The political stances in Baghdad coincided a day after the Iraqi parliament passed an amendment to the election law that requires the Electoral Commission to manually count and count. The Commission rejected the new law and decided to appeal it. At the same time, Prime Minister Haider al-Abadi, the investigation of the explosion of weapons cache in one of the Husayniyat in Sadr City, east of Baghdad yesterday, and held «outside the security services» legal and judicial responsibility.

The Iraqi political scene seemed more complicated than ever before. The Iraqi judiciary began to put the election commission on the table and to withdraw the powers of the judicial committee competent to hear appeals under the Third Amendment Law of the Elections Law. "The Judicial Council has decided to form a committee from the head of the public prosecution, the head of the Judicial Supervision Authority and one of the judicial supervisors to immediately move to the Electoral Commission building in preparation for the implementation of the task assigned to it," the Supreme Judicial Council's spokesman, Judge Abdul Sattar Birqdar, said in a statement.

On the other hand, the Electoral Commission rejected an amendment to the electoral law issued by the parliament yesterday, including the cancellation of results abroad, and force the Commission to conduct the counting and sorting manually under the supervision of a judicial committee commissioned. According to a statement issued by the Board of Commissioners that the Commission will use its legal right to appeal the third amendment to the electoral law, the Federal Court, because it contains constitutional violations, and in contradiction with the law of the Commission.

The Federal Court has received previous appeals from the Commission and the Presidency of the Republic on the decisions issued by the government and parliament, but have not responded to them so far.

The positions of the political blocs, especially the Kurdish ones, varied over the new law. While six Kurdish forces supported the amendment of the parliament, joining Arab parties such as the "state of law", "patriotism", "decision" and "victory", the two main Kurdish parties completely rejected the law and declared their intention to challenge it. "Al-Fath" is conservative about the law, but without declaring the appeal.

On the other hand, and «on the background of the crime of storing ammunition in a densely populated area of Sadr City from unauthorized parties, which led to the explosion and the deaths of innocent civilians», «the Prime Minister and the Commander-in-Chief of the armed forces orders immediate to the Ministry of Interior to investigate the incident, And take deterrent legal action against the perpetrator of this crime ».

A statement issued by the office of Abadi said yesterday that he authorized the security forces to launch "large-scale search campaigns inside and outside cities to confiscate arms and ammunition stores belonging to bodies outside the responsible security services, and to hold them responsible for the legal and judicial, and to prevent any weapon outside the state, To the risk of being held accountable by law. "

A storehouse of equipment and weapons exploded inside Husseiniyah in Sadr City, leaving dozens dead and wounded, and led to the demolition of about 15 houses in the vicinity of Husseiniya. No one claimed responsibility for storing the weapons, nor did the security services charge them. The sources confirm that the weapons belong to one of the armed factions active in the city, while other sources indicated that the weapons belong to the organization of the "Saraya peace" of the Sadrist movement, but the leader of the movement, Moqtada al-Sadr immediately issued a statement confirming the formation of a commission of inquiry into the causes of the incident.

"It is certain that a number of UNHCR officials and board members will end up in prison, either for evidence and documents relating to financial bribery or bias of political entities, or because of corrupt equipment purchased for electronic voting, which is found to be inappropriate and inaccurate, That the price that was calculated on the government multiplied by the real price several times.

Security personnel in UNHCR were withdrawn and replaced by others, in accordance with the procedures of the Higher Judicial Council, which also imposed a ban on politicians and officials from UNHCR headquarters and offices.

In this context, a member of the alliance, "victory", which is led by the current Iraqi Prime Minister Haider Abadi, "The recent parliamentary decisions will change a lot of the form of the new parliament, and some of the faces that have risen to parliament will emerge from it, and vice versa, there is lost will return to Parliament winner With seats that qualify him, most notably the current parliament speaker Salim al-Jubouri. "

For his part, said the leader of the coalition, "State of Law," Saad Almtalibi, "that more than half a million votes will be counted in the new phase, after being neglected by the Electoral Commission for technical considerations."

"We have 25 seats and we are currently working with the other blocs to form the majority government that we are seeking to achieve," said Muttalibi, who is in charge of re-counting and referring the commissioners to the Integrity Commission to restore the sanctity of the elections and confidence between the citizen and the political process.

He added that "the election results change does not matter, and I hope that the detection and manual counting of some of the fraud in the recent elections," noting that "counting and sorting will be counted half a million ballot papers were neglected due to technical errors suffered by electronic devices, Election and its connection to sealing ".

"Najjar: the results of the Alliance Suron will not be affected"

For his part, said a member of the alliance, "Asron," Hussein al-Najjar, "The stage of counting and sorting by hand and those who maintain it, they have to be careful about the votes of voters, but I ask where was this rejection of the deputies, when we were demonstrating in the squares of Baghdad to demand the need to change the Electoral Commission In accordance with the new system, relying on independence and efficiency? And why our voices did not hear the House of Representatives? ", Pointing out that" the corrupt stood in front of our demands to amend the Electoral Commission, and they have lost the elections and went to amend the election law to benefit from it commensurate with their ambitions.

He said that "the results of Alliance Suron will not be affected, and will remain the winner of the highest votes even after the announcement of the results of counting and manual sorting."

In turn, explained the legal expert Ali Tamimi, that "the outputs of the House of Representatives on the re-counting and sorting by hand is not wrong, which is legal and effective from the date of voting in the House of Representatives," pointing out that "Parliament replaced the Board of Commissioners with nine judges, and will be supervisors of the elections only , And not administrators, and in each province there will be a judge. "

He added that "the Iraqi Council of Representatives is entitled to vote on other issues in the coming days, because it is still working according to the law, and powers expire at the end of this month."

The biggest bloc negotiations have stopped

In a related context, the leader of the Iraqi civil movement, Ahmed Salam al-Mayahi, said that the decisions of the parliament "hit the negotiations between the political blocs paralyzed, as it stopped during the past hours completely," noting that "the abolition of the votes of voters in the Diaspora, as well as the voices of displaced, And sorting, may result in the rise of blocks and other descent, which may restore the map of the priorities of the political blocs among them.

"We are talking about 15 to 20 deputies will be removed from the list of winners, while others will go losers instead of them," he said, wondering, "But what about manual counting and counting, how will appear uneven and how much will be revealed from fraud?

"The time is longer and there is a lot of waiting and negotiation between the blocks, it is unlikely to end the current tangle before the end of the month," he said.

Right and the picture of those millennials with a pile of paper ballots looks sooo much more organized than a messy electronic system. Im Sure that they will be waaay more accurate than the stupid electronic voting machines, and way less subject to corruption cause everybody knows that voting machines are not to be trusted. You know, like the politicians!?:rake:

The Supreme Judiciary: Canceling the results of the elections is not our prerogative and those who claim to falsify provide evidence

Doc-P-161105-636637955334116795.jpg

The Supreme Judicial Council (SJC) said on Tuesday that the cancellation of the election results is not its prerogative, calling on those who claim falsification of the results to submit evidence.

The Council said in a statement received by "Al-Ghad Press" a copy of it, that "the jurisdiction of the judiciary of the elections is determined by the text of Article (8) of the Electoral Commission Law No. 11 of 2007 and its summary in the event of the conviction of those who participated in the elections, The Board of Commissioners, whose decision is either positive or negative, according to the evidence provided by the complainant. If the complainant is not satisfied with the decision issued by the Board of Commissioners, he shall challenge it before the Electoral Commission under Article 8. Within 10 days from the date of referral of the appeal And this method to object to the election results is the only method provided by the law of the Electoral Commission No. 11 of 2007 and can not be bypassed to another method because there is no legal basis for the judiciary based on him in that " .

"There is no provision in the law that gives the judiciary the authority to take a general decision to cancel certain results either inside or outside Iraq as required by some, as there is no provision in the law giving the judiciary authority to ask the Commission to re-calculate a certain percentage of the election results.

He added: "As is known to all that the judiciary issued decisions based on texts in the law allows him to issue a decision in a certain direction and without these texts can not take an absolute decision based on information is circulated in the media or just to satisfy a certain wish with reference to the House of Representatives is the law Article (5) of this amendment stipulates the cancellation of Article (38) and that the process of counting and counting using the acceleration of electronic results and thus the House of Representatives canceled under this amendment the process of manual counting and sorting " .

As for the allegations of forgery, he stressed that Article 8 of paragraph 1 of the Electoral Commission Law No. 11 of 2007 provided for the "exclusive authority" of the Board of Commissioners regarding the referral of any criminal case to the competent authorities if there is evidence of misconduct in the fairness of the electoral process. All respect this legal text and apply it strictly and not be allowed to anyone who was violating it. "

He added that "in the event of a complaint of forgery attributed to the Board of Commissioners, this requires the review of the alleged to the competent investigating court to provide evidence to prove the existence of forgery and attributed to the person who did it and then take the appropriate decision on the person who committed the crime of forgery in accordance with the provisions of the Penal Code Which is punishable either by imprisonment or imprisonment for the perpetrator of the crime. "

He explained that "the number of complaints submitted to the Board of Commissioners regarding the objection to the election results amounted to (1881) complaints either appeals to decisions issued in those complaints, which reached the judiciary until 4/6/2018 amounted to (1221) will be resolved during the legal period of (10) days from the date of referral to the judiciary.

Between "As for the rest of the remaining appeals, the judiciary is waiting to be referred to it by the Board of Commissioners to be resolved within the legal period, ie 10 days according to the text of Article (8) paragraph VI of the Electoral Commission law."

Iraq has no choice but to investigate claims of fraud as advised by the UN.

10 days....what is 10 more days compared to the more dreaded "soon"

"Kubiš, who heads the United Nations Assistance Mission for Iraq (UNAMI), called on Iraqi authorities to investigate claims of fraud in the election and "to adjudicate all appeals properly." On May 17, the UN called on Iraq to "immediately" investigate the claims."

Surprise .. Know the losing alliances of the election recount

Surprise .. Know the losing alliances of the election recount

Iraqi political sources revealed on Saturday the most prominent lists threatened by the loss of a number of parliamentary seats obtained in the recent elections, after the decisions of the last parliament.

"The Arab site 21 quoted sources as saying that" prominent electoral lists will lose part of the parliamentary seats declared by the Electoral Commission victory, and raised a wide controversy over the fraud and manipulation of the results. "

He explained that "the abolition of the parliament for the votes of the outside and the voting of the displaced and the balance of population and conditionalities (prisons and hospitals), will lead to the loss of people announced that the Commission won seats in the next parliament, because they got their votes from these centers."

The sources stressed that "the most prominent loser lists is the coalition of Iraq, which was formed from small lists in Baghdad and the provinces with a Sunni majority, and leads the political coalition Jamal Karbouli, where he was the first accused to buy polling stations in Jordan, as well as centers of the displaced and the weight of population.

She pointed out that "the Karbouli coalition got about 31 seats, and is expected to lose about half of them, because of the cancellation of the voices of displaced people and other centers that he was said to have purchased with the collusion of the President of the Commission Maen Haitawi."

The sources pointed out that "the mass of Asaib Ahl al-Haq affiliated with the Fatah alliance will receive the largest share of the losers, for accusing them of buying votes and manipulation of the election results, where it announced that it won about 17 seats, having had one seat in the current parliament."

According to information provided by the sources, the "alliance of the fall of the leader of the Sadrist movement, will also lose a number of parliamentary seats, in a number of provinces, because of the cancellation of votes."

The MP Rahim Darraji, leader of the alliance, "conquest" led by Hadi Amiri said that "the parliament's vote on the return of counting and sorting manually, will change the results by 70 percent, and perhaps turn the equation and change the results by 90 percent."

Dia al-Asadi, official of the Sadrist movement's political bureau, launched a scathing attack on the Iraqi parliament, saying that "those who lost the elections are not entitled to hijack parliament or manipulate its decisions."

The Iraqi parliament decided on Wednesday to compel the Electoral Commission to re-count and hand count the votes in the last legislative elections held on May 12, where the Shiite cleric Moqtada al-Sadr won a surprise victory.

The decisions of the Parliament included the withdrawal of the Office of the Commission in the Electoral Commission, the assignment of nine judges to manage their functions, and the elimination of reliance on the electronic results accelerator.
