yota691 Posted August 10, 2017 Report Share Posted August 10, 2017 Baghdad orders arrest of 15 lawyers 10/8/2017 Right now - agencies 7:47:26 PM The Iraqi authorities have issued orders to arrest 15 private lawyers on charges of belonging to the terrorist organization Da'ash and working in the city of Mosul before being released from his grip on July 10, Human Rights Watch said Thursday. "The lawyers represented a number of suspects from a sympathetic organization facing trials in Iraqi courts," the New York-based organization said in a report posted on its website. "Since the arrest warrants have been issued, lawyers in the country have stopped taking any defendant's cases by belonging to Daish, and they are only handling the cases of those who are convinced of their innocence," the lawyer told the organization. "As a result, state-appointed lawyers have become those who believe they belong to the organization." Sarah Leah Whitson, Middle East director at Human Rights Watch, said the Iraqi authorities should immediately explain why they issued arrest warrants and "should make clear that Iraqi lawyers should not feel intimidated by the defense of suspects." And demanded that Baghdad ensure the rights of the 15 lawyers to obtain due protection and fair trials. The report quoted a senior judge (unnamed) that the court is considering about two thousand cases of affiliation or association with the organization. The judge pointed out that his court "gathered evidence, including witness testimony, indicating that 15 defense lawyers, representing the suspects suspected of belonging to the court, were working as lawyers in the organizational courts in Mosul." Any person who commits, instigates, plans, finances or assists in the commission of a terrorist act is sentenced to death by the Iraqi Anti-Terrorism Act (No. 13 of 2005) and provides for life imprisonment for anyone who hides this act or for harboring those who participated in it. Article 14 of the International Covenant on Civil and Political Rights, ratified by Iraq, states that every person accused of a crime has the right to defend himself by a lawyer of his choice and to give sufficient time and facilities to prepare his defense and to communicate with counsel of his own choosing. Where the organization said in a statement that the arrest warrants were issued against 15 lawyers from the city of Mosul on charges of belonging to the organization urging the terrorist. The agency's Middle East director, Sarah Leah Whitson, asked the Iraqi authorities to explain why they issued arrest warrants and should make it clear that Iraqi lawyers should not feel intimidated by the defense of suspects.
