ERBIL, Kurdistan Region – The Kurdistan parliament has decided in a majority vote to issue an amnesty to those on death row, reducing their sentence to a mere 15 years in prison, excluding those convicted of serious criminal charges.
 
Convicts who carry the death penalty will have their sentences reduced to 15 years in prison, excluding those who have been convicted of terrorism, threatening national security or murdering women in so-called honor killings, the Kurdish parliament stated following a closed session on Sunday.
 
Following the resignation of Kurdish President Masoud Barzani, the power to impose the death penalty has now been assigned to the KRG Prime Minister, Nechirvan Barzani.
 
The Kurdistan Region, unlike Iraq, rarely implements the death penalty. The last known case in which it had been carried out was in December 2016, when then President Masoud Barzani approved the execution of a man found guilty of raping and killing a female child in the Kurdish city of Duhok.

Shafaq News / Kurdistan Region Parliament voted on the amnesty law by a majority of those present. 

The power to issue an amnesty was transferred to Parliament, while the power to issue a pardon was transferred to the territorial government after Massoud Barzani refused to extend his term of office and to delegate his powers to the legislative, executive and judicial branches. 

A statement by the Kurdistan parliament said all articles in the draft amnesty law had been ratified after some changes had been made to some of its articles. 

He pointed out that the ratification was made by a vote of 62 members yes against 17 members voted against the project. 

The law, which has been ratified, does not include the charges in article 8, including terrorism and crimes that affect public security and those convicted of killing women, the statement added.

Shafaq News / The Presidency of the Parliament of the Kurdistan Region ratified the draft general amnesty law in the province and referred it to the Kurdistan Region Council.

According to examples of the law written in Kurdish, the law included all "inmates and depositors" as well as detainees in accordance with the instructions and provisions annexed to the law.

The law will enter into force after its ratification by the Kurdistan Judicial Council.

ERBIL, Kurdistan Region — Details of the KRG’s proposed reform plans were released on Saturday, outlining equality in salaries, cleaning the list of beneficiaries, preventing duplicate benefits, and pension institutionalization.

 

Prime Minister Nechirvan Barzani “approved a project on reforms in systems of pension, salaries, endowments, grants and other privileges in the Iraqi Kurdistan Region, and then a copy of this decision be submitted to Kurdistan parliament through the region’s minister for parliamentary affairs in order for the project to be debated and decided,” his office revealed on Saturday via a decree dated on December 21.

 

While many of the reforms have been in the works for years, these five objectives formally will be presented to the Kurdistan Region’s parliament.


“Bringing about equality and justice in expending salaries, endowments, grants, other financial privileges in the Kurdistan Region, and stopping irregular beneficiaries in the general budget;

“Cleaning the list of beneficiaries in the general budget from irregularities and cutting down on expenses dedicated for salaries and endowments;

 

“Preventing the [practice of] benefiting from the general budget for more than once; 

 

"Institutionalizing and unifying different directorates and offices of pension in the general directorate of pensioners at the ministry of finance and economy, and activating the pensioners’ box;


“Reorganizing the pensioning of people with high positions and special ranks on the basis of reaching the legal age specified for retirements and number of years of servants.”

The Change Movement (Gorran) and Komal, an Islamist party, announced their withdrawal from the KRG coalition government on December 20.

The Kurdistan Islamic Union (KIU) — the largest Islamic party in the Kurdistan Region — the Kurdistan Democratic Party (KDP) and the Patriotic Union of Kurdistan (PUK) remain in the government.

The prime minister, along with his deputy Qubad Talabani, have spearheaded reform initiatives.

They and their cabinet held a special meeting with the heads of parliament committees to discuss the budget reforms that focus on the salaries that take 70 percent of the KRG’s annual budget on December 13.

Thousands of people began protests on December 18, pouring into the streets in Sulaimani and Halabja provinces condemning lack of services and the continued delay of civil servants' wages from the government. Protests turned violent when demonstrators clashed with riot police and security forces.

The KRG has blamed the economic crisis on budget cuts from Baghdad and loss of oil revenues.

The KRG has not received its 17 percent share of the Iraqi federal budget since early 2014, namely because of disputes over the Kurdistan Region exporting oil to global markets.

Iraq’s draft 2018 budget proposes the KRG receiving 12.6 percent.

KRG Prime Minister Nechirvan Barzani has said the people should realize that the KRG’s revenues “have been slashed by half” since the loss of oil-fields in Kirkuk to the Iraqi federal government in mid-October.

A representative of the International Monetary Fund told Rudaw on December 22 that Iraq's 2018 budget share proposals "do not suffice in our view to cover the needs of the Kurdistan Regional Government.”

According to the agenda of the session, the Parliament of Kurdistan will discuss the following draft laws:

The Secretary of the Council of Ministers of the Kurdistan Region Amang Rahim, announced that the bill "reforms in retirement and salaries, allowances and privileges" will guarantee the rights of peshmerga, employees and retirees.

Rahim added that by legislating and implementing this law, it would eliminate "injustice, illegitimacy, double-pay, retirement, non-profit and non-deserving" phenomenon in the payrolls, pointing out that the rights owed to pensioners, employees and pensioners, who have borne so much, will be guaranteed.

He stressed that this law is more important than everything for people as it is related to salaries and livelihood of people, stressing that the lack of support and support for this project does not tolerate any excuse.

The financial and legal committees have asked through a report that included 4 paragraphs not to make any changes in the allocations and to have a minimum pension of 400 thousand dinars. 
The Parliament of Kurdistan voted on the reform law on retirement and salaries, allowances and privileges in February this year, and because of the emergence of objections to the articles of the law was returned to the Parliament of the region.

The Financial Committee of the Parliament of Kurdistan, on Sunday, held a meeting with the Presidency of the Parliament of Kurdistan in addition to the parliamentary legal committee to discuss the draft law reform in retirement and salaries and privileges and allocations.

A member of the Finance Committee of the Parliament of Kurdistan Shaukat Jawdat said in a press statement that "the meeting discussed the reports of the committees on the draft law reform in retirement and salaries and allowances," adding that "the parliament will determine the date of its meeting on the draft law."

The governing body of the Parliament of Kurdistan called on members of parliament to hold a regular session of parliament on Tuesday. 

According to the text of the invitation, which was signed by Jaafar Iminki, Deputy Speaker of the Parliament of Kurdistan, that according to the provisions of paragraph (2) of Article (17) and the provisions of paragraph (1) of Article (18) of the Rules of Procedure of the Kurdistan Parliament No. (1) for the year 1992, The Presidency of the Parliament of Kurdistan held the first regular session of the spring semester for the fifth year. 

The Presidency of the Parliament of Kurdistan called on all members to attend the session at 11 am on Tuesday, June 26, 2018.

The parliament will meet with the regional government to discuss the latest amendments to the draft law on the reform of salaries and retirement before the vote again.

"The Presidency of Parliament and the concerned committees will meet with the regional government before proceeding with the adoption of amendments to the law on the reform of salaries and pensions," Aminki said in a statement to reporters today in front of the parliament in Erbil.

He added that the Parliament of Kurdistan has made amendments to the draft law in three points has not been notified to the territorial government, saying that he will be informed the government of the three points.

The bill was voted by the Kurdistan Regional Parliament at the end of last February.

The law has been strongly criticized by citizens and activists from Kurdistan on social networking pages to allocate four million dinars as a pension for parliamentarians, prompting him to return to parliament again for an amendment.
