The adoption by the Council of Ministers of the Law (Social Insurance) concerns the political blocs of the possibility of abolishing the institutions of martyrs and political prisoners.
The decision, taken by the Council of Ministers early this August, to demonstrate the beneficiaries of the laws of the victims of the former regime yesterday at the gates of the Green Zone to demand that the decision.
Recent demands have been made for a review of the laws of political prisoners and martyrs, given the privileges described by the beneficiaries.
The Dawa Party bloc, earlier this month, rejected the violation of the transitional laws that were legislated after the fall of the regime. She considered that the loopholes and legislative loopholes in some paragraphs of these laws are "common", and not a justification for the abolition of the law as a whole.
During its regular session on August 1, the Cabinet voted on the draft Social Insurance Law. The council affirmed that the law "will guarantee all workers in the private sector a corresponding pension salary for the pensions of state employees, in addition to guaranteeing the rights of the families of the martyrs to provide a suitable source for their livelihood."
In turn, the parliamentary bloc criticized the law of law, on Saturday, dealing with the victims of the former regime and accused them of looking at them by "Ain Awra."
"The Council of Ministers voted on the Social Insurance Law, which included substantive provisions that would abolish the laws of the transitional justice institutions, specifically my institutions," MP Khalaf Abdul-Samad, head of the State of Law bloc, told a news conference held in the parliament building with the participation of deputies from the province of Basra. Martyrs and political prisoners and victims of terrorism and then cancel all privileges and benefits allocated to those covered by the provisions of these institutions and approved in the Iraqi constitution.
"The government justified its cancellation of these institutions to achieve justice and provide financial resources added to the treasury of the state." He added that his bloc "does not know about any alleged justice intended by the government as it looks blindly at the abolition of laws and institutions that began to raise the voice of the oppressed against the oppression and the overthrow that has been inflicted on them."
The head of the State of Law bloc said that "the government at the same time is keen to provide the large sums of money to kill the people and cadres of the repressive apparatuses dissolved, who colluded with terrorism and paved for him to seize the cities of Iraq through platforms of sedition not known and conspiracies in the dark rooms and in neighboring countries" .
The MP and leader of the Dawa Party said that "the law of social insurance included material and paragraphs in which errors and fundamental errors against the martyrs of all the swords, both in the time of the former regime and political prisoners and martyrs of the popular crowd," and called on the Council of Ministers, "reconsider the social insurance and the cancellation of paragraphs that intersect with Laws of the Iraqi Constitution legislator by the House of Representatives. "
The head of the State of Law bloc stressed that "the institution of martyrs and the institution of prisoners, institutions can not be linked to the law of social insurance in order to achieve justice," calling for "the need to secure the salaries of former regime martyrs and martyrs of the popular crowd and the release of their financial dues in proportion to the size of sacrifices."
At the same time, dozens of families of martyrs and political prisoners demonstrated on Saturday in the Freedom Square near the bridge of the two floors in central Baghdad, demanding their support and full rights. The demonstrators warned against prejudice to the rights of martyrs, prisoners and detainees

So the COM passed this, then it goes to the fools in parliament (who are on vacation for 3 weeks). Let's see how long it takes them to make this law. Since it benefits the hard working, average hourly citizen working the private sector.....they won't be in any hurry. ;)

Parliamentary economic: the law of social insurance faces the obstruction of concessionaires

 Baghdad / Zahraa al-Jassim

The draft law on social insurance collides with political differences and deals before it reaches the parliament, according to the parliamentary committee on economy and investment, which believes that the uproar surrounding it was caused by "some segments of the legislation of this law was affected" The clarity of some of his paragraphs is made around all this controversy, he believes that there is no misunderstanding of the law should be discussed and modify some of the paragraphs with the participation of organizations deployed locally in various fields of economy and law.
The Social Insurance Law provides for insurance for the insured in the public and private sectors and for their successors in retirement cases. It also includes multiple branches of social insurance, including retirement insurance, old age and death, work injury insurance, health insurance, maternity insurance for women The insurance shall also include work disability, provided that the Social Insurance Authority and the Social Insurance Fund are established under the provisions of the law to calculate and fulfill the amounts of the contributions deducted from the insured for 7% of the total amount of the contributions. To be borne by the employer at a rate equal to 13% of the monthly wage of the insured - and the retirement of pensioners' rights.
A member of the Committee on Economy and Investment parliamentary Najib Najib says in an interview for "(to the extent), so far has not been presented the Social Insurance Law on the parliament for the first reading, but in any case, this law is not new, the equipment of its legislation has started since the start of the current government has been formed a committee Local and international experts from the United Nations, adding: "This law according to the economic vision of building the state has many positives, but from the point of view of some of the disadvantages.
Najib stresses that one of his important answers is to find a comprehensive law for all beneficiaries of retirement, both for the government and private sector. This is a very important step because it serves the government steps towards privatization, activating the private sector and non-oil imports and increasing its sources. On the other hand, Or the martyrs and political prisoners, because these segments under its own laws had financial allocations, as some were receiving a salary more than the other under those allocations granted to him, but the social insurance law and the salaries and under that no longer enjoy A financial rights as before.
Naguib said: It is a simple example, the university professor was under the old law is calculated salary pension on the nominal salary according to the certificate with the allocations, but now there are no provisions, on the other hand, the old law was calculated pension on the basis of three-year salary The salary will be calculated under the last four or five years, and in the equation to calculate the salary there is a difference in the salary of the retired and not as the previous, because the salary of retired in the last three years to serve him, for example, the amount of "500 thousand, while The calculation has been made Wrote to the five-year basis in the last job that may be the salary of 400 thousand, the difference will be here, so the hype that I got is the result of damage to some sections of the enactment of this law.
In another example, Najib believes that political prisoners with a salary of 500 thousand or even a million without a pension formula and whose allowances are given an exception, but in this law all their laws have been canceled, which is certainly against their benefit. The law is very good, but unfortunately and because the parliament at the end of the legislative year, the law will collide with many differences and orientations and even political bidding, because those who received the salaries of prisoners and martyrs and university professors will not accept this law, which means that the law will face many difficulties and will not be Easy to pass.
The law of social insurance is very important for Iraq because we are facing a lack of revenue due to the drop in oil prices and the many financial obligations and the real need today is the one who pushed the government to legislate this law, not to mention that the issue of the inclusion of the sector For retirement is a step more historical and will be very influential and will make a big difference in the economy by encouraging private sector work.
For his part, says economic expert Bassem Antoine in an interview with "(of the extent), which emphasizes: The social insurance in all countries of the world granted to citizens in the country that lives, according to pension and social security, and the Iraqi citizen must live from the good of oil under the Constitution which He notes in Article 111 that oil belongs to the people, so every citizen must have a generous pension to live in, so that he does not remain dependent on the government job.
"There are more than six and a half million employees in the private sector. These must be included in this process to enjoy a rewarding retirement that guarantees their lives and the lives of their children," said Antoine. It is not true that someone sits in an office and puts and discusses a law in isolation from the beneficiaries. At a time when civil society should have a voice through organizations that are scattered in various fields of economy and knowledge so as not to be There is an unrealistic understanding of the law must To have an opinion thereon, taking into account administrative and financial matters that are commensurate with the State's revenues.
In Antoine's opinion, the controversy surrounding the law is because of the ambiguity surrounding it. Today, social security and retirement are for employees, and the sums are not all from the government, but are part of the deductions from the employee's salary during his term of office. Previously, these amounts were invested by the state in many fields and they are occupied by mature investment mentality so that the funds are not rigid and the interest is greater. The state must invest these funds, not to take from the person who has the benefits of the job deductions and has the right to retire. , And in this In other words, our objection to the law is only because it needs certain amendments and more extensive discussions.
The media office of Prime Minister Haider al-Abadi, announced last Monday that the government is seeking to develop the Iraqi economy and reform the system of state resources and restructuring the economic sectors important to ensure the drawing of a true economic path based on new foundations Adopting partnership with the private sector and revitalize in a manner that stimulates the economic cycle and helps "The government has taken many important steps in this direction, which have contributed to laying the foundations for an ambitious economic vision and to enhance this government orientation and to boost the role of the private sector."

Comments, corrections and criticisms have always been in the direct and private interests of the Social Security Law, which is legislated by the executive and has not been voted on, although it is very important.
This law, in order to stand on its feet and emerge from its stage and ensure its success and economic and social interaction, requires the availability of factors that support and fit it. Those who are usually addressed by those who have privileges and special allocations or who have no service as defined by the law. This opposition is not easy because it reflects a segment that is not limited In the legislative resolution.
In general, the law is fair to the regular employee who is accustomed to the traditional ways of dealing with the civil service in its reward and punishment. It is the prevailing and the most important of the law and the safety of the application. Therefore, it is necessary to establish support and supports and suitable ground through the following proposals: First, activate the system of punishment and reward and sanctify it from the bonus to the reward and promotion With objective reasons established as instructions for accountability and objection from the concerned parties, because it is about the discharge and performance of the work of this margin ensures the flow of work and ensure the success of the departments that are managed by the budgets that now range between profit and loss.
And second, the unification of the instructions in terms of allocations and gravity so as not to be a sense of injustice among workers, which hinders and distorts performance, which multiplies the traditional loss that hit most of the departments is the slack of the job that absorbs production and performance and traditional labor values; and the third point the existence of the Service Council is necessary to unify the civil service system from During the social insurance law so that he can consider the instructions and laws and the foundations adopted and multiple now in the departments of the state and the comprehensive decision without exceptions and pressures and powers unusual.
IV Limitation of responsibility to the Director General or the special class will attract a lot of manifestations of slack powers appropriate to achieve the objective of the Department set by the ministry or other bodies not associated with the Ministry.
Fifth, the need for a program of government departments that takes into account the economic feasibility of achieving the goal.
Sixth, the social security law must be activated for all segments of the private sector. This sector should be set up to set criteria for its success to pay the employees' dues and guarantee them by paying the full contribution from the salary of the employee or employee and we are in market unemployment.

  • yota691 changed the title to The Secretariat of the Council of Ministers announces the adoption of the draft unified social insurance law

BAGHDAD /
The General Secretariat of the Council of Ministers announced on Sunday the adoption of the draft unified social insurance law for the public and private sectors.
"The task of reform in the area of retirement is one of the most difficult areas of reform in any country. This requires a long-term process in light of the political and technical challenges. Iraq has taken the first and most important step in its history," the secretariat said in a statement. This reform was issued when the unified retirement law No. 27 of 2006 amended the basis for the integration of the retirement scheme in the public and private sectors.

"Despite the significant challenges faced by Iraq, there has been continued pressure to move to the system of allocated benefits that effectively affect the financial sustainability of the pension system as well as the vagaries of the political environment and difficult security conditions as Iraq faces a major challenge in moving towards a pension system consistent with Good international practices, taking into consideration the social preferences, the specific circumstances of Iraq and what has been achieved and what path it will take in the medium and long term to ensure the aging of its entire population. "
"The pension system in general contains many disadvantages, such as the existence of a dual system of retirement and large disparities as the system does not encourage the movement of labor and exacerbate the differences between the public and private sectors," indicating that "does not support the existence of mechanisms for the transfer of benefits fully across the two sectors Public and private sectors and reduce the availability of employment in the private sector with the difficulty of privatizing state-owned enterprises because of the fear of the fate of its employees, and this leads to the reduction of welfare and impede the allocation of adequate human resources and sacrifice rights or benefits in the case of the transition from sector to sector.
"The Iraqi government adopted the draft unified social insurance law for the public and private sectors and the following principles were adopted in the draft law approved by the Council of Ministers namely justice, equal, sufficient, flexible, financial sustainability."
"The deletion of exceptions and reliance on a unified equation for all employees of the state and workers in the private sector, we find within the draft law to stimulate the labor market in Iraq, and spread the principle of non-reliance on the State in employment with the possibility of transition between the two sectors to ensure the revitalization of the economic sectors of the country and reduce reliance on oil As a major source of state revenue ".
She pointed out that "the most important features of the draft law is the inclusion of social insurance branches all provided for in the laws and regulations of the International Labor Organization and the World Bank, which was not insured in Iraq previously, such as maternity insurance and insurance and unemployment insurance and voluntary insurance and the informal sector.
She stressed that "the draft law guarantees the extension of pension coverage in Iraq through the introduction of workers in the private sector and entrepreneurs, companies and individual entrepreneurs under the umbrella of social insurance to ensure a decent living for them and their families."

More than 6 million Iraqi workers in the private sector are looking for approval by the House of Representatives for the new social insurance bill after it was approved by the government at the end of last year, which includes all workers in the country.

"The number of workers in the private sector now stands at more than 6 million, about 200,000 of whom are registered under the Social Security Law," said Mohammed Saleh, the prime minister's adviser on financial affairs.

Saleh added that "the Iraqi government approved a new draft law on behalf of social insurance in the private sector, in accordance with the new direction of the social market economy," explaining that "the new legislation, which is expected to be passed by parliament gives private sector workers the right to social security (pensions).

"Private sector pensions will depend on the percentage of monthly contributions for the same worker, but in any case salaries will not be below the poverty line minimum of $ 2.5 per day," he said.

On the future plans and strategies to support the private sector, he explained that "the private sector strategy 2018-2022, aims to raise the volume of investment in the private sector from 34 percent now to 40 percent, with government investment constituting 60 percent."

Iraq, through the draft new social insurance law, seeks to establish a pension fund working in the private sector and equalize with retirees of employees (public sector).

This depends on the state's support for the fund. The salaries of workers in the private sector amount to 270,000 dinars (about 210 dollars), while the state pensioners pay pensions to some of them to one million dinars (900 dollars).

The World Labor Day coincides with hundreds of workers in government institutions holding temporary contracts to strike because they have not been paid.

Since the beginning of April 2018, hundreds of daily wage workers in Iraqi Ministry of Electricity companies in the governorates of Diwaniyah, Najaf, Karbala, Babil, Baghdad, Basra, Maysan and Nasiriyah have resorted to a strike due to non-payment of their dues.

For his part, a member of the trade union movement in Baghdad, Yasser Kazem, Anatolia, said that "more than 200 thousand workers in the system of daily wages working in the majority of Iraqi ministries are still unknown."

"Some of them have resorted to a strike after their monthly salaries, which do not exceed 250 dinars ($ 200), have been suspended from the institutions where they work, on the pretext that the government has ordered them," Kazem said.

He pointed out that "200 thousand workers in the system of daily wages, and those who spent years in the work, requires the government to redress them and turn them into permanent employees."

The Iraqi government has introduced a new amendment to the daily wage system, as part of the increase in their monthly salary rates, while calculating the length of their work for retirement.

In turn, the spokesman of the Ministry of Labor and Social Affairs, Ammar Menem, Anatolia, said that "the Ministry of Labor and Social Affairs was able to raise the monthly salaries of workers with daily wages of unskilled labor from 250 thousand dinars to 350 thousand Iraqi dinars (290 dollars).

"The implementation of the increase will begin with the start of the 2018 budget funds," he said. "The worker's daily wage service was also calculated for retirement purposes."

On the problems faced by some workers in the system of daily wages on the receipt of salaries, among Menem, "The allocations for employees of the system of daily wages disposal of the investment budget, through the implementation of projects, and because of the suspension of many projects, whether for security or financial reasons, "
