The Federal Supreme Court on Sunday issued a decision on the formation of a committee of the House of Representatives to nominate the members of the Independent High Electoral Commission, confirming that this does not contradict with the Constitution.

"The Federal Supreme Court held its session and considered the appeal against the unconstitutionality of article 3 (II) of Chapter III of the law of the Independent Electoral Commission for elections and demand its cancellation," spokesman Ayas al-Samuk said in a statement received by Mawazine News.

He added that "the appeal focused on the establishment of a committee of the House of Representatives nominated members of the Board of Commissioners on the grounds that this constitutes a violation of the provisions of the Iraqi Constitution"

The Samok, that "the court found in its decision of (7/11/2017) No. (88 / Federal / 2017) that the committee formed of the House of Representatives, which took the nomination of members of the Board of Commissioners, provided for in Article (9 / II) of the law Independent Electoral Commission, and that its nomination was to fulfill its obligations under the law.

He explained that "the appellant relied on the members of the Commission of the owners of special grades that need to be nominated by the Council of Ministers."

He pointed out that "the decision of the court stated that this nomination does not intersect with the provisions of the Constitution; because the candidates are not the owners of special grades or agents of the ministry, but enjoy their privileges without the above mentioned, and therefore the court found that the lawsuit is not based on a bill of the Constitution, .anthy 29 / a 43

The House of Representatives is considering 3 amendments, including an increase in the number of seats

 Baghdad / Mohammed Sabah

The House of Representatives is considering amendments to its electoral law, including an increase in the number of seats to 390 seats.

The owners of this proposal are based on the high number of souls of Iraq to 39 million people, according to the statistics of the Ministry of Planning.
In article 49, the Iraqi constitution requires that there be one deputy for every 100,000 people.
There is a debate among lawmakers about the interpretation of this constitutional provision, whether it refers to voters or the total number of citizens. Parliament is moving to reduce its seats based on the first interpretation.
On Sunday, the House of Representatives ended its legislative term, delaying the completion of legal legislation for local and parliamentary elections early next year.
The Electoral Commission had pledged its commitment to the dates of the elections with the commitment of parliament to enact the laws of the budget and the provincial council and the House of Representatives before the end of December.
"There are differences that prevent the adoption of the provincial elections law," says Soran Ismail, head of the Parliamentary Committee of Regions and Provinces.
"The differences are related to the elections in Kirkuk province, which hampered the passage of the law and delay until the moment." He pointed out that "the parliament gave the components of Kirkuk more time to reach an agreement on these points of contention."
"There are talks between the components of Kirkuk did not rise to the required level." Pointing out that "the point of disagreement is the essence of the body that determines the fate of the province is the provincial council or parliament."
And turned the differences of components of Kirkuk to a node prevented the House of Representatives from completing the vote on the remaining items of the law of provincial and district elections. The draft law on local elections in force, in article 37 / I, contains a map of the holding of the elections in Kirkuk, which includes a number of requirements:
a) Reviewing and verifying all data and records relating to the status of the governorate which has not witnessed local elections since 2005. The population status of the governorate, including the voter register.
(B) A mechanism for the sharing of senior positions in the province, with the exception of federal posts, to ensure representation of all components of the governorate.
C / The status of the province of Kirkuk remains as it is currently until the decision of the House of Representatives to put the province in the future.
The Kurdish MP says that "Turkmen and Arab components in Kirkuk strongly insist that Kirkuk has a special law for one session," noting that "the Kurdish component demands the approval of the government project, but with an amendment to it allows to determine the fate of Kirkuk by the provincial council."
The head of the Committee of Regions that "these differences delayed the adoption of the election law for more than four," and expected "moves to the United Nations and the American administration to resolve all these differences on the law."
In parallel, the House of Representatives, in its last sessions, discussed the law of elections of the House of Representatives in force, and discussed the possibility of amending some of its items and was referred to the Legal Committee.
In this context, says Soran Ismail that "
The Kurdish MP said "there are parties and parties called for the Ministry of Planning updated statistics on the recent census of the souls of Iraq," noting that "the planning confirmed the high population of Iraq to 39 million people during the current year."
"If the number of Iraqi souls increases, that would require an increase in the number of seats in parliament according to the constitution and the electoral law, which stipulate that every 100,000 people has a seat in parliament," said Soran Ismail. "There are proposals to increase the seats of parliament to 390 seats based on this statistic."
The parliamentary legal committee has ruled out, in a statement to (extent) last month, the possibility of completing legislative legislation elections of the Council of Representatives and provincial councils before the end of this year. She spoke of a consensus not to abide by the date of elections.
In October, the cabinet set the date for parliamentary elections in mid-May. He affirmed his commitment to providing the safe and necessary environment for holding elections, returning displaced persons to their areas and voting electronically.
At the same time, MP Kamel al-Zaidi, a member of the legal committee, that "the proposals submitted to the law of the elections of the House of Representatives focused on the police age and the academic certificate of the candidate." Revealing "the existence of reservations to determine the candidate's bachelor's degree, and demands the adoption of a preparatory certificate in the upcoming elections."
"The issue of age will be set between 28 - 30 years for the candidate," Zaidi said, referring to "proposals to reduce the number of seats in the House of Representatives in the next parliamentary session."
The member of the Legal Committee that "the House of Representatives tends to reduce the number of seats and not increase," stressing that "
"There are deputies who talked about increasing the number of seats in parliament from 275 seats to 328 seats based on population growth," Zaidi said. "But the existing proposal is to reduce seats." He stressed that the proposals will be studied in the relevant parliamentary committees.

They can barely get a quorum when they meet now. What makes them think adding 50 more fat cats will accomplish anything except bloat the GOI payroll. They're overpaid to do nothing already.  If there ever was a swamp that needs draining, it's in Iraq.  IMHO of course.  ;)

The call is approaching the option of two lists .. The differences postpone the founding conference

 Baghdad / Mohammed Sabah

The deadline for the registration of political parties wishing to run for elections is nearing completion, at a time when the Dawa Party has not yet completed its registration procedures, particularly the convening of its general conference. But the Electoral Commission has kept the door open to parties that fail to establish its constituent conference if the rest of the proceedings are completed.

The extent (revealed), in April last, that the differences forced the call to postpone the convening of the party conference for more than two years after it was scheduled in 2015. The sources said at the time, "a great fear among the leaders of the party that the holding of the electoral conference to multiple splits because of Disagreements Maliki and Abadi and the writer. "
The dispute cast a shadow over the party's preparations for the next election. As he approaches the adoption of the option to get down on two lists leading both Maliki and Prime Minister Haider Abadi, a solution to compete between the two men.
"The General Conference of the Dawa party was delayed for two years due to differences and problems between the party's secretary general Nuri al-Maliki and Haidar al-Abadi, who contributed to the postponement of his contract more than once," said a senior leader of the Dawa Party. Despite the differences that prevented the convening of the General Conference, but he got a leave of establishment from the Electoral Commission to allow him to run in the local and parliamentary elections to come. The source close informed, asking not to be identified, that "the Dawa Party resolved the crisis of participation in the upcoming elections and decided to enter two lists, one led by Nuri al-Maliki and another led by Haider Abadi, a solution to the intersections between the two men on the serial number one."
The leadership of the Dawa Party that "the leadership of the party will be divided into two parts, one will be with Maliki, and the other with Abadi, while granting freedom to the candidates within the invitation to join any of the lists," noting that "
The widely-informed source added that "Abadi was insisting on getting the number one in the Dawa Party's electoral list," adding that "participating in two electoral lists for the Dawa Party is part of the solution to the differences between the party leadership."
The former MP recognizes that "the differences between al-Maliki and Abadi reflected on the figures within the Dawa Party has been deported," and expected "the continued exclusion and removal of some figures from within the Dawa Party because of intersections within the party."
The leader of the Dawa party is likely to "remove more members of the party before holding the founding conference of the Dawa party in the event of this year in order to prevent them from reaching the new leadership." He revealed "the existence of pressure from the wings of Abadi and Maliki to hold a founding conference of the party in the coming periods."
The Parties Law and the instructions of the Electoral Commission, the political parties and entities that have been granted a founding leave, need to hold a founding conference within a period of not more than 90 days as a prerequisite for the elections.
On the option of multiple lists, which resorted to the Dawa Party, says MP Khalaf Abdul-Samad, head of the parliamentary Dawa bloc, "The party discussed participation in one list or two lists, and there are those who see entry two lists and another section would prefer to participate in one list and each of its causes."
"The decision is submitted to the leadership of the Dawa party, which will determine in the coming periods the decision to enter one list or two lists," Abdul Samad said in an interview with Al-Mada.
And denies the leadership of the Dawa Party, there are differences within the Dawa Party, except for the performance of the government, stressing "
On the delay of holding the founding conference of the Dawa Party, despite receiving a leave of establishment, says Khalaf Abdul-Samad that "delaying the convening of the founding conference of the Dawa Party is not the first time." He played down the importance of talking about disagreements within the party that hampered the holding of his general conference more than once.
The deputy MP from Basra, "there are natural problems contributed to the delay of the conference, is the presence of advocates outside Iraq," ruling out a general conference of the Dawa Party at the moment, "likely to postpone until after the next election On the alliances of the Dawa Party, says Abdel-Samad Khalaf, For the Dawa party with a number of parties, but did not reach the level of alliances. "The spokesman for the Council of the Electoral Commission Karim Tamimi told the (range), last week," The Commission set December 21 as a deadline to close registration for parties wishing to participate in the Next elections ".
The Commission opened the door to the registration of political alliances on November 19 last and that the registration is closed on December 28. In the same context, the Electoral Commission asserts that it "issued regulations, regulations and regulations governing the work in the Law of Parties No. 36, which was voted by the House of Representatives in 2015, requiring the political party after obtaining the establishment leave, the establishment of a conference of the General Assembly within ninety days of granting the license."
"The conference of the General Assembly will be followed by the adoption of the rules of procedure and the political program," Riyad al-Badran, director of the electoral district, told Al-Mada.
"In the event of intersections and disagreements within the party, which granted establishment leave, hinder the conduct of the conference can submit a detailed report to the Party Department in the Electoral Commission to demand the postponement of the Constituent Assembly for a limited period determined by the circumstances.
"After granting the political party permission to convert the party's file to the follow-up department, which is coordinating with these parties to establish constituent conferences to achieve in the search for the selection of the new leadership."
"The participation of any new party in the upcoming elections is conditional on obtaining the establishment license restricted by holding a founding conference of the party within 90 days, which includes the election of a new leader and leadership of the party." "The party that took the leave of establishment is not entitled to run in the next election without convening a constituent assembly," he said. But the member of the Council stresses that "the old parties are not required to hold constituent conferences on the grounds that they held these conferences earlier, and has a head of the party and a public body and the administration of finance," stressing that "the old parties submitted their internal systems to the circle of parties that ratified it."
Badran notes that "the internal regulations of these parties, which have been ratified by the Party Department, set the dates for the election of the leadership and also determine the age of this presidency may be for five years or less or more," revealing "the establishment of some parties changes and amendments in their internal systems, In line with the new party law.
