Couldn't agree more.  If indeed this is their version of the FDIC, it might be the last barrier (other than an RV/RI) to convincing the public, AND outside investors to trust the Iraqi banks - as I believe all the hoopla over the ISO announcement.  Good call.....

The effects of the House of Representatives to include freedom of expression, assembly and peaceful demonstration law in its agenda and put to the vote a sensation by activists and civil society organizations, the Council called for a wait-and-drag it to modify it.

The Iraqi Council of Representatives decided on Thursday to postpone the vote on the draft freedom of expression, assembly and peaceful demonstration law.

He noted that "the postponement came at the request of the committees (legal, human rights, security, defense, culture and information, Awqaf and Religious Affairs)."

Said a member of the Commission on Human Rights Achaouk Dry "The Commission on Human Rights today will submit a request to the Presidency of the Council of Representatives to postpone the vote on the draft freedom of expression, assembly and peaceful demonstration law", stating that "it came at the request we received yesterday from civil society organizations to wait to vote ".

For her part, head of the Hana Edwar hope that the politicians want to pass on a law restricting the freedom of citizens to protest and organize demonstrations and public meetings.

She explained that "the draft law has been manipulated serious form, especially as we have agreed previously with the Commission on Human Rights on him to write off everything that has to do with a bayonet expression received an absolute in the Constitution and the only text on the organization of freedom of assembly and peaceful demonstration."

The Presidency Council

Issued the following law:

No. () 2017

Freedom of expression and assembly and peaceful protest law

Chapter One

Definitions and objectives

Article 1 is intended for the purposes of the following expressions of this law meanings indicated opposite thereto:

First, freedom of expression: the freedom of the citizen to express his thoughts and opinions orally, in writing, photography or any other appropriate means without prejudice to public order or public morals.

Second, the right of knowledge: the right of citizens to obtain information Eptgaha from official authorities in accordance with the law, especially information concerning its substance and any decision or policy concerning the public.

Third Special Meeting: The meeting which will be attended by invited personally if held in place.

Fourth General Meeting: The meeting to be held in a public place or a special and be available for all attendees.

Fifth peaceful demonstration: gathering an unlimited number of citizens to express their opinions or claim their rights guaranteed by law regulating and moving in roads and public squares.

Sixth electoral meeting: the meeting that the purpose of which definition candidate for the purposes of electoral propaganda is during the period prescribed by law.

Article 2 This law aims to regulate and ensure freedom of expression by all means, freedom of assembly and peaceful demonstration and the right to know what does not violate public order or public morals and to identify those responsible for the organization.

Chapter II

Freedom of expression

Article 3 of the first ministries and departments not associated with the Ministry set up an open database of the public to be able to see it, and its dissemination of information on the progress of their work.

Second, the UN High Commissioner for Human Rights is concerned with the Foundation Law No. (53) of 2008 to decide on citizens' complaints of administration decisions to withhold information about them and after checking her complaints to ask the relevant department to provide citizens with the required information if requested by agreeing to the law

Article 4 of this law guarantees freedom of scientific research through scientific experiments and the use of necessary means to search and conditions, as to ensure the free dissemination of the products of scientific activities.

Article 5 prohibits Mayati:

First propaganda for war or terrorist acts or national hatred, racial or religious or sectarian.

Second appeal of religions, sects and denominations and beliefs and detract from that or would adherents

Chapter III

Freedom of assembly

Article 6 First: citizens freedom of private meetings and without the need for prior permission is prohibited and the security men to attend these meetings.

Second, this law provides for freedom of election meetings

Article 7 of the first citizens of the freedom of public meetings after obtaining prior permission from the head of the administrative unit before (5) at least five days that includes a request for permission to the subject of the meeting and its purpose and the time and place of his contract and the names of the members of the organizing committee for him.

Second, the Commission provided for in item form (i) of this article from the chairman and two members at least if there is no formation of the committee, it is the problem of members installed named in the request for authorization, the Commission is responsible for the good organization of the meeting and to meet the legally prescribed obligations and maintain the meeting and be in coordination with Competent authorities .

Third, if the head of the administrative unit rejected the request of the general meeting was held, Fflerias the organizing committee of the meeting may challenge the rejection decision before the competent court of first instance and by the chapter in which a matter of urgency.

Fourth of rejection decision in accordance with the item (iii) of this article to the organizers of the public meeting or to one of the applicants before the date of the meeting b (24) twenty-four hours at least and are reported ways specified by law.

First Article 8 is not permitted to force one to participate in a general meeting.

Second, the general meeting may not be held in public roads.

Third, it is not permitted to be extended to the general meeting for after ten o'clock at night.

Fourth in the combined general meeting of the right to raise the banners and slogans and making statements it is contrary to public order or public morals to the media.

Article 9 prohibits Mayati:

First of public meetings held in places of worship or schools or universities or state departments unless the lecture or discussion meeting will be held for it concerning the purpose of which allocated those places.

Second, carrying a firearm and tools of all kinds of prey or sharp, or any other material harm the Balanevs or property at the meeting.

the fourth chapter

Freedom of peaceful demonstration

Article 1. First of citizens to demonstrate peacefully to express their opinions or claim their rights guaranteed to them by law in accordance with the conditions specified in Article 7 of this law.

Second it is not allowed to organize demonstrations before seven o'clock in the morning or after ten o'clock at night.

Chapter V

General and Final Provisions

Article 11 First, the security authorities are responsible for providing protection to the demonstrators gathered or if the meeting or demonstration had been organized in accordance with the provisions of this law, and may not use force to disperse demonstrators gathered or only if this led to the destabilization of security or causing damage to persons or property or money.

Second, in the event of damage to physical or material in persons or property or money due to public meetings and demonstrations, the originators of the damage are responsible for compensation, either if it can not be guided by the knowledge of the perpetrator, the the victim to claim compensation for the damage that injury according to the law does not prevent it from moving the criminal case on the actor.

Article 12 is not permitted to put restrictions on the rights and freedoms set forth in this law, but based on the requirements of public interest or Maakhal public order or public morals.

Article 13 First shall be punished by imprisonment for not exceeding (10) ten years each of deliberately broadcast propaganda for war or terrorist acts or national hatred, racial or religious or sectarian.

Second, it shall be punished by imprisonment for a term not less than (1) one year and a fine of not less than (1,000,000) million dinars and not more than (10,000,000) ten million dinars each of:

A attacked in one of the ways of publicity on the belief of a religious denominations or blackguard rituals.

B deliberately interfere with the establishment of the rites of a religious sect or a religious ceremony or meeting or deliberately prevent or disrupt its establishment.

C vandalized or damaged or disfigured or desecrated the building is ready to set up a religious ritual or a symbol or something else has religious sanctity.

D print and publish a sacred book about a religious sect in which a character text deliberately distort and alter its meaning or underestimated by virtue of its provisions or its teachings.

Its publicly insulted Nasca or a symbol or a person subject of sanctification or glorification or respect for the religious community.

And imitated publicly Nasca or a religious ceremony with a view to ridicule him.

Article 14 Penal Code applies (111) of 1969 in all the special provision in this law did not respond.

Article 15 shall be repealed is the Coalition Provisional Authority (dissolved) No. (19) in 10.07.2003 (freedom of assembly).

Article 16 The Minister of Interior in coordination with the Minister of Human Rights and Minister of State for Civil Society Affairs and Chairman of the High Commissioner for Human Rights to issue instructions to facilitate the implementation of the provisions of this law.

Article 17 of this law shall be from the date of its publication in the Official Gazette.

Reasons

In order to draw a mechanism to ensure that freedom of expression by all means, freedom of assembly and peaceful demonstration and the right of knowledge without prejudice to public order or public morals and to identify those responsible for organizing and punishing offenders.

I agree about the Depositor insurance, could be the last piece of the puzzle to get the tired and bewildered citizens to trust enough to deposit the newly valued notes they have tucked under the mattress in the state and private banks! Would also go a long way to prove to the international investors that they have security and stability...... Suddenly?!

House of Representatives voted in its sixth ordinary of the legislative term first fourth legislative year, which was held under the chairmanship of Dr. Salim al-Jubouri, President of the Council and in the presence of 184 deputies on Thursday 20/7/2017, the Council of State law and give confidence to members of the Board of Commissioners of the High Commissioner for Human Rights, while finished reading two laws.

At the outset of the meeting, the Council voted in principle to the recommendations submitted by the MP Haider Alfoada regarding loyalty to the martyrs and the wounded to address the problem of housing, education, health prevention and the provision of services of all kinds to the families of the martyrs and the wounded and elements of the security forces, the police, the army and the crowd popular tribal and Peshmerga through the construction of housing units each bearing the name of the province (residential project to meet) the martyrs and the wounded that the government allocate the necessary funds to implement the project as well as quick and Ptoukitat about the importance of stimulating the international community to contribute to housing projects and opening the door of donations inside Iraq and the formation of a committee of the Council of House of Representatives to follow up the implementation of the recommendations.

The Council voted on the members of the Board of Commissioners of the High Commissioner for Human Rights as they both Mr. dominated Rashid Zidane and Ms. Basma Mahmoud Mustafa and Mr. Thamer Yassin Abdullah and Mr. Ali Akram Zainal Abidin and Mr. Bright Naji Abboud and Ms. Unit Mahmoud Fahd and Mr. Ali Abdul Karim Mazer and Mr. Fadel Abdul-Zahra Abbas and Mr. Aqeel Jassim Ali and Mr. Zeidan Khalaf Obaid Amer and Mr. Paul Zia and Ms. Faten Abdel Wahid Abbas Aedaoua counties, as well as Ms. Brewin Mohammad Amin and Mr. Anas Akram Mohammed and Mr. Faisal Abdullah Badr Aedaoua reserve.

Ladies and Gentlemen, then members of the Board of Commissioners of the High Commissioner for Human Rights was sworn in.

President al-Jubouri, and thanked the Commission for Human Rights and the Committee of Experts on the Mapzloh effort throughout the entire year to provide the names of the candidates for the Human Rights Commission.

 

The Council voted on a draft State Law Council and submitted by the Legal Committee pursuant to the provisions of Article 101 of the Constitution and the independence of the administrative judiciary from the executive branch and make the State Council, an independent body with the moral personality which includes the administrative judiciary and the courts eliminate staff and administrative Supreme Court is separated in the cases before it impartially and independent councils, similar to the state in the civilized countries to lift the State Council link from the Ministry of Justice and renamed to replace the State Council in line with the Constitution.

 

The Council postponed the vote on the draft freedom of expression and assembly law and the peaceful demonstration and submitted by the legal committees, human rights, security, defense, culture, media and religious affairs to next Monday

The Presidency also postponed voting on the draft provincial councils and districts and submitted by the legal committees and provincial elections law and governorates not organized in a region to the first of the month of August next.

 

The Council resumed voting on the draft reform of inmates and depositors and submitted by the working committees of social and legal choosy, security, defense and human rights law, where voting has been completed on the 37 articles in the draft law out of 54 articles.

 

Council's first reading and completed the project accession of the Republic of Iraq to Minameta mercury convention and submitted by the Committee on Foreign Relations Act, which came to control and reduce the risk of mercury and its effects on the environment and human health from emissions of human and releases origin of mercury and its compounds and the transfer of best available techniques in all mercury from its products and trafficking by contaminated sites and storage style from the experiences of countries in order to join the Republic of Iraq to the Minamata Convention on mercury.

 

The Council postponed the first reading of the draft election law and the House of Representatives submitted by the Legal Committee until agreement is reached to provide a mechanism to deal with draft laws and proposals.

 

The Board completed reading the report and discussion of the draft law of irrigation and submitted by the Committee on Agriculture, Water and marshes.

In the interventions of Ladies and Gentlemen, the House of Representatives MP Riad Ghareeb he stressed the importance of the legislation of the law to prevent overtaking on water quotas and minimize the damage chip farmers.

She called MP Huda Sajjad to put deterrent penalties for violators and reach water quotas to all provinces, central and southern private.

He stressed MP Aziz Ugaili on the need to establish strict controls for the distribution of water quotas in the southern regions of Iraq to avoid problems.

I suggest MP Mutashar al-Samarrai severe punishment against squatters on water quotas and the use of modern techniques in irrigation to ensure that no access problems in the distribution of water.

In response to the interventions, the Committee on stressed that the draft law in line with the Iraqi Constitution with regard to justice in the distribution of water quotas.

 

Then decide to adjourn the meeting on Saturday 22/7/2017.

Council of State Law

In the name of the people Presidency Based on what passed the House of Representatives and approved by the President of the Republic based on the provisions of item (i) of Article (61) and item (iii) of Article 73 and Article 101 of the Constitution.
Issued the following law: No. () for the year 2017 Law Council of State Article
1 shall be established in accordance with this law, the Council of State, specialized functions of the administrative judiciary, advising, drafting, and is an independent body with the moral personality represented by the Council and is chosen by the Presidency of the Council to be among the advisers it shall be appointed according to the law.
2. The provisions of Article-State Consultative Council Law No. applicable (65) of 1979, the State Council provided for in
Article (1) of this law. And replace the label (State Council) replaced (Council of State) wherever mentioned in the legislation.
Article-3 I. obligations and rights of the State Council transferred to the founding of the State Council under this law, and the movement of its courts, management and its affiliates and funds to the State Council. II. All of the assets allocated to real estate and personal property transferred to the State Council, or were at his disposal, and recorded in the name of the State Council.
Article-4 is the President of the State Council, the competent minister stipulated in the legislation expires.
Article-5 of the State Council an independent financial budget financed from the general budget of the state.
Article 6.-The Ministry of Finance separation between the budget of the State Consultative Council of the current fiscal year by the Ministry of Justice after the re-allocated in the light of the needs of the State Council for the remaining period of the year.
Article-7 delete the reference to the (Minister of Justice), wherever mentioned in the legislative texts related to the work of the Council, and replaced by (President of the State Council).
Article-8 of this law is implemented from the date of ratification by the President of the Republic. The Council voted on the members of the Board of Commissioners of the High Commissioner for Human Rights as they both dominated Rashid Zidane and Ms. Basma Mahmoud Mustafa Thamer Yassin Abdullah Ali Akram Zainal Abidin and bright Naji Abboud and Ms. Unit Mahmoud Fahad Ali Abdel Karim Mazer and Fadel Abdul Zahra Abbas and Aqeel Jassim Ali Zeidan Khalaf Obaid Amer Polus Zia and Faten Abdel Wahed Abbas are members of the group, as well as Berwin Mohamed Amin, Wans Akram Mohammed and Faisal Abdullah Badr reserve members.

President Jabouri thanked the Human Rights Committee and the Committee of Experts for their efforts over the course of the year to submit the names of the candidates to the Commission on Human Rights.

The Council postponed the first reading of the draft law on the election of the House of Representatives and submitted by the Legal Committee until the agreement to provide a mechanism to deal with the draft laws and proposals. 
A report and discussion of the irrigation bill submitted by the Committee on Agriculture, Water and Marshlands was completed. 
In the interventions of deputies MP Riad Gharib stressed the importance of legislation to prevent the law to bypass water quotas and reduce the damage to the peasantry. 
She called on MP Hoda Sajjad to put deterrent penalties for violators and access to water quotas to all governorates, especially central and southern. 
MP Aziz al-Ugaili stressed the need to establish strict controls for the distribution of water quotas in the southern regions of Iraq to avoid problems. 
MP Mutashar al-Samarrai suggested tightening the punishment for those who exceeded water quotas and using modern irrigation techniques to ensure that there were no problems in water distribution.

The House of Representatives voted in its session today, chaired by Salim al-Jubouri, Speaker of the Council and in the presence of 184 deputies, on the Law of the Council of State and granting confidence to the members of the Board of Commissioners of the High Commission for Human Rights. 
At the outset of the meeting, the Council voted in principle to the recommendations submitted by the MP Haider Alfoada regarding loyalty to the martyrs and the wounded to address the problem of housing, education , health prevention and the provision of services of all kinds to the families of the martyrs and the wounded and elements of the security forces , the police, the army and the crowd popular tribal and Peshmerga through the construction of housing units each bearing the name of the province [Wafa housing project] for the martyrs and the wounded that the government allocated the amounts necessary to implement the project and the timing of rapid as well as the importance of motivating the international community to contribute to housing projects and open the door of donations within Iraq and the formation of a committee of the Council Deputies to follow up the implementation of the recommendations. 
President Jubouri and the Committees of Martyrs and Finance to follow up the implementation of the recommendations with the relevant government agencies.
