Iraqi courts accused of becoming tool to persecute political opponents

ERBIL, Kurdistan Region--Iraqi courts are seem to becoming a tool to punish political opponents and Kurdish officials are now the new targets of these courts after the Sunnis.
 
During his two terms as prime minister Nouri Maliki drove away many Sunni leaders from the Iraqi political landscape through court decisions, namely, former Iraqi Vice President Tariq Hashimi and Finance Minister Rafe al-Esawi.
 
And now under Haider al-Abadi the same scenario is being used against Kurdish leaders. The first case started with firing Kirkuk Governor Dr Najmadin Karim. The latest official wanted by these courts is the deputy leader of the Patriotic Union of Kurdistan (PUK), Kosrat Rasul Ali.
 
There are claims that these courts will also try the Kurdistan Region’s President Masoud Barzani.
 
On Thursday, October 19, 2017, judge Abdulstar Bairaqdar, spokesperson for Iraq’s Judicial High Council said that the Rusafa Investigation Court issued, in accordance with article 226 of Iraq’s penal code, an arrest warrant to Kosrat Rasul Ali for branding Iraqi forces in Kirkuk province as ‘invaders.’
 
Article 226 law says that any person who disrespects the national council, government courts, armed forces or any other department of the government, will be sentenced by imprisonment for no more than 7 years or by fining.
 
“Kosrat Rasul Ali faces charges of insulting the state. But the accused is innocent until proven guilty. He can therefore appear in front of the court and speak his words,” Tariq Arb, an expert in constitution and law, told Rudaw.
 
He also said that according to the court decision, Kosrat Rasul is now wanted and cannot therefore travel abroad. His property will also be seized. For example, if he has property in Kirkuk, it will be seized.
 
This is the third arrest warrant being issued to Kosrat Rasul Ali. One was during the former regime of Saddam Hussein, the other one was during the internal war between the PUK and the Kurdistan Democratic Party (KDP).
 
“The decision to arrest Kosrat is political and we will pursue every legal procedure to nullify this decision,” Mohammed Othman, MP with PUK at Iraqi parliament told Rudaw.
 
“The rulers of Baghdad are free. They can make any decision they want, but they should know that they cannot and they don’t have the right to arrest a patriot like Mr Kosrat and other patriots,” Masoud Barzani said of the arrest warrant issued to Kosrat Rasul.
 
Lawsuits have been filed against many Kurdish officials in Baghdad, notably, Najmadin Karim, Rebwar Talabani, Hoshyar Zebari, Babakir Zebari and officials from the Kurdistan Region’s High Independent Electoral and Referendum Commission.
 
Sadiq Laban, an MP of the State of Law coalition rejects the idea that the Iraqi court decisions against the president and vice president of the Kurdistan Region, Masoud Barzani and Kosrat Rasul are political. He thinks that the courts were late in issuing these verdicts and should have therefore taken this step earlier.
 
“The court has issued an invitation for Masoud Barzani. If he doesn’t appear before the court, a decision to arrest him will be made,” he added.
 
“Resorting to the court and issuing arrest warrants to the leaders of the Kurdistan Region will ruin the bridge of dialogue and getting close to one another. This doesn’t serve the situation. It deepens the crisis rather than solving it,” Abdulqahar Samaraye, Sunni MP with Coalition of Iraqi Forces, told Rudaw.
 
The current scenario against the Kurds was practiced previously against the Sunnis. Through court decisions, Nouri al-Maliki chased away the effective leaders of the Sunni Arabs.
 
An arrest warrant was issued in December 2011 for Iraqi Vice President Tariq Hashimi, an effective Sunni leader, on charges of alleged involvement in terrorist activities.
 
Hashimi turned to the Kurdistan Region on January 19, 2011. Then president of Iraq Jalal Talabani said that Hashimi was his guest and will appear before the court at any time. But Hashimi left Kurdistan and went to Turkey. The court then sentenced him to death in absentia.
 
Rafe al-Esawi, a Sunni Arab official and finance minister, faced the same fate. An Iraqi court issued a prison sentence of seven years to him in 2015. He lives outside Iraq now.
 
The list also includes other Sunni Arab leaders Khamis Khanjar, Ali, Atam Sulaiman, Atheel Nujaifi, former Mosul governor, Aris Zari, head of Muslim scholars body in 2013 facing charges of involvement in terrorist activities and then left Iraq until he died from cancer in Istanbul on March 13, 2015.
 
Some Shiites have also fallen victim to this campaign initiated under the name of constitutional and law enforcement.
 
On August 23, 2003, an Iraqi court issued an arrest warrant to Muqtada Sadr, leader of the Sadr movement, on charges of inciting the murder of a Shiite religious figure, Abdulmajid Khuy.
 
According to some statistics, the Iraqi government had until the beginning of 2016 submitted 1015 arrest warrants to Interpol.
 
In addition, seven Iraqi officials fled to outside Iraq this year who are accused of corruption.
 
Many of these officials are wanted by the court, namely, Ayham Samaraye, minister of electricity in Ayad Alawi’s cabinet. He faces 12 dossiers of corruption. Mohammed Shalash, minister of electricity during Ibrahim Jafaari’s cabinet, was also wanted.
 
Karim Wahid, minister of electricity in Nouri Maliki’s first cabinet. Azim Shaalan, defense minister in cabinets of Ayad Alawi and Ibrahim Jafaari. Luay Hatam, minister of transportation during the cabinet of Ayad Alawi. Asad Hashimi, ministry of culture in Maliki’s first cabinet. Malas Sheikh Mohammed Kasnazani, minister of trade in Haider Abadi’s cabinet in 2014 until the beginning of 2015.

BAGHDAD (Reuters) - A Kurdish source revealed on Wednesday the existence of a Kurdish political movement to name the head of the Coalition for Justice and Democracy Barham Saleh as head of a rescue government in Kurdistan, while noting that the Kurdish divide hinders dialogue with Baghdad.

The source said in an interview with Baghdadiya News that "Kurdish movement is taking place within the region on the formation of a temporary national rescue government by the former Prime Minister in the province Barham Saleh and change and the Islamic Group until the holding of new elections and the formation of a delegation to dialogue with Baghdad authorized by the interim government."

The source, who declined to be named, said that "the Kurdistan Democratic Party led by Massoud Barzani and the Islamic Union and the National Union led by Kosrat Rasul form an alliance opposed to Barham Saleh and the Islamic Group and change and calls for dialogue with Baghdad."

He explained that "the political conflict is still hot on the arena of Kurdistan," noting that "the picture is still bleak without clarity."

The government said in a statement received by Baghdad News that a "situation and danger to Kurdistan and Iraq, impose on everyone to be the level of historical responsibility, and not to push things to the state of fighting between the Iraqi forces and the Peshmerga," indicating that "attacks and clashes between forces Iraq and the Peshmerga since October 16, and today, led to the loss of the parties and may lead to a war of attrition and thus to destroy the social fabric among the components of Iraq.

Kurdistan Region’s Penjwen border crossing is expected to reopen on Wednesday after Tehran closed down all international gates with Kurdistan at the wake of September’s independence referendum.

Head of Syndicate of Truck Drivers in Penjwen, Abdullah Ahmed, told BasNews that his Iranian counterpart has informed them to send truck drivers to the border crossing by Wednesday as authorities have decided to reopen the gate.

He said that there are also indications of reopening the gates for tourists as well.

Following the independence referendum in Kurdistan Region on 25th September, the Iraqi government asked Tehran and Ankara to close down the borders with the Kurdistan Region as part of collective punishments for the independence move.

Later on 15th October, the Iranian government decided to halt all trade and tourism communications with Kurdistan, but Turkey is yet to take a similar decision.

KRG OFFERS TO “FREEZE” RESULTS OF INDEPENDENCE REFERENDUM
Iraq, October 25, 2017 

As Iraq and Kurdistan are faced with grave and dangerous circumistances, we are all obliged to act responsibily in order to prevent further violence and clashes between Iraqi and Peshmerga forces.

Attacks and confrontations between Iraqi and Peshmerga forces that started on October 16, 2017, especially today’s clashes, have caused damage to both sides and coud lead to a continuous bloodshed, inflicting pain and social unrest among different components of Iraqi society.

Certainly, continued fighting does not lead any side to victory, but it will drive the country towards disarray and chaos, affecting all aspects of life.

Therefore, in order to fulfill our responsibilites and obligations towards the people of Kurdistan and Iraq, we propose the following to the Iraqi Government and the Iraqi and world public opinion:

  • Immediate ceasefire and halt all military operations in the Kurdistan Region.
  • Freeze the results of referendum conducted in the Iraqi Kurdistan.
  • Start an open dialogue between the Kurdistan Regional Government and Iraqi Federal Government on the basis of the Consititution.

Shahristani called on the president of the region Massoud Barazani to "take responsibility for the referendum and to initiate his resignation." 

Shahristani said that "Iraq is associated with Iran good relations at various levels," pointing out that "we will not accept any intervention of the Americans in relation to Iran." 

He said that "the commander of the Quds Force in the Revolutionary Guards, General Qassem Soleimani sought all his guidance to lead the Kurdistan region to retreat from the referendum," pointing out that "Iraq is better off after defeating the raging and regulating the relationship between Baghdad and Erbil." 

He added that "the factions that fought an organization calling for the liberation of Iraqi cities have the right to be present in the upcoming elections."

The former deputy prime minister said that "Baghdad expects all those supporting terrorism to review its accounts," stressing that "the Iraqis fought terrorist organizations in the field on their own." 

Hussain Ibrahim al-Shahristani is an Iraqi politician born in Karbala in 1942 and a doctorate in chemical engineering who was appointed oil minister in May 2006. He was appointed deputy prime minister for energy affairs in the second government of Nuri al-Maliki and was recently elected minister of higher education and scientific research In the government of Haider Abadi in 2016, but he submitted his resignation from this position later.

ERBIL, Kurdistan Region (Kurdistan 24) – Iran reopened one of its border gates with the Kurdistan Region on Wednesday, over one week after having closed it in retaliation to the Sep.25 referendum on independence, Iranian state media reported.

“After the referendum and changes within the Kurdistan region, our borders with the Kurdistan region of Iraq were closed... today the Bashmaq border is open,” Jahangir Bakhshi, the head of customs for the border crossing, said, according to the Islamic Republic of Iran Broadcasting (IRIB) news agency.

Iran has been one of the regional countries most opposed to the independence vote. Its influence in Iraq manifested most recently in the Iranian-backed Shia Hashd al-Shaabi militia helping Iraqi Forces seize cities in the disputed territories, including the multi-ethnic and oil-rich Kirkuk.

The decision to re-open the Bashmaq border crossing came on the same day as the Kurdistan Regional Government (KRG) offered to freeze the result of the Sep. 25 vote as a step toward resolving its disputes with Baghdad through dialogue rather than military means.

There are three official border crossings between the Kurdistan Region and Iraq: Bashmagh, Parwezkhan, and Haji Omaran.

So far, there have been no decisions regarding the re-opening of the two other official passages, the border gates’ directors told Kurdistan 24 on Wednesday.

Trade between the Kurdistan Region and Iran each year amount to tens of billions of dollars.

Despite having good economic relations with Iran, KRG officials have often accused Tehran of interfering in the internal affairs of the Kurdistan Region and Iraq.

Qassem Soleimani, the Iranian Revolutionary Guards' military commander, visited the Kurdistan Region in the past weeks to convince Kurdish leaders to withdraw from Kirkuk before the Shia militia and Iraqi forces launched their assault on Kirkuk on Oct. 16.

The Kurdish leadership and many US officials have criticized Iran's role in the attack, with some accusing Soleimani of orchestrating the Hashd al-Shaabi and Iraqi forces military incursion against the Kurdistan Region, an accusation the Iranian officials deny.

ERBIL, Kurdistan Region (Kurdistan 24) – The Kurdistan Regional Government (KRG) has offered to freeze the results of the independence referendum and called for all military operations to cease for an open dialogue with Baghdad to begin.

In a statement early Wednesday morning, the KRG stated that due to the grave and dangerous circumstances facing Iraq and Kurdistan, all sides are obliged to act responsibly in order to prevent further violence and clashes between Iraqi and Peshmerga forces.

The KRG has called for the “immediate ceasefire and halt all military operations in the Kurdistan Region,” for Erbil to consider freezing the results of referendum conducted in the Kurdistan Region and urged for “an open dialogue between the Kurdistan Regional Government and Iraqi Federal Government on the basis of the Constitution.”

The KRG's propositions to the Iraqi government and Iraqi and world public opinion were made “in order to fulfill our responsibilities and obligations towards the people of Kurdistan and Iraq.”

“Attacks and confrontations between Iraqi and Peshmerga forces that started on October 16, 2017, especially [Tuesday]'s clashes, have caused damage to both sides and could lead to a continuous bloodshed, inflicting pain and social unrest among different components of Iraqi society,” the statement read.

The KRG added that continued fighting would not lead any side to victory, but rather would “drive the country towards disarray and chaos, affecting all aspects of life.”

Agreed, however, this LAW would have to be voted and passed by the CROOKS in D.C. I doubt they would pass a Law that would put many in Orange at the Grey Bar Hotel. To be sure, " The jails would be full " - much to the delight of the population at large.

But you can steal billions from the citizens, imprison and kill your own people, allow foreign invaders to take over part of your country who then decimate cities, torture, rape and dehumanize the working poor.................and become Vice President without consequence. Hmmmmmmm??? <_<

The Iraqi News Agency of Information (conscious) attributed to the "unnamed political source," saying that the President of the Kurdistan region Massoud Barzani agreed to submit his resignation and the formation of a rescue government, provided that headed by his nephew Nechirvan Barzani, who heads the current government of the region.
