SULAIMANI PROVINCIAL COUNCIL GIVES KRG 15 DAYS TO SEND EMPLOYEES’ SALARY
Iraq, October 25, 2017 

Sulaimani Provincial Council has given the Kurdistan Regional Government (KRG) only 15 days to send the salary of the province’s employees, likewise, it would discuss with Baghdad regarding the issue.

Following an emergency meeting of the council’s members, the head of Sulaimani Provincial Council, Azad Hama Amin, said during a press conference that the KRG’s programs have not included taking care of the livelihoods of the people.

The council has directed several requests to the KRG, Amin added. “We will use our legal rights to begin talks with the central government if [the KRG] does not respond to our requests.”

The head of the council also called on the Iraqi government to provide the province with fuel, saying the KRG has failed to provide the province with fuel after Sulaimani Provincial Council requested it from the Kurdish government in Erbil several times.

Hama Amin urged the KRG to start talks with the Iraqi government according to the constitution.

In February 2016, KRG cut government employee salaries by 15 to 75 percent, depending on position and salary bracket, as part of austerity measures to deal with the ongoing economic crisis.

The KRG’s aim in cutting the salaries of employees, excluding Peshmerga forces fighting the Islamic State (ISIS), security forces and judges, was to reduce expenditures and increase revenue in the region.

3 - Granting direct powers to the governors of the Kurdistan region in the federal budget law and dealing with the provinces of Kurdistan as governorates not organized in a region and not as a federal province in violation of the provisions of paragraph (I) of Article (117) and paragraph (I) of Article (121) of the Constitution.

4 - Paragraph (IV) of Article (126) of the Constitution does not derogate from the constitutional powers of the Kurdistan region by the federal authorities, but that the Constitution to prevent any constitutional amendment individual lead to a reduction of the powers of the Kurdistan region.

Erbil, Kurdistan Region, Iraq (cabinet.gov.krd) – The Kurdistan Regional Government Council of Ministers issued a statement on the draft of Iraq’s 2018 federal budget bill and on statement by Iraqi Prime Minister, Mr. Haider Al-Abadi.

Below is KRG Council of Ministers’ statement

Iraqi Prime Minister, Mr. Haider Al-Abadi, has been stressing that the people of Kurdistan Region are first class citizens and that he will not allow them to be harmed, adding that he will also send the financial dues (salaries) of the civil servants of the Kurdistan Region.

The Kurdistan Regional Government’s Council of Ministers welcomes this initiative to pay the salaries of the Kurdistan Region civil servants who number one million two hundred forty-nine thousand and four hundred eighty-one (1,249,481) and the total amount of their salaries is eight hundred ninety seven billions and five hundred million Iraqi Dinars (897, 500,000,000.00). These numbers are based on biometric registration of all the civil servants and pensioners of the Kurdistan Region. The KRG is ready to make this information available. Below are the details of the numbers:

- 108 billion Iraqi Dinars are for the pensioners.
-  38.5 billion Iraqi Dinars for the salaries of 96,053 families of the martyrs and victims of Anfal campaign.
-  30 billion Iraqi Dinars for the salaries of 159,000 handicapped and Welfare Plan beneficiaries.
-  455 billion Iraqi Dinars for the salaries of 483,307 civil servants, including the police.
-  266 billion Iraqi Dinars for the salaries of 266,465 Peshmerga troops and security forces.

Meanwhile the KRG Council of Ministers requests the Federal Iraqi Council of Ministers not to approve the draft bill of Iraq’s 2018 budget, which was prepared by the Federal Ministry of Finance without the participation of the Kurdistan Region and for the following reasons:

1. For the first time since 2003, the constitutional term “Kurdistan Region- Iraq” has been removed and instead the term “Kurdistan Region Governorates” is used. This is clear breach of Section (1) of Article (117) and Section (1) of Article (121) of the Iraqi Federal Constitution which recognizes the Kurdistan Region and its authorities as a Federal Region that has the right to exercise executive, legislative and judicial powers. So the Iraqi Constitution deals with the Kurdistan Region as an entity not as Governorates or provinces.

2. Reducing the budget share of the Kurdistan Region, which is happening for the first time since 2005, from 17 percent to 12.6 percent is a breach of Section (3) of Article (121) of the Iraqi Constitution which states: “Regions and governorates shall be allocated an equitable share of the national revenues sufficient to discharge their responsibilities … having regard to their resources, needs, and the percentage of their population”. However, since an official census has never been conducted in Iraq, both Erbil and Baghdad agreed to estimate the population of the Kurdistan Region at 17 percent of the total population of Iraq. It is on this basis a similar percentage of federal revenues have been allocated to the Kurdistan Region in all Iraqi Fiscal years. It is worth mentioning here, that the Kurdistan Region has never been given the full amount of this 17 percent due to the annual increase of Iraqi Federal sovereign expenditures, yet without the KRG participating in the allocation and spending of these expenditures or even getting a share of it. That is why reducing the Kurdistan Region share of the Federal Iraqi budget has no constitutional basis and has been decided outside the Erbil-Baghdad joint agreement.

3. Granting direct authorities to the governorates of the Kurdistan Region in the federal budget bill and dealing with the Kurdistan Region as “provinces” not as a Region, is a contradiction to Section (1) of Article (117) and Section (1) of Article (121) of the Iraqi Federal Constitution. Not dealing with the Kurdistan Region as one entity “Region” is a breach of the constitution.

4. Section (4) of Article (126) of the Iraqi Constitution prohibits the Federal Authorities from limiting or reducing the powers of the Kurdistan Region. The Constitution even does not allow any amendment of the Constitution that result in the reduction of the powers of the Kurdistan Region.

5. In addition to the repetition of the same flaws of previous years in the draft budget bill of 2018, now the above mentioned “unconstitutional points” have been added to the bill.

Taking the above constitutional references into consideration and on the basis of Iraqi Prime Minister, Mr. Haider Al-Abadi’s statements of not intending to harm Kurdistan Region people, we ask the Federal Iraqi Council of Ministers to communicate and negotiate with the Kurdistan Region’s Council of Ministers in order to redraft the federal budget bill within the framework of the constitution and a fair allocation of budget to the Kurdistan Region.

KRG welcomes Abadi’s offer to pay Kurdish salaries, costs Baghdad $772m

ERBIL, Kurdistan Region – The Kurdistan Regional Government has welcomed a call by Prime Minister Haider al-Abadi for Baghdad to pay the salary of Kurdish public servants, saying that doing so requires the Iraqi government has to pay 1.2 million people and that will cost Iraq 897.5 billion Iraqi dinars ($772 million).
 
The KRG said in a statement that it is willing to provide the Iraqi government the list of those people who are on its payroll if Baghdad agreed to pay in full their salaries.
 
It also criticized the proposal for the 2018 Iraqi budget which for the first time does not refer to Erbil as the Kurdistan Region, instead choosing to use “the provinces of the Kurdistan.” It said doing so violates the Iraqi constitution recognizing the Kurdistan Region as a federal entity with its own government, legislature and laws.
 
The KRG detailed that it has 1,249,481 people on its payroll, including 455,000 public servants (police forces included), 266,465 Peshmerga and local Asayish (Kurdish security).
 
PM Abadi stated on Tuesday that his government is willing to pay the Kurdish salaries.
 
The Kurdistan Region has been struggling to pay its large employees because of the drop in oil prices, the war on ISIS, and budget cuts by Iraq since 2014.
 
The KRG said it is willing to provide the list of its employees it collected through the biometric mechanism aimed at canceling double salaries and ghost employees. 
 
PM Abadi on Monday doubted the Kurdish Region has hundreds of thousands of Peshmerga fighters, saying it is a small fighting force while many stay at home.
 
He said the Peshmerga must either come under the command of the Iraqi government, or be downsized to a small, local force paid by Erbil.
 
The KRG demanded for the Iraqi government not to approve a budget proposal presented by Baghdad’s finances ministry that “for the first time since 2003 the constitutional term of (the Kurdistan Region-Iraq) has been removed and instead used the term 'provinces of the Kurdistan Region,' ” the statement detailed. It added that this violates Article 117 of the Iraqi constitution that recognized the Kurdistan Region as a federal region with its own government, parliament and judiciary.
 
It said that the Iraqi government trying to deal directly with the provinces of the Kurdistan Region is also in violation of the Iraqi constitution since the constitution recognized the four provinces collectively as one entity.
 
The KRG pointed out that the budget proposal for the first time since 2005 has cut the Kurdish share from its entitled 17 percent down to a mere 12 percent. It added that the KRG and Iraq have since 2005 agreed that the Kurdish population constitutes 17 percent of the Iraqi population, and this remains to be the case unless a census conducted.
 
The regional government stated the Iraqi constitution does not allow the federal government to decrease the constitutional powers of the Kurdish government, nor does it allow the constitution to be amended in this regard.
 
It concluded that PM Abadi has long advocated that every side respect the constitution, and now it is his turn to show in practice that his government will be doing so.

A source in the Parliamentary Economics Committee revealed on Thursday that the draft federal budget law for 2018 is free of allocating job grades to the sectors of the state, with the increase of deductions from employees salaries to 4.8%.

The source, who spoke on condition of anonymity, told Mawazine News that "the budget next year does not include the allocation of job grades in the ministries of the state in fulfillment of the conditions of the International Monetary Fund to stop appointments for the coming years to reduce the number of public servants and to go to the private sector.

The source added that "the ratio of government deduction of the salaries of employees and retirees in the new budget 2018 will reach 4.8%, while the government justified the high costs of military operations and the allocation of funds for the reconstruction of liberated areas," noting that "the proportion of Kurdistan budget will reach 12.67% .

The estimated draft budget bill 2018 total projected expenditures during the next year at 91 billion dollars, an export rate of oil of 3 million and eight hundred thousand barrels per day, including 250 thousand barrels of oil in the Kurdistan region, and 300,000 barrels of Kirkuk oil province.
