parties reached an agreement to end the crisis, according to sources in the region and Baghdad, the return of the Peshmerga to the "Blue Line" and the joint administration of the border crossings.

Stop fighting

The Electoral Commission for the referendum in the Kurdistan Region said on Thursday that the next week will begin to pay the wages and entitlements of polling officers who oversaw the referendum on 25 September last.

"UNHCR spokesman Sherwan Zarrar, the Commission continued with the polling staff and we have previously confirmed that their wages will be disbursed, stressing the receipt of all amounts of wages from the presidency of the Kurdistan Region.

On polling officers in the disputed areas, the spokesman said: "The fact is we do not know how we will give the money to these, and how we will deliver them to them."

He announced the start of the distribution of these wages to the staff of Halabja province, revealing that the Commission will begin to hand over wages to employees in the Kurdistan Region all next week.

Kurdistan Region is likely to accept cancelling its referendum results that has fueled the crisis with Baghdad, Nineveh MP Abdul Rahman al-Lowaizi revealed Thursday. 

In a press statement, al-Lowaizi said that the US and the EU are pressuring Baghdad to end its military operations in Kirkuk and the disputed areas in return for convincing Erbil to cancel the results of the referendum which was held on September 25. 

This settlement has paved the way for issuing a ruling that cancels the referendum results, he noted.

On Monday, Iraq’s Supreme Federal Court ruled a Sept. 25 Kurdish independence referendum was unconstitutional and the results void, strengthening Baghdad’s hand in a stand-off with the Kurdish region. 

The federal government now has a legal ceiling that allows it to deploy its forces in the disputed areas, the MP added. 

After issuing the ruling, the Kurdistan Regional Government (KRG) has not directly say whether it accepted the effective cancellation of the vote, but its new prime minister called for a third party to oversee talks between Iraq’s central government and the Kurds.

The KRG also called on the international community, including the United Nations, European Union and non-governmental organizations, to intervene and help lift what it called “restrictive” sanctions imposed by Baghdad in retaliation for the referendum.

The United Nations Security Council issued a statement after a meeting to discuss the situation in Iraq on Wednesday, in which it announced its support for dialogue between Erbil and Baghdad to resolve the differences and outstanding issues between them.

The statement issued by the Council in New York today, to be a dialogue between the federal government and the Kurdistan Regional Government within the framework of the Iraqi constitution.

The Council welcomed the announcement by Prime Minister Haider Abadi and the Government of Kurdistan of their success in the dialogue, expressing full support for the United Nations efforts to pave the way for negotiations between the two sides.

The special envoy of the UN Secretary-General in Iraq, Jan Kubic, said in a briefing to the Council today, that the mission offered to help Erbil and Baghdad if desired, is sure to start a dialogue to get out of the crisis and settle differences between the two sides.

He said that all outstanding issues between the federal government and the Kurdistan Regional Government must be resolved through constructive dialogue between them, leading to permanent solutions based on the Constitution, and also included all the constitutional rights of the Kurdistan region of Iraq and its inhabitants.

He added that we received violations from the Kurdistan Region on what happened in Tuz Khurmato and Kirkuk on October 16, saying that he urged the Iraqi and Kurdish authorities to conduct an impartial investigation into any events occurred in the past period.

The UK Foreign Minister Boris Johnson confirmed that there is a "serious effort" underway to start a dialogue between Erbil and Baghdad, Rudaw quoted a statement from the Kurdistan Regional Government (KRG) as saying. 

Kurdistan Region Prime Minister Nechirvan Barzani received a letter from Johnson on Wednesday, delivered by the country's new ambassador to Iraq, Jonathan Wilks.

Johnson "reaffirmed that there is a serious effort in place to begin dialogue to resolve disagreements between Erbil and Baghdad in light of the constitution," the Kurdish statement read.

The UK appreciates Erbil's efforts to de-escalate tensions with Baghdad, it added.

PM Barzani thanked Mr. Johnson for his effort and repeated that Erbil has always favored dialogue with Baghdad to resolve their outstanding issues. He said the international community should do more to bring Baghdad to the table.

Earlier on Monday, The UK's Deputy National Security Advisor Christian Turner met with Iraqi Prime Minister Haider al-Abadi in Baghdad.

This comes as the crisis in Kirkuk has escalated. Peshmerga forces have been fending off attacks launched by the Iraqi forces. 

Tensions between the two sides over the future of Kurdistan have been high since the Kurds voted for independence in a September referendum. 

The oil-rich Kirkuk Governorate has emerged as a flashpoint in the crisis as it is claimed by both sides.

ERBILIraqi Prime Minister has refused to receive Germany’s Foreign Minister Sigmar Gabriel if he intends to visit Kurdistan Region’s capital of Erbil after Baghdad.

 

Gabriel had initially planned a trip to Iraq and Kurdistan Region in hopes of giving the sides a helping hand and mediate between them.

 

Abadi “vehemently opposed” Gabriel’s plan to visit Erbil and meet with Kurdish officials, as reported by Der Spiegel, which has also revealed Iraqi government’s response saying Gabriel’s visit to Erbil would be “undesirable”.

 

During a phone conversation between Abadi and German Chancellor Angela Merkel, the Iraqi premier refused to reconsider his position on the issue, which forced the German Foreign Minister to cancel his trip.

The Kurdistani political entity and the Iraqi Arabs entity are very much intertwined, as both of them come from the womb of the Sykes-Picot Treaty. The English and the French are not at all ignorant of this conspiracy. The result was that brother tortured brother, and if they survived the effort to demolish the other, they lived in eternal contention throughout their bitter lives.

After 2003, the hope of the Iraqis for a new democratic country received support throughout Iraqi society. They came together to establish a new constitution that would bring the country together once and for all. The Kurdish leadership played an important role in writing the new constitution and the people of Kurdistan voted overwhelmingly in favor of it. The implementation of the new Constitution is another story. While the Central Government grew stronger, they gradually began to depart from the spirit of the Constitution. This became clear as they shied away from implementing Article 140 of the Constitution which pertained to the disputed areas. Article 140 was the key to resolving the different claims of the disputed territories by the Central Government and the Kurdistan Regional Government. The people of Kurdistan should have known then that the ideal of power-sharing in these areas would not work. And they have known to withdraw from the Iraqi Parliament and the Government at that time. But they erred by staying in and accepting the status-quo in which the power-sharing policy virtually vanished by 2014, before ISIS attacked Iraq.

None the less, the Peshmarga forces joined the Iraqi forces and International allies to fight against the ISIS’ intrusion into Iraq and Syria. Together they scored big victories against ISIS until September 2017. During the attacks by ISIS in 2014, the Iraqi forces fled from most of the areas in the north. The Peshmarga forces, that seemed to have a lot more to lose, intervened and took control of most of these areas, especially the Kirkuk governorate and most of the disputed areas referred to in the Iraqi Constitution. The Peshmarga forces fought heroically against ISIS, while defending and protecting all parts of Iraq and the Iraqis from terrorism.

It became clear to the leadership in the Kurdistan Region as well as the leadership in the Iraqi Government, that they were at a cross road—not just in terms of controlling the disputed areas—but more importantly, the obvious differences that emerged in the mentality of the leaders in Baghdad toward the people of the Kurdistan Region. This difference in mindset led the leadership of the Kurdistan Region to conduct the constitutional referendum on September 25th, 2017 to determine the future of the disputed territories. So the people of Kurdistan did indeed hold the lawful referendum throughout the Kurdistan Region and the disputed territories. A total of 72.3% of the total population of the Kurdistan Region and disputed territories did vote, and of this 92.7% voted in favor of independence. The events of October 16 reveal they were quite correct and fully vindicated in calling for the Referendum. History will judge the call for a referendum to have been overdue and highly necessary to see just what all were dealing with in Iraq.

After the Iraqi army and the Popular Mobilization Units (PMU) defeated ISIS in the last area in the north (Haweja), they continued to use their American weapons, but this time directed against the people of Kurdistan—all under the watchful eyes of the US-led anti-ISIS. On October 16, these forces carried out a major offensive against the Peshmarga forces with inside help. They almost managed to control all the areas that were under Peshmarga control after 2014.

After October 16, the Kurdistan Region faced internal and external crises that demanded urgent attention if the people of Kurdistan were not to sink into chaos. The Kurdistan parliament extended the term of Parliament and the Government for another eight months, to last until the next election. This was necessary in order to achieve unity, to keep from falling into utter disarray, and to keep leaders from tearing each other apart. If the people of Kurdistan are to avoid a disastrous chaotic dissolution, the following steps must be attended concerning the Kurdistan Region Presidency and Executive, Legislative and Judicial branches of Government:

 

1.  Kurdistan Region Presidency: 

On October 29th, 2017, the President of the Kurdistan Region asked the Kurdistan Parliament of Iraq to allocate its powers between the Executive, the Legislative and the Judicial branches of authority. President Barzani asked Parliament not to manipulate the presidential law until the next election which is scheduled to take place in 2018 (eight months hence).

The question to be considered is this: Should the law of the Presidential office remain in force, or should it be repealed by Parliament. If the law were cancelled, then the debate would cease and be discontinued.  If the law is not repealed, then the discussion will be to define the authorities of the President of the Kurdistan Region. If the Parliament agrees on authorities of the President, then the President will beholden to answer directly to the Parliament, the debate then will center on whether the President should be elected directly by the people, or elected by the Parliament. The position of the Presidency should not be ceremonial, like in the Presidency office in Iraq.

 

     2. Separation and reforms of the executive branches (judicial, legislative and executive) to be done as follow: 

A.   The Judicial Branch of the Kurdistan Government:

In order to build trust between the people of Kurdistan and the Government the Judicial system must be totally revamped in order to become completely independent. No one should have power over the judicial authorities. Unless this important step is taken immediately and sincerely, then the citizenry of Kurdistan have no right to believe that their rights are safe. They will feel that their human and civil rights will continue to be violated. This state of affairs would put us back in “square one”, a situation of mistrust and suspicion between the people and the judicial authority.

B.   The Legislative Branch of the Kurdish Government:

Elected by the people of Kurdistan, the people must be able to trust Parliament to be impartial as it enforces the democratic process as well as the Rule of Law. Parliament must work as one body to establish the necessary legal framework to ensure fair elections. If the people do not back the Parliament and trust this body to oversee a fair and impartial election process, we will not be united as a people and our society will continue to write in controversy. In this respect, it cannot be overestimated the importance of Parliament’s ability to act responsibly, honestly, and efficiently, as it earns the trust of the populace at large. Needless to say, all political parties must be united and stand behind Parliament as it makes bold decisions to prepare for the challenges it will face within the coming eight months.  

        C.  The Kurdistan Regional Government:

Some they are calling for a “transitional government” to help resolve the KRG’s current political and economic crises. This will be difficult to achieve during such a period of chaos and political instability. To reform this Government, we all must work together to support the Government in this period of transition. The Government’s biggest challenge lay ahead is to elect a new committee to lead us through the next 8 months as well as to represent the citizens of the Kurdistan region in its negotiations with the Central Government relating to all the disputes between them. To achieve these goals the Government must do the following as a road map out of this crisis: 

1. A new committee of intellectuals and academicians to serve as advisors from outside the Government and political parties this committee should include jurists in the constitution. This body of advisor will assist the Government and the Parliament in this critical stage. The current advisors were responsible for our failure in many sectors inside and outside of the Kurdistan Region. They should be let go so that a new crop of fresh advisors who are not bound to old patterns, can assist the Government and the Parliamentary leaders to a new phase of accountability, transparency, and responsibility.

2. The Government & Parliament must create a new committee with responsibilities to lead during this current period of crisis. Regulated by law for a specific period of time, until the next election, the committee will be called the crisis and peace committee or any other name they agree on. 

3. Led by the Prime Minister and his Deputy, the new committee will be tasked to participate in all negotiations involving the Central Government and the Kurdistan Region. They will also be engaged in all regional and international discussions related to all aspects of the Government and the rights of the People of Kurdistan. This committee will be effective for 8 months until the new election.

4. The Government must work closely with the parliament to implements any new laws.

5. As mentioned, the Government must work very hard to reform the Judiciary system to gain the support of the people. An independent judiciary system able to freely to implement the law of the land enables the Government to be on the right path toward building a solid democratic state that ensures equality for all under the Rule of Law. This core reform will allow us to start a nation-building process that will result in a democratic system of government where no one will be above the law.

6. The most important and key element to enable trust-building between the Government and the people is to have full transparency, accountability, and responsibility. To achieve this goal the Government must publish accurate incomes, expenses, so the people can see for first time what the Government is doing with all the money that comes into their coffers. In this way the Government will slowly begin to build up the people’s trust once again. These reports must be audited and approved by an international auditing body as well as the Parliament. Eliminating corruption and mishandling of the public trust should be severely punished.

7. The modernization and professionalization of the Peshmerga forces is a must. Under the supervision of military advisors and technicians from America, France, and Germany, professionalism will be installed and partisanship eliminated. The military forces must be consolidated and removed from the control and loyalty or ownership of their parties. As the military becomes professionalized and modernized, unqualified officers should be either retired or retrained regardless of their military rank or their loyalty to any political party. Impartiality must be adopted as a ruling ethic if the military establishment is to be respectable and entrusted to protect the populace.

8. Foreign affairs: At the international level, the representation of the regional government abroad should be reviewed, and qualified people should be appointed to represent the regional government according to their competencies, not on the basis of nepotism or party loyalty. This is to form a strong lobby that can build resilient relations with the countries in which they work and benefit from the experiences of Kurdish intellectuals in these countries as well. 

9. To commission an independent committee to conduct a comprehensive investigation into the effects of the referendum and the events of October 16, in order to determine the nature and causes and consequences of the referendum and ways to deal with them and ways to get rid of the effects, and study in detail to come out with a realistic analytical vision of the crisis, internal and external factors. And submit a detailed report to the government, parliament and Kurdistani political parties to study them to avoid their recurrence in the future.

Political Leaderships Council 

This council replaced the referendum committee, with no legal authority as of yet because it has not been regulated or established by any law or authority. No one knows what the Council’s authority consists of, or what they represent. However, this Council can be important forum for political parties to discuss the national issues related to the future of the people of Kurdistan. The Council can operate as a consultancy body to the Government at this stage. The importance of this Council is to back up and support Parliament and the Government through their contributions on the crucial issues of the people of Kurdistan

Negotiations with the Iraqi government

Negotiations with the Iraqi government should be conducted only in the presence of a neutral body such as the United Nations, America, France or Germany. Because there are radical differences in the interpretation of the Iraqi Constitution between the Iraqi government and the Kurdistan Regional Government.

One thing is certain: our hope for independence will never die.

Kurdish government on Thursday affirmed the necessity of revoking all measures initiated by the government and parliament in Baghdad in response to the independence referendum held in the region.

 

In response to Abadi's remarks he made on Tuesday, spokesman for the Kurdish government said the measures taken against the region of Kurdistan should be lifted, saying these measures are taken against the people and government of Kurdistan.

 

As to the Peshmerga, the spokesman said they are recognized by the constitution and played a major role in crushing ISIS and protecting the country.

He also called on Abadi to order the disbursement of wages of Kurdish employees, as he pledged to do so before, but he went nowhere on the matter.

 

Tensions have been mounting between Baghdad and Erbil over the latter's bid for referendum. Things have gone worse as Baghdad opted for military solution to settle the dispute.

Iraqi forces backed by IMIS took control of oilfields in Kirkuk.

Head of Protection and Information Agency in the region of Kurdistan Lahor Talabani said on Thursday he and Swedish ambassador in iraq Christian Nilsson discussed the latest developments in Iraq in the wake of the independence referendum conducted last September 25th.
He also added the meeting asserted the necessity of settling the outstanding issues between Baghdad and Erbil.
In the meantime, he warned of what he called signs of resurgence of the terror group of ISIS in some areas.
 ISIS terror outfit has been incurring huge losses in Iraq in recent months, with its affiliates expelled entirely from Mosul, Tal Afar and other areas.

ERBIL — A Kurdish music band has recently adapted Michael Jackson’s most controversial song, “They don’t care about us”, into Kurdish language, using some Kurdish musical instruments as well.

Bajar, the band, is based in Turkey’s Istanbul, and has collaborated with 'Defjen — an all daf-playing ensemble — in composing and performing the piece, Kurdistan24 reported.

ERBIL — With reference to the recent decree by the Iraqi Federal Court on Kurdistan Region’s independence referendum, there are obligations for the Iraqi central government to be met, among them lifting all the sanctions Baghdad has imposed against Erbil, said Safin Dizayi, a spokesperson for the Kurdistan Regional Government (KRG).

The punishments, including the reduction of KRG’s share from the federal budget, punishments against Kurdish representatives at the Iraqi parliament and ban of international flights to Kurdistan Region must be all lifted, Dizayi told KRG’s official website on Thursday.

Concerning the Kurdish Peshmerga forces, Dizayi pointed out that they are, according to the Iraqi constitution, part of Iraq’s defence structure, and that Baghdad must grant them with all the financial rights. However, he added, the central government has been reluctant for many years to even send the Peshmerga wages.

The Kurdish forces have been playing a decisive role in the three-year-long war against Islamic State (IS). Since mid-2014, they have liberated a vast territory in northern Iraq from the jihadists.

Dizayi reminded that 1,802 Peshmerga fighters were killed in the anti-IS battle with 10,233 others injured. Sixty-two Peshmerga troops are missing.

Commenting on previous statements by Iraqi Prime Minister Haider al-Abadi, who promised to send wages for public servants in Kurdistan Region, Dizayi said that no concrete steps have been taken thus far, and that the statements remain a claim only.

BAGHDAD, Nov. 24 (UPI) - President Fuad Masum held talks at the Peace Palace in Baghdad with senior constitutional experts and lawmakers in the country on ways to strengthen adherence to the constitution and monitor constitutional violations from all state institutions.

In a statement issued by his office, Masoum praised the "expertise and keenness of Iraqi constitutional and legal experts in various fields," pointing out "the need to redouble efforts to monitor and address the problem of constitutional violations that may be committed by State institutions at various levels. "He said.

"The need to speed up the issuance of the laws stipulated by the Constitution, especially the law of the Council of the Union and oil and gas and the Federal Service Council as well as the completion of the draft constitutional amendments."

For their part, the participants presented proposals and recommendations aimed at supporting the implementation of the provisions of the Constitution in all fields. AH
