Iraq’s supreme court on Nov. 20 declared that September’s referendum on independence in the autonomous Kurdish areas in the north of the country was unconstitutional.

A statement said the court "rendered a decision declaring unconstitutional the referendum held on September 25, 2017 in Iraqi Kurdistan... and cancelling all the consequences and results that resulted".

The legal move on Nov. 20 was the latest stage in a crisis sparked by the referendum, which resulted in a resounding "yes" vote for independence in the Kurdish area.

Last month, the UN Security Council urged the Iraqi government and regional leaders in Kurdistan to set a timetable for talks to end the crisis.

The world body’s appeal came after Baghdad dismissed an offer from Iraqi Kurdish leaders to freeze the outcome of the referendum and hold talks.

Rejecting the freeze offer, Iraqi Prime Minister Haider al-Abadi instead demanded the annulment of the independence vote.

Last week, as the deadline announced by the Supreme Court for its decision on the constitutionality of the referendum approached, the Kurdistan government said it "respected" the decisions taken by Iraq’s highest court.

It also said it respected a previous decision insisting on Iraqi unity, which could be a basis for dialogue.

Parliament in Baghdad is currently reviewing the federal budget for the coming year, including the allocation for the autonomous Kurdish region.

September’s referendum was initiated by then Kurdish leader Massoud Barzani, for whom the repercussions were severe.

Barzani at the beginning of November announced he was stepping aside, having lost almost all of the territory disputed between Kurdish capital Irbil and Baghdad.

The Kurds also lost all of the oil resources in Kirkuk province that could have ensured the viability of a hypothetical Kurdish state.

The Kurdistan Regional Government (KRG) calls upon the international community to intervene with the Government of Iraq to end its collective measures against the people and government of the Kurdistan Region, said the KRG.

“The restrictive policies adopted by Baghdad against Erbil are in violation of Iraq’s obligations and responsibilities under international and humanitarian law, and its duty as a state to respect and protect its citizens, including those displaced, and to promote and protect the human rights and fundamental freedoms of individuals and groups,” reads an official statement.

Erbil reminds the world that Baghdad has taken “collective punishments” against the people of Kurdistan Region in retaliation for their vote for independence. “Reducing Kurdistan Region’s budget in the 2018 Draft Budget Bill without involving the Kurdistan Regional Government, closure of the Kurdistan Region’s airspace, and travel restrictions are among the measures of collective punishment,” reads the statement.

The measures Baghdad has taken against Erbil, according to the KRG, has also impacted the humanitarian shipments for over 1.5 million Syrian refugees and Iraqi IDPs sheltered across Kurdistan. “With winter fast approaching, many displaced persons, including Yezidis, Christians, and recently displaced people from Kirkuk, Tuz Khourmatu and other areas, will be without critical supplies, specialized assistance, and care provided by UN agencies, NGOs, and other international organizations”

“We call on the international community to intercede in urging Baghdad authorities to lift the embargo, without conditions, on international flights. The international community’s attention and action would be deeply appreciated in mediating and lifting air embargos and other collective restrictions in order to minimize and avoid adverse effects on vital humanitarian services, health and education services, food security, security against terrorism, jobs and income security in the Kurdistan Region,” the KRG added.

Washington said Baghdad and Erbil could resolve outstanding issues without having to send a special US envoy to mediate the crisis, State Department spokesman Heather Naort said.

"They have lived together, fought together and raised children together," she said, prompting Washington to believe in their ability to resolve outstanding problems.

The Kurdistan Regional Government has asked the United States to appoint a special envoy to mediate between them and the central government, according to the head of foreign relations in the region Falah Mustafa Bakr of the Wall Street Journal on Monday.

Asked about the request, Naourt replied that the administration believes that the contentious issues between the parties can be resolved internally. "We do not feel it necessary to appoint a US envoy to deal with this," she said.

The central government in Baghdad rejected the referendum and its results and said it would not recognize it and took administrative and military measures to strengthen its federal powers, particularly in disputed areas and border crossings.

The Federal Supreme Court in Iraq on Monday reinforced Baghdad's position by saying that the referendum was unconstitutional.
