It is of my opinion when the dust settles that the Barzani family's decision to hold the referendum was one of the greatest moves in expediting the HCL. article 140 and a few other laws we desperately need to take place in order to see the RV of the Dinar.

The central government has launched a legal crackdown on Kurdish officials and sought to build on key companies in an effort to clamp down on the referendum's promoters of independence.

These moves come a month after the referendum in the non-binding Kurdistan in Baghdad. The central authorities have already cut relations between Kurdistan and the outside world when all the airlines cut into Kurdistan, while Turkey and Iran threatened to close their borders to Kurdish oil exports.

Supreme Court decision re Article 1 Iraq Constitution.

At the request of the Secretary General of the Iraqi Council of Ministers on November 5th, 2017, the Federal Supreme Court issued Decision No. 122 on November 6th, 2017, regarding the interpretation of the Article 1 of the Iraqi Constitution which states: “The Republic of Iraq is a federal, independent and fully sovereign state in which the system of government is parliamentary and democratic republic, and this Constitution is a guarantor of the unity of Iraq.”

As we, in the Kurdistan Region, have always emphasized on finding solutions to disputes between the federal Authorities and the Kurdistan Region through constitutional and legal means, and based on our known position which welcomes all relevant initiatives, especially the initiatives by the Grand Ayatollah Ali Al- Sistani, Iraqi dignitaries and friendly countries to the Iraqi people regarding addressing disputes on the basis of the Constitution, we respect the interpretation of the Federal Supreme Court of the First Article of the Iraqi Constitution.

We believe that this Decision must become a basis for starting an inclusive national dialogue between Erbil and Baghdad to resolve all disputes through implementation of all constitutional articles and in a way that guarantees all rights, authorities and status mentioned in the Constitution, since this is the only way to secure the unity of Iraq, as Article 1 stated.

ERBIL, Kurdistan Region (Kurdistan 24) – In a statement released on Tuesday, the Kurdistan Regional Government (KRG) stated that they respect the Iraqi Federal Supreme Court's recent interpretation of Article 1 of the constitution regarding secession in Iraq.

The Federal Supreme Court of Iraq issued a decision on Nov. 6 stating that no region or province could unilaterally secede, strengthening the federal government’s hand as it seeks to prevent other movements such as the Sep. 25 independence vote in the Kurdistan Region.

The ruling responded to a request from the Iraqi government in Baghdad to put an end to any “misinterpretation” of the constitution and to assert the unity of Iraq, a court spokesman said last week.

“The Republic of Iraq is a federal, independent and fully sovereign state in which the system of government is a parliamentary and democratic republic, and this Constitution is a guarantor of the unity of Iraq,” Article 1 of the Constitution of Iraq reads.

The KRG welcomed the ruling of the court and stated that the Kurdistan Region respected the decision.

“As we, in the Kurdistan Region, have always emphasized on finding solutions to disputes between the federal Authorities and the Kurdistan Region through constitutional and legal means, and based on our known position which welcomes all relevant initiatives, especially the initiatives by the Grand Ayatollah Ali Al- Sistani, Iraqi dignitaries and friendly countries to the Iraqi people regarding addressing disputes on the basis of the Constitution, we respect the interpretation of the Federal Supreme Court of the First Article of the Iraqi Constitution,” read the KRG statement.

The Kurdish government also called on launching a peaceful dialogue between Erbil and Baghdad to address their differences.

“We believe that this Decision must become a basis for starting an inclusive national dialogue between Erbil and Baghdad to resolve all disputes through implementation of all constitutional articles and in a way that guarantees all rights, authorities and status mentioned in the Constitution, since this is the only way to secure the unity of Iraq, as Article 1 stated,” the statement added.

Ties between Erbil and Baghdad have considerably deteriorated following the Sep. 25 referendum on independence for the Kurdistan Region.

On Oct. 16, Iraqi Forces along with the Iranian-backed Shia Hashd al-Shaabi militia launched a military operation and took over Kirkuk and other disputed territories which have been under the protection of the Kurdish Peshmerga Forces in the past few years. Since then, Baghdad has been introducing measures to undermine the Kurdistan Region’s constitutional integrity.

The erasing and renaming of the Kurdistan Region into ‘northern Iraq’ is seemingly becoming a policy enforced by the central government since the holding of the independence referendum. Baghdad is allegedly attempting to dissolve the KRG by trying to deal with provinces individually.

In the draft 2018 budget introduced earlier this month, the bill referred to the Kurdistan Region as ‘the provinces of northern Iraq,’ opting to completely ignore the constitutionally-enshrined terminology and removing Kurdish rights.

Kurdistan Regional Government (KRG) has officially responded to the Supreme Federal Court’s ruling on the constitutionality of Kurdistan Region’s independence vote.     
Last week, six out of nine judges in the Federal Court voted that the Iraqi constitution does not condone the secession of any region or governorate.
The ruling was a response to a request from the central government in Baghdad to put an end to any “wrong misinterpretation” of the constitution and assert the unity of Iraq, a court spokesman said.
The ruling also came in wake of the September 25 Iraqi Kurdistan Region’s independence referendum that saw the majority of Kurds vote in favor of secession from Iraq. 


In a statement issued on Tuesday, KRG called for entering into a comprehensive national dialogue to solve all conflicts by implementing all articles of the constitution to ensure that the rights and powers enshrined in the constitution are protected.


Implementing all articles is the only means to ensure Iraq’s unity, which is referred to in Article 1 of the constitution, the statement read. 


We respect all initiatives that require resorting to the constitution to solve conflicts. In this sense, we respect the federal court’s interpretation of Article 1 of the constitution. At the same time, we reaffirm our convection that this can be a basis of a comprehensive national dialogue, it added.  
Article 1 of the Iraqi constitution stipulates that Iraq is a united independent federal state that enjoys a republican parliamentary system.

Seems like Barzani (the older one) didn't have the stroke he thought he did and/or the backing of the US.

 

I wonder if the Trump administration swerved from Obama's stance with the Kurds, maybe? Don't know enough about what's really going on but what shook out isn't what I thought would happen, to be honest. 

 

Good thing for everyone concerned if the Kurds capitulated and are indeed working with the GOI, maybe something will be hammered out as a result of the referendum.

ERBIL — The Kurdistan Regional Government (KRG) released on Tuesday a statement in response to the Iraqi Federal Supreme Court’s interpretation of Article 1 of the constitution in relation to the Kurdistan Region’s referendum for secession from Iraq.

Iraq's Supreme Federal Court ruled on November 5 that no region within the country may secede from the state, depending on the interpretation of the constitution.

The ruling was in response to the referendum by the Kurdish Region which overwhelmingly voted for independence, with over 92 percent of the votes in favor of secession from Iraq.

The spokesperson for the Supreme Federal Court, Iyas Samok, state’s that the court concluded that there is "no provision in the Constitution that allows for the separation" of any region in the country.

KRG believes that court’s decision needs to be the basis for an inclusive dialogue to settle all issues by implementing the constitution in its entirety.

“We believe that this decision must become a basis for starting an inclusive national dialogue between Erbil and Baghdad to resolve all disputes through implementation of all constitutional articles and in a way that guarantees all rights, authorities and statuses mentioned in the Constitution, since this is the only way to secure the unity of Iraq, as Article 1 stated,” the statement reads.

The Kurdistan Democratic Party (KDP) declared its conditions for its MPs return to the Iraqi Parliament, KDP top leader Ashwaq al-Jaf announced on Tuesday.

In a press statement, Jaf said that KDP's MPs will not return to the Iran Parliament until the Baghdad central government begins a dialogue with the Kurdistan Regional Government (KRG).

 

She added that KDP members are also waiting for the two sides to solve a number of issues and problems in order to attend any parliamentary sessions.

Jaf asserted that 2018 state budget is full with constitutional violations, as the lowering Kurdistan's budget allocations are considered punishment against the Kurdish people.

 

On Sunday, Iraqi Parliament will keep Kurdistan's state budget allocations at 12%, Parliament Legal Committee Member Kamil al-Zeidi said.

In a press statement, Zeidi said that the region's share of the state budget may even be decreased if the population statistics were less than before, noting that there is no coming back to the previous 17% share.

The Kurdistan Region has expressed its readiness to cancel the results of the referendum held on 25 September last; conditional on obtaining a fair share of the federal budget.

 

 

The newspaper "Al-Sabah" semi-official, Tuesday,  that "the stage of disagreement between Baghdad and Arbil may see a breakthrough soon, after it revealed the readiness of the Kurdistan region to cancel the results of the referendum for a certain price."

The newspaper added that "the announcement of canceling the referendum may be a reasonable price for any agreement between Baghdad and Erbil, under which the Kurdistan region to get a fair share of the federal budget of the country."

The newspaper pointed out that "according to these data, the indications that the possibility of declaring the Kurdistan region to cancel the results of a referendum held on the twenty-fifth of last September, on the secession of the region; increasing and suggest a close settlement."

Direct : The Kurdistan Regional Government of Iraq, its commitment to seek a solution to the differences between them and the federal authorities in Baghdad by constitutional means, and respect for the decision of the Federal Supreme Court, which prohibits the separation of the territory from Iraq .

The Iraqi Kurdistan government said in a statement Tuesday that it respected the Supreme Court's interpretation of article 1 of the constitution, issued on November 6.

Article 1 of the Iraqi Constitution stipulates that "the Republic of Iraq is a single, independent and fully sovereign federal government with a democratic parliamentary system. This constitution guarantees the unity of Iraq."

The territorial Government affirmed its belief that the application of all constitutional articles should be the basis for initiating a comprehensive national dialogue to resolve disputes, ensuring that the rights, powers and competencies contained in the Constitution are protected as the only way to ensure the unity of Iraq.

It is worth mentioning that the Iraqi Federal Court issued mid-September a ruling on the request of the Prime Minister of the federal government Haider Abadi, to stop the referendum on the secession of the region.

The Iraqi president, Fuad Masum , that the referendum in the Kurdistan region "constitutional action," but the separation of the territory from the Iraqi state "unconstitutional ."

The Kurdistan Regional Government of Iraq launched several initiatives to end the dispute with the central government in Baghdad, stressing its readiness for any kind of negotiation under the Iraqi constitution.
