Article 3 - This law aims at the following: First: - Participation of voters in the selection of their representatives in the Council of provinces and districts. Second: Equality in electoral participation. Third: Ensure the rights of the voter and the candidate in the electoral participation. Fourth: Ensure the fairness, freedom and impartiality of the elections. Fifth: Providing legal protection for the stages and procedures of the electoral process. Chapter II The right to vote
 
Article 4: First: The election is a right for every Iraqi who meets the conditions stipulated in this law to exercise this right without distinction as to race, race, nationality, origin, color, religion, sect, belief, opinion or economic or social status. Second: Every voter shall exercise his right to vote for free, direct, secret and individual elections.
 
Article 5 - The voter must be: - First: - Iraqi nationality. Second: - Full eligibility. Third: - 18 (18) years of age in the year in which the elections are held. Fourth: - Registered in the register of voters in accordance with the provisions of this law and instructions issued by the Commission.
 
Article 6: First: - The Council of Ministers on the proposal of the Independent High Electoral Commission to disrupt the official time for the days of provincial councils and districts Second: - The Council of Ministers in consultation with the Independent High Electoral Commission to postpone the elections of provincial councils and districts as it postponed in one or more provinces. Chapter III Right of nomination
 
Article 7: The candidate shall be required to: First: - A full Iraqi citizen (30) thirty years of age in the year in which elections are held. Second: - Holds a bachelor's degree or equivalent at the time of nomination. Third: Good conduct and conduct that is not sentenced to a felony or financial or administrative corruption or crime against honor. Fourth: A resident of the governorate under the Civil Status Register or a permanent resident for a period of not less than (10) ten years, provided that his residence is not for the purposes of demographic change. Fifth: - Not covered by the provisions of accountability and justice or any law replaces it. Sixth: - Not convicted because of illegal enrichment at the expense of the homeland or public money by a court order. Seventh: He should not be a member of the armed forces or the security services or a judge when he is nominated.
 
Article 8: First: The Commission shall submit lists of candidates to the Ministry of Higher Education and Scientific Research, the Ministry of the Interior and the Supreme National Authority for Accountability and Justice, each according to its competence to decide within fifteen (15) days from the date of receipt. Second: Candidates are subject to the approval of the Commission. Third: The wages of the participation of the party or the political organization or the individual in the elections shall be determined by a decision issued by the Independent High Electoral Commission.
 
Article 9 - Nomination shall be in accordance with the open list system. The voter shall have the right to vote for the list or for the list of candidates and the individual election.
 
Article 10 - No political parties or organizations shall be allowed to withdraw from the winning candidate the seat assigned to him at any time.
 
Article 11 - I. Voting is personal and confidential. Second: The voter may not vote more than once in the same election. (1, 3, 5, 7, etc.) and the number of seats in the electoral constituency. Then, the highest number of division results shall be conducted to give a seat and repeat the situation until all the seats of the constituency Elections. Second, the distribution of seats to the candidates of the list and re-arrange the candidates based on the number of votes obtained by the candidate and the first winner is the one who gets the most votes in the open list and so for the rest of the candidates to be a woman after the end of all three winners regardless of the winners of men .
 
Article (13) First, if two or more candidates in the same electoral list receive equal valid votes and their last rank within the constituency, the approved sequence of the party or political organization shall be adopted in the electoral list to determine the winner of the electoral seat. Second: (If two lists obtained an equal distribution of income that qualifies them to obtain a seat and this was the last seat in the constituency, the draw shall be taken for the seat).
 
Article 14 - First - If the member of the Council lost his seat for any reason was replaced by the next candidate in the number of votes obtained in the list. Second: If a member of the Council loses his seat for any reason and was on a single list, allocates the seat to another candidate who holds the highest votes for a party or political organization that obtained the highest number of votes and did not get a seat Third: If the vacant seat belongs to a woman, it is not required to be replaced by another woman unless it affects the representation of women.
 
Article 15 First: The following seats shall be allocated to the components specified for each component within the seats of the provincial councils not organized in a region: (3) Three seats for Christians, Sabean Mandaeans and Fili Kurds in Baghdad. (3) Three seats for each of the Christians, Yazidis and Shabak in Nineveh. (1) one seat for Christians in Basra. (1) one seat for the Faily Kurds in Wasit. (C) (1) one seat for Mandaeans in Maysan. Second: - The seat is allocated to the list that gets the highest votes and allocated to the candidate who gets the highest votes in the list.
 
Article 16 The counting and counting process shall take place in the polling stations immediately after the completion of the polling process. The Commission shall provide the agents of the political parties, political organizations or the candidate individual with a certified copy of the counting and counting results for each polling station.
 
Article 17 First: The Commission shall register voters who meet the conditions stipulated in this law. Second: The Commission shall prepare and update the primary register of voters in cooperation and coordination with the regional offices and governorates not organized in a region. Third: Every person who meets the conditions of the election shall have the right to request that his name be registered in the primary register of voters and he shall have the right to verify his name if he is not present. Fourth: Registration shall be done in person or in accordance with procedures issued by the Commission. Fifth: The voter may not be registered in more than one constituency.
 
Article 18 - First - The Commission shall determine the number of seats in the electoral district and in the preparation of the voter register on the latest database of the voter register prepared according to the ration card database and updated with voter registration centers. Second: After the completion of the process of organizing the register of primary voters is announced so that local and international observers and journalists and the media can monitor and see it.
 
Article (19): The electoral register of each constituency with the names of the voters in alphabetical order or the biometric registration form for those who have registered with the Commission shall be displayed in a prominent place within the registration center for easy access.
 
Article 20 First: Any person whose name is not included in the primary register of voters and anyone who has a mistake in the data relating to his registration shall submit an objection to the head office of the High Commission or its branches in the regions and governorates not organized in a territory to include his name or correct his data in the register. Second: The objection shall be submitted in writing to the head office or branches in the regions and governorates not organized in a region in accordance with the provisions of this law within (7) days from the day after the end of the date of updating Voters register. Third: The Office of the Commission shall decide on the objection within three (3) days from the date of registration of the appeal. The decision shall be subject to appeal before the Board of Commissioners within three days from the date of the decision on the outcome of the appeal.
 
Article 21 The primary register shall be final and the ballot shall be held after the expiry of the term of objection against it or the dissolution of the objections submitted in respect of the provisions stipulated in Article (21) of this law. Chapter V Constituencies
 
Article 22 - Every voter shall exercise his electoral right himself in the electoral district where he is registered in the register of voters, subject to the provisions of Article (20) of this law.
 
Article -23- First: Every governorate that is not organized in a province according to the official administrative boundaries shall be one constituency in the provincial council elections. Second: Each district according to the official administrative boundaries shall be one electoral district in the district council elections. Chapter six Election campaigning
 
Article 24 - Free election advertising is guaranteed to the candidate under the provisions of this law, starting from the date of the Commission's authorization to start the election campaign officially and ends 24 hours before the date of the elections.
 
Article 25: Election propaganda shall be exempted from any fees.
 
Article (26) First: The Municipality of Baghdad and the relevant municipalities in the Region and the governorates not organized in a region in coordination with the Commission shall specify the places where electoral advertising is prohibited and the electoral ads shall be stuck throughout the period prior to the day specified for the elections and the publication of any advertisement, . Second: Political parties, political organizations or individual candidates on a single list must participate in the elections. Remove election posters according to the instructions issued by the Commission.
 
Article 27 The election meetings held by the candidate or his supporters shall be prohibited. The purpose of the elections shall be to publicize the candidate during the period specified in this law in the buildings occupied by the ministries and entities not affiliated with the ministry and the various state departments.
 
Article 28 - It is prohibited to use the official logo of the State in meetings, advertisements, electoral leaflets, writings and drawings used in the electoral campaign.
 
Article 29 The employees of the State, the public sector and the local authorities shall not use their professional influence or the resources of the State, its means or apparatus for the benefit of themselves or any candidate, including its security and military agencies, in electoral propaganda or influence on voters.
 
Article (30) First: Any party, group, organization, individuals or any entity shall be prohibited from practicing any form of pressure, intimidation, atonement, intimidation, intimidation, giving or promising material gains. Second: Any political party or organization that keeps armed militias from participating in elections shall be deprived. Thirdly: Any political party or organization is prohibited from participating in the elections and counting the votes in case it closes an electoral area by force or threatens to force the force in its favor or against others.
 
Article 31 - The use of government departments and places of worship shall be prohibited by any means for the purpose of electoral propaganda.
 
Article 32 - Candidates are prohibited from carrying out any electoral propaganda that involves deceiving, cheating or using the style of insulting or defaming others in the election campaign.
 
Article 33 The expenditure on electoral advertising shall be prohibited from public funds or from the federal budget allocated to ministries or entities not affiliated with the Ministry or from the Waqf funds or from external support funds.
 
Article (34) First: No candidate may, on the day of voting, distribute work programs, publications, cards or other documents by himself or by others. Second: It is not permissible for any of the employees of the government departments, the public sector or members of the local authorities to distribute the work programs by himself or by others. Thirdly: It is not permissible to place advertisements or distribute work programs, publications or cards in the name of a candidate who is not registered in the list of candidates. Chapter VII Governorate of Kirkuk
 
Article 35 The elections of the Kirkuk Provincial Council shall be held under the provisions of this law as follows: 1. The Independent High Electoral Commission (IHEC), in coordination with the relevant ministries (Interior, Trade, Planning and Health), shall check the records of the voters before the elections. 2. In the event that it is impossible to check before the elections, the above mechanism shall be carried out to check the records no later than six months from the commencement of the work of the elected provincial council. 3 - Determine the mechanism determined by the provincial council elected to share senior positions in the province except the federal posts, given priority to the people of the province in the event of availability of legal conditions and to ensure the representation of components. 4- The results of the local elections shall not result in any administrative or legal action concerning the future of Kirkuk governorate. 5. One seat shall be allocated by the Kirkuk Governorate Council to the Christian component "(Assyrian Chaldean Assyrians) The provisions of this Article shall apply to one electoral cycle of four years. Chapter VIII Electoral Crimes
 
Article (36): A term of not less than (6) six months or a fine of not less than (500000) five hundred thousand dinars and not exceeding (1000000) million dinars shall be punished by imprisonment for: First: - deliberately inserting a name or names or false features in the first of the voters or deliberately not to include a name contrary to the provisions of this law. Second: - The inclusion of his name or the name of another without the availability of the required legal requirements and proved that he knows this and all who reached the lack of the inclusion of another name or delete it. Thirdly: he cast his vote in the election knowing that his name was included in the voters' register contrary to the law or that he has lost the legal conditions required to use his right in the elections. Fourthly: The vote shall be taken in the name of others. Fifth: - Reveal the secret of the vote of a voter without his consent. Sixth: - used his right to one election more than once. Seventh: - The will of the illiterate voter and wrote a name or sign on a symbol other than the voter intended or obstructed any voter to prevent him from exercising his right to vote. Eighth: Nominated in more than one constituency or electoral list.
 
Article 37: A term of not less than one year shall be imposed on: First: Use force or threat to prevent a voter from using his right to force him to vote in a particular way or abstain from voting. Second: - Give or offer or promise to give a voter benefit for himself or others to make him vote on a particular face or abstain from voting. Third: - Before or requesting interest for himself or for others who was entrusted with the performance of public service in the electoral process. Fourth: - Disseminate or broadcast among the voters incorrect news about the behavior or reputation of one of the candidates in order to influence the views of voters in the result of the election. Fifth: - He entered the electoral headquarters carrying a firearm or a victim in violation of the provisions of this law. Sixth: Spoiling, slapping or hitting the Election Commission or one of its members during the election process. Seventh: - tampering with the ballot boxes or electoral lists or any documents related to the electoral process.
 
Article (38) A penalty of not less than one year or a fine of not less than (1000000) million dinars and not more than (5 million) five million shall be imposed on anyone who acquires, conceals, misses, destroys, spoils, steals the ballot papers or the first or last voters In any way.
 
Article (39) Any person who pastes data, photographs or special electoral bulletins outside the places assigned to them shall be punished by imprisonment for a period not exceeding one month and a fine not exceeding JD (1000000) million.
 
Article 40: A term of not less than one month and not more than one year shall be punishable by: First, deliberately attacking the photographs of candidates or their programs affixed in the places designated for them to another account or a specific party with the intent to harm this candidate or influence the conduct of the electoral process. Second: Declared the withdrawal of one or more candidates from the electoral process, knowing that this is not true, with the intention of influencing voters or turning the candidate's votes to him. Third: Attacks on the means of electoral propaganda allowed for any reason, whether it was to be destroyed or ripped or otherwise or any such behavior.
 
Article (41) First: A term of not less than (1) month and not exceeding (6) six months and a fine of not less than (1000000) million dinars and not exceeding (5 million) five million shall be punishable by imprisonment for violating the provisions of articles (30, 31) , 32, 35, 36) of this Act. Second: A temporary imprisonment and a fine of not less than (10,000,000) ten million and not more than (25000000) twenty five million shall be punished by anyone who contravenes the provisions of Articles (33) and (34) of this Law.
 
Article 42 - The initiation of election offenses provided for in this Law shall be punishable by the offense of complete punishment
 
Article (43) First: If the contribution of the party or the political organization or individual candidate to a single list in committing any of the electoral crimes stipulated in this law is proven to be punishable by a fine of 50 million dinars Second: The Council of the Commission may deprive the party or the political organization or individual candidate of a single list of votes obtained in the electoral center in case of committing one of the electoral crimes stipulated in items (I), (V), (VI) and (VII) 39) and Article (40) of this law. Chapter IX General electoral provisions
 
Article (44) First: The provincial elections shall be held with the Chamber of Deputies on the same constitutional date as the parliamentary elections. Second: - The government is committed to providing security, humanitarian and technical conditions for the provincial council elections and has the right to delay them in some provinces if these conditions are not available. Third: - The provincial councils that are not organized in the province and the sub-districts in the administration of its affairs until the election of new councils.
 
Article 45: First: A special vote shall be taken for the military and internal security forces, and the conditions for participation in the general vote shall not be permitted in accordance with instructions issued by the Commission not to vote in the military units. Second: The Commission shall carry out the procedures to ensure that those covered by the special vote are removed from the final voter register.
 
Article 46. Specific electoral centers shall be allocated to displaced persons and displaced persons in their areas of residence for the purpose of casting their votes for their candidates in the areas of abandonment or displacement. UNHCR shall determine the mechanism for their registration under instructions issued by the Commission.
 
Article (47) The duration of the electoral cycle of the governorate council and the judiciary shall be four calendar years starting with the first session.
 
Article 48 The Independent Electoral Commission shall issue instructions to facilitate the implementation of the provisions of this law.
 
Article 49: No provision shall be made in contradiction to the provisions of this Law.
 
Article (50) The Law of Provincial, District and District Elections No. (36) for the year 2008 shall be repealed except Article (23) of the Law until local elections are held in Kirkuk. Article 15: This Law shall be implemented from the date of its publication in the Official Gazette. Positive reasons For the purpose of holding free and fair elections for the provinces not organized in the province and its districts and to be democratic elections away from external influences and in order to raise these elections to the required level.
